Authorize Mayor to Execute Agreement FINANCIAL STATEMENT $17, 380 to $19, 750 Sufficient Funds are Budgeted DESCRIPTION At the City Council meeting of July 22 , 1985, the Council approved the Request for Proposal for the Park Development Plan and authorized staff to invite interested firms to submit proposals. In addition a review committee was established consisting of the City Manager, the Recreation Director, the City Engineer, one member of the City Council and one member of the Park and Recreation Commission. Five firms submitted proposals for the Park Development Plan which are shown summarized in Exhibit A. After completing interviews with four of the five firms, the committee recommended that the firm of Singer & Hodges, Inc . , Landscape Architecture be retained to provide consulting services to the City of Dublin for the Park Development Plan. Staff has done background investigations of the firm and concurs with the committees recommendation. In addition, it is recommended that the bid be awarded for Option II, an overall Park Development Plan to include Dolan, Dougherty Hills, East Dougherty Hills , Kolb, Mape and Shannon Parks . It is estimated that Option II will be approximately $19, 750 and take 4-6 months to complete . As the configuration of Kolb Park has not yet been determined and as ownership is uncertain at this time, an additional clause should be inserted which would provide for the deletion of Kolb Park from the contract in the event that the acquisition is not completed during the course of the contract (approximately 4-6 months ) . Staff has prepared a contract detailing the specific responsibilities of the Contractor and the City (Exhibit C) . Philip Singer of Singer & Hodges, Inc . , proposed project leader for the Park Development Plan, has reviewed the contract and is in agreement with the contract specifications . The Park and Recreation Commission at their October 8, 1985 meeting made the following recommendations : 1 . Approve hiring of Singer & Hodges, Inc . 2 . This firm of landscape architects provides consultation, master planning, design studies, preliminary plans , construction documents,' and construction review services for site planning, park and recreation, and other landscape architectural projects . The firm consists of Peter Callander - Principal, Margaret Fahringer - Associate, three project Landscape Architects and four other technical staff personnel . All work under this project would be coordinated by and under the direct supervision of the principal and senior project landscape architect . Callander Associates recommends grouping the parks into one project as substiantial economics of professional time can be effectuated in doing so . Additional economics can also be implemented through possible : a. ..Joint meetings on two or more parks in a given neighborhood; I ' b . meetings with City staff on several parks at once; C . reviewing documents prior to final reproduction to avoid secondary reproduction expenses, and d. careful consideration on the type and quantity of reproduction for the final report. Cardoza-Dilallo-Harrington is a creative, design/research firm that produces and manages solutions using multi-disciplinary talents to meet the needs of its clients and profession. Established in 1971, the firm has grown from two founders to five partners . with diversified talents . Services include a wide variety of disciplines from multi-faceted community developments to urban streetscapes and pedestrian plazas to recreation facility planning and physical design to commercial entities and major industrial complexes . Robert Stone, ASLA, will be the Principal-in-Charge -of the project responsible for the overall direction of the project, ensuring the quality and performance of the firm. William Talley, Project Manager, will be the direct contact with the City and responsible for preparation of the plar}s and report. l In addition, this firm suggests a program for recreation and park needs . In order to design development options for the six sites, the whole program for recreation and park needs should be resolved to insure a minimum future facility inventory and to avoid duplication of facilities . Recreation/park criteria should be established to predict need. In this program development, the potential of each of the six sites will be reviewed for appropriate facility potential and individual site program established with staff . The cost would . be $4 , 300 . ' References - City of South San Francisco City of Petaluma City of Palo Alto City of Walnut Creek City of Daly City Town of Moraga East Bay Regional Park District r (Formats - Misc . #11 ) CITY OF DUBLIN AGREEMENT TO PROVIDE PROFESSIONAL SERVICES FOR DESIGN OF A PARK DEVELOPMENT PLAN THIS AGREEMENT, made and entered into this at Dublin, County of Alameda, State of California, by and between ' City of Dublin through its duly elected or appointed officers, hereinafter called "CITY" and Singer & Hodges, Inc . , hereinafter called "CONTRACTOR" . WITNESSETH: That the Contractor for and in consideration of the covenants, conditions, agreements, and stipulations of the City herein expressed, does hereby agree to furnish to the City . services and materials, as follows : Article I - Statement of Work The overall purpose of this contract is to complete a Park Development Plan for the City of .Dublin. The proposal submitted to the City on August 30, 1985 shall become a part of this agreement. Items not explicitly stated in this article, but contained in the proposal shall be considered