SUBJECT 1985-86 Contract Agreement with the County of Alameda
Library for Additional Library Services

RECOMMENDATION 1 . Authorize additional library hours for Thursday
evenings
2 . Adopt Resolution approving contract with the
County of Alameda for additional library services
and authorize Mayor to execute said agreement
FINANCIAL STATEMENT: Total cost to the City for existing Monday library
services and additional four hours of library service
on Thursday $63 , 239. Amount Budgeted $69 , 740 .
DESCRIPTION On June 25 , 1985 the City Council adopted the City' s
1985-86 Annual Budget . This Budget included the allocation of funds for
four additional hours of library service to be provided at the Dublin
Library. The total additional cost of adding the four hours of library
services to the City for a year is $26 , 005 . This would increase the City' s
total subsidy to the operation of the Library to $69, 741 •
The County has prepared a revised Contractual Agreement for Fiscal Year
1985-86. This agreement is substantially the same as the agreement approved
by the City Council during �Fiscal Year 1984-85 except for the fact that it
provides four additional hours of library service commencing October 1 ,
1985 . The County Librarian had indicated that it would be necessary to
start at this time because of the time required to get the Board of
Supervisors approval and the County Budget finalized , as well as the
recruitment of new personnel .
The County Librarian and City Staff have discussed the desirability of
providing additional evening hours on Monday evenings versus Thursday
evenings . Since the City Council holds its meetings on Monday evenings and
there is limited parking . It is Staff ' s position that Thursday evenings may
be better for the purpose of adding hours to the library. / If parking was
difficult for library patrons on Monday evenings due to City Council meeting
parking requirements , library patrons may not decide to take advantage of
the additional hours .
The County Librarian has written the contracts so as to give the flexibility
to provide evening service on either Monday or Thursday , so that if the City
does change its meeting place , the addition of Monday library hours could be
accommodated .
It is Staff ' s recommendation that the City Council approve the addition of
library hours to Thursday evenings and .adopt the resolution approving the
contract with the County of Alameda for additional library services for
Fiscal Year 1985-86 .

SUBJECT: REVISED ADDED HOURS CONTRACT
I am pleased that the Dublin City Council has decided to increase the number
of hours that the Library will be open. I }mow that the citizens of Dublin
will also be very pleased and will continue to make excellent use of their
library!
Opening the Library on Monday evening continues to be my recommendation for
the time that would be of most use for library users. Thursday evening is
also a possibility. I am sure the Library would be well used that night, too.
The major problem with Monday evening Library hours is parking. On Monday
evening when the City Council or Planning Commission have items of special
interest, the Library's parking lot is FULL. I would hate to see library
users and city meeting_ attenders competing for parking space!
After discussing, this problem with City Manager Richard Ambrose, we decided
that Thursday evening would be the best choice. If another alternative should
develop for City Council meetings (Don't hurry to find one. We love having
you! ), we could then discuss changing to Mondays. In order to allow for this
possibility, the revised contract calls for the additional open hours to be
either Monday or Thursday evening. I hope this meets with your approval.
We anticipate that these additional hours would start by at least October 1.
The contract calls for you to pay the amount needed to fund the four
additional hours for nine months of the year.
Again, thank you for your good decision and your continued support of the
Library.

SUBJECT: REVISED CONTRACT
Here is the revised contract for added hours. The Alameda County Board of
Supervisors needs 5 originally signed copies of the contract for processing.
Please return the 5 enclosed copies, signed, to Barbara Baxter, Acting Dublin
Branch Manager or directly to me for further processing.
You will note in the letter to City Council that I once again raised the issue
of which night we should open, Monday or Thursday. I think they should have
an opportunity to agree with our decision that Thursday night would be best,
in light of the parking problems that would exist if the Library were open on
Monday night.
I also will plan to attend the meeting on July 22nd and speak to this issue if
any Council members have questions.

