RECOMMENDATION Adopt resolution approving application and direct
Staff to notify the State of a revision to the
acquisition schedule originally submitted with the
1984-85 application.

DESCRIPTION During the 1984 State election, a ballot measure was
included which approved the issuance of park development bonds. This
program provided for funding for park improvements in urban areas. The
local agency is required to contribute a matching contribution of at least
25% of the project cost. These grants are disbursed based upon population
and the City of Dublin' s 1985-86 allocation is $7, 549.
At the regular City Council meeting on April 22, 1985, the Council
authorized Staff to submit an application for the 1984-85 allocation. The
project identified for that project was the acquisition of the Kolb Park
Tennis Courts. The developer of Amador Lakes is required to make the
improvements at this location based upon their development agreement., Given
the existing documents and approved project, it is most expedient to apply
the 1985-86 allocation to the same project. The environmental documents
were previously processed and there has been no change in the scope of the
project.
The original submittal to the state had indicated an acquisition schedule
which assumed the date of acquisition to be completed by October 1, 1985.
Staff has revised the acquisition schedule to indicate a date of March 31,
1986. It is important that the project be completed within 3 years of the
State Park Bond Allocation. Although the Murray School District has not
been able to give a precise date as to the determination of when the
property would be available, Staff feels that this date of March 31, 1986
will allow adequate time to complete the transaction.
It is recommended that the City Council adopt the resolution approving the
application for grant funds and direct Staff to file the appropriate
materials. Staff will also notify the State officials of the change in the
acquisition schedule.

APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE ROBERTI-Z 'BERG
URBAN OPEN SPACE AND RECREATION PROGRAM FOR
KOLB PARK TENNIS COURTS ACQUISITION
WHEREAS, the legislature of the State of California has enacted
the Roberti-Z 'berg Urban Open Space and Recreation Program, which provides
funds to certain political subdivisions of the State of California for
acquiring lands and for developing facilities to meet urban recreation
needs; and
WHEREAS, the State Department of Parks and Recreation has been
delegated the responsibility for the administration of the program, setting
up necessary procedures governing application by local agencies under the
program; and
WHEREAS, said procedures established by the State Department of
Parks and Recreation require the applicant to certify by resolution the
approval of applications prior to submission of said applications to the
state; and
WHEREAS, said applications contain a certification that the
applicant will comply with all federal, state and local environmental,
public health, relocation, affirmative action, and clearinghouse
requirements and all other appropriate codes, laws and regulations prior to
the expenditure of the grant funds; and
WHEREAS, the project applied for under this program must be of a
high priority and satisfy the most urgent park and recreation needs with
emphasis on unmet needs in the most heavily populated areas.
NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council
hereby;
1. Approves the filing of an application for funding under the Roberti-
Z 'berg Urban Open Space and Recreation Program; and
2. Certifies that said agency understands the general provisions of the
agreement; and
3. Certifies that said agency has or will have sufficient funds to
operate and maintain the project funded under this program; and
4. Certifies that said agency has or will have available prior to
commencement of any work on the project included in this application
matching money from a nonstate source; and
5. Certifies that the project included in this application conform to the
recreation element of any applicable city general plan; and
6. Appoints the City Manager as agent of the City to conduct all negotia-
ions, execute and submit all documents including but not limited to
applications , agreements, amendments, payment requests and so on which
may be necessary for the completion of the aforementioned project; and
7. Appoints the City Attorney as legal counsel for said agency with
authorization to sign the certification on page 1 of application.

Description of Project(Brief)
The Murray School District has declared the Fallon School site as surplus property.
This site includes an area known in the community as Kolb Park. The Kolb Park site
includes tennis courts which were developed by the Dublin San Ramon Services District,
a special district, prior to incorporation. The City of Dublin wants to preserve the
recreational facilities offered by the tennis courts.