to be a part of this agreement . A summary of the tasks identified below and a time frame for completion of the project is contained in Exhibit A. The date (s) may change, depending on when the Contractor receives notice to proceed and as approved by the City Manager. Contractor shall design a Park Development Plan and Report for the following six ( 6 ) sites : Dolan Park (5 acres ) Dougherty Hills Park (90 acres ) East Dougherty Hills Park ( 8 acres) Kolb Park ( 5 acres) Mape Park (3 acres) Shannon Park (10 acres) Contractor shall complete the following : A. Through site visitations and meetings with City staff, prepare two preliminary plan options per park site, illustrating recommended design and improvement options . B. Present plan options to each of the park neighborhoods for review and comment. Two meetings for each of the following parks - Dolan, Kolb, Mape and Shannon; three meetings combining Dougherty Hills and East Dougherty Hills . C. Modify park designs utilizing input from neighborhood meetings' and represent revised plans to each neighborhood. D. Present completed plans to the Park and Recreation Commission ( 2 meetings) . E. Prepare the Park Development Plan Report for staff review and comment . The report should include a brief analysis of each site, it ' s development potential, a summary of recommended improvements for each site and a reduced preliminary plan with development cost estimates and maintenance cost estimates for each site . F. Present the completed report to the City Council for approval (1 meeting) . City shall provide contractor with all existing site information necessary for completion of landscape architectural services indicated in the proposal, i .e. base maps, existing topography and soils information, site boundaries and aerial photographs . Article II - Costs Compensation For Services and Billing Procedure A. The fee for the services indicated in this contract shall be $19 , 750 . B. Bills shall be submitted monthly based on the progress of work. C. Net payment is 30 (thirty) days . D. The City shall retain 10% of the billing, which retention shall be paid to Contractor with final payment, upon acceptance by the City of the satisfactory final report. Reimbursable Expenses A. Reimbursable expenses are in addition to the compensation for services and include actual expenditures made by the employees and consultants of contractor in the interest of the project for the expenses listed in the following subparagraphs . 1 . Expense of additional reproductions , postage, and other documents that are not included in this agreement. 2 . If authorized in advance by the City, expense of overtime work requiring higher than regular rates . 3 . Expense of any additional renderings, models and mock-ups requested by the City, that are not included in the scope of Landscape Architectural services . 4 . Expense of any additional insurance coverage or limits, including professional liability insurance requested by the City in excess of that normally carried by Contractor or its consultants . Additional Services A. Any extra services in addition to those indicated in this proposal shall be billed at the hourly rates listed below in addition to the fee indicated in Article II above . Principal $55 per hour Associate $45 per hour Draftsperson $35 per hour Clerical $25 per hour Article III - Completion Date Contractor shall complete the work described in this contract within five months of a notice to proceed being issued by the City. It is understood that the City shall schedule neighborhood, commission and council meetings to facilitate completion of this project with a five month time period. P Article IV - Reports Contractor shall prepare a Park Development Plan Report for staff review and comment. The report shall contain a brief analysis of each site, its development potential, and a summary of recommended improvements for each of the six ( 6) park sites. A reduced preliminary plan, development cost estimate and maintenance cost estimate for each site will be included. Original art work, text, plans and estimate ready for printing will be presented to the City. The City shall be responsible for printing reports for distribution. In addition to original copy ready report, Contractor shall provide the City with colored renderings of each park site at 1 : 20 scale or 1"=30 scale and reproducible sepias of each park plan. Article V - Contract Termination This contract may be terminated at any time for breach and City may terminate unilaterally and without cause upon thirty days written notice to the contractor. All work performed pursuant to the contract and prior to the date of termination may be claimed for reimbursement . Article VI - Assignability Contractor shall not assign or transfer interest in this contract without the prior written consent of the City. Article VII - Amendment The City reserves the right to delete Kolb Park from the contract in the event the configuration is not determined during the course of the project . It is mutually understood that the sum of $2 , 370 will be deducted from the total cost of $19, 750 thus reducing the total cost to $17, 380 . Article VIII - Indemnification Contractor shall assume liability and pay all costs of defense, including legal fees and court costs, and hold the City harmless from loss, damages, costs or expenses caused by any negligent or wrongful acts or omissions of Contractor ' s officers, employees and agents which may occur in the performance of the term, duties and obligations of this agreement .