CONTRACT AGREEMENT BETWEEN THE CITY OF DUBLIN
AND THE
COUNTY OF ALAMEDA
FOR
ADDITIONAL LIBRARY SERVICES
INTENT
WHEREAS, current funding level for County library services prevent
increasing the number of open hours per week at the Dublin Branch of the
Alameda County Library System, and
WHEREAS, the citizens of Dublin wish to have the Dublin Branch Library
open more than the current 37 hours per week, and
WHEREAS, the members of the Dublin City Council have authorized
funding for the increases in staffing and utility costs required to open
the Dublin Branch eleven ( 11 ) additional hours for a total of 48 open
hours per week; therefore,
The City of Dublin and the County of Alameda agree to provide eleven (11)
additional hours per week of library services at the Dublin Branch of the
Alameda County Library System subject to the following terms and
conditions .
TERMS AND CONDITIONS
1) Effective Dates : This contract will be in effect from July 1, 1985 to
June 30 , 1986 .
2 ) Services Described: The County- of Alameda agrees to provide seven (7 )
additional hours of library services at the Dublin Branch Library each
Monday, excluding County observed holidays, from 10 :00 a.m. to
5 :00 p.m. from July 1, 1985 through June 30 , 1986 . The County of
Alameda will, in addition, provide four ( 4 ) additional hours of
library services at the Dublin Branch Library each Monday or Thursday,
excluding County observed holidays, from 5 :00 p.m. to 9 : 00 p.m.
commencing October, 1985 .
3 ) Payments : The City of Dublin agrees to pay the County of Alameda
$63 , 239 in four ( 4 ) quarterly installments as follows :
September 30 , 1985 - $10,934
December 31, 1985 $17,435
March 31, 1986 - $17 , 435
June 30, 1986 - $17, 435
4 ) Extension: All terms and conditions of this contract may be extended,
by mutual agreement, on a year-to-year basis, provided the amount paid
by the City of Dublin to the County of Alameda is adjusted annually to
reflect increases/decreases to the costs connected with providing the
services.
5 ) Periodic Activity Reports : Activity Reports will be provided by the
County Librarian to the Dublin City Council. Dublin City Council can
request such reports at any time.
6 ) Option to Terminate or Renegotiate Contract: This contract is
predicated on the assumption that library service levels will remain
constant. Should any circumstance arise which changes both County
Library funding levels and levels of service, either party shall have
the right to terminate or renegotiate this agreement by giving at
least thirty ( 30 ) days written notice.
7 ) Liability:
a) All persons employed in the performance of such services and
functions for City of Dublin shall be County employees, and no City
employees as such shall be taken over by the County and no person
hereunder shall have any City pension, Civic Service, or other status
or right.

b) The City shall not be called upon to assume any liability for the
direct payment of any salary, wages, or other compensation to any
County personnel performing services hereunder for the City, or any
liability other than that provided for in this agreement.
Except as herein otherwise specified, the City shall not be liable for
compensation or indemnity to any County employee for injury or
sickness arising out of his/her employment.
c ) The County will assume liability and pay cost of defense and hold
the City harmless from loss, costs or expenses caused by the negligent
or wrongful act or omission of County officers, agents and employees
occurring in the performance of agreements between the parties hereto
to the extent that such liability is imposed on the City by the
provisions of Section 895. 2 of the Government Code of the State of
California. In addition, when liability arises pursuant to Section
830 et seq. , of the Government Code, by reasons of a dangerous
condition of public property of the County, the County shall assume
liability and pay cost of defense and hold the City harmless from
loss, costs or expenses caused by the negligent or wrongful act or
omission of County officers , agents and employees, whether or not
arising in the performance of an agreement between the parties hereto.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

APPROVING A CONTRACT WITH THE COUNTY OF ALAMEDA FOR ADDITIONAL
LIBRARY SERVICES DURING FISCAL YEAR 1985-86
WHEREAS , the services provided at the Dublin Library
have been historically reduced by the County due to lack of
fundings ; and
WHEREAS , the City Council of the City of Dublin has
improved library services to the community by funding the opening
of the Dublin Branch Library on Monday' s from 10:00 a.m. to 5 :00
p .m for the last two years ; and
WHEREAS , the Dublin City Council is desirous of
increasing the number of evening hours that the Dublin Branch
Library is open; and
WHEREAS , the Dublin City Council has allocated $26,005
for Fiscal Year 1985-86 to open the Library for an additional four
hours in the evening; and
WHEREAS , the County of Alameda has agreed to provide the
additional library hours at the Dublin Branch of the Alameda
County Library System.
NOW, THEREFORE , BE IT RESOLVED that the Dublin City
Council does hereby approve the attached agreement between the
City of Dublin and the County of ,Alameda for additional library
services and further authorizes the Mayor to execute said
agreement .