IMPORTANT
You may incur costs against the grant only after your project has been approved by the Legislature and the State has
received your application signed by your attorney. All State requirements must be met and an agreement signed before
any funds will be disbursed.
An audit may be performed before or after final payment.
GRANT APPLICATION
A complete application consists of one each of the following 11 items.
1._ A completed application form signed by the person authorized in your resolution and by your attorney.
2-The resolution from your governing body authorizing the application.
3. Environmental Impact Report or Negative Declaration and a copy of Notice of Determination showing County
Clerk's stamp, or, if applicable, a copy of the Notice of Exemption if the project is categorically exempt,or the
reason why CEQA does not apply. Clearinghouse response is required if you have an EIR or Negative Declaration
for the project.
4. A city or county street map showing the project location in sufficient detail to find the site.
5. If property to be developed is not owned in fee,evidence of adequate land tenure. (Copies of leases,joint powers
agreements, permits,etc.)
6. A site plan for development projects. Map of the overall park showing location of project facilities, details of
access,water, power and sanitation.
7. Cost estimate. A detailed estimate of all projects costs.
8. Acquisition map and acquisition schedule listing number of parcels,size and approximate date of acquisition and
cost (acquisition projects).
9. A list of all funds,over and above the grant requested,that will be used for the project.
10. Copies of any permits, leases, agreements,etc. affecting project lands or operation and maintenance.
11.--Photos of the project site.
Assurances
The applicant hereby gives assurances and certifies with respect to the grant that:
It possesses legal authority to apply for the grant, and to finance, acquire and construct the proposed project; that a
resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's governing body,
authorizing the filing of the application, including all understandings and assurances contained therein, and directing and
authorizing the person identified as the official representative of the applicant to act in connection with the application
and to provide such additional information as may be required.
It will provide and maintain competent and adequate architectural engineering supervision and inspection at the con-
struction site to insure that the completed work conforms with the approved plans and specifications;that it will furnish
progress reports and such other information as the State may require.
It will give the State's authorized representative access to and the right to examine all records, books, papers, or
document related to the grant.
It will cause work on the project to be commenced within a reasonable time after receipt of notification from the State
that funds have been approved and that the project will be pursued to completion with reasonable diligence.
It will not dispose of or encumber its title or other intrests in the site and facilities without permission from the State
Legislature.
It will comply where applicable with provisions of the California Environmental Quality Act and any other State, and/or
local laws, rules and/or regulations.
In cases involving leased property, it agrees to maintain and operate the property and/or facilities acquired or developed
for an agreed to period commensurate with the type of project and the proportion of state grant funds and local funds
allocated to the capital costs of the project.

NOTICE OF EXEMPTION
AS PROVIDED FOR IN THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
PROJECT TITLE : KOLB PARK TENNIS COURTS ACQUISITION
PROJECT LOCATION: Adjacent to 7416 Brighton Drive , Dublin, Alameda County,
CA 94568
Description: The Murray School District has designated the Fallon School
site ( including the adjoining Kolb Park) as surplus property. The City of
Dublin in accordance with Education Code Section 39397. 5 (Naylor Bill) has
prepared a plan for the purchase of a portion of the designated surplus
property. The adopted City of Dublin General Plan identifies a three to
five acre neighborhood park at the Fallon site .
The City of Dublin recognizes the value of the improvements on the Kolb
Park site which consists of two tennis courts . Therefore , it is proposed
that the City shall acquire a parcel which is approximately + 38 ,000 square
feet . This shall consist of the tennis courts and an area immediately
north of the location as shown on the sketch of the proposed acquisition.
The site is located in an urbanized residential subdivision. The project
faces Brighton Drive , which is a recognized collector street and provides
public access . The School District has declared the property as surplus
and the City desires to preserve the recreational opportunities offered by
the subject site .
Exemption Findings : The above described project has been reviewed to
determine the necessity of an Environmental Impact Report or Negative
Declaration, as required by CEQA.
Sections 15301 and 15312 allow for categorical exemptions from CEQA and
both are relevant to the proposed project .
Support of Declaration of Exemption: Section 15301 provides for an
exemption when the operation of public facilities involving negligible or
no further expansion of use beyond what is existing, is the primary focus .
The recreational facilities are currently owned by the School District and
the City would not implement changes in the type of use of the property.
Section 15312 declares that the sale of surplus government property is
categorically exempt . This project involves the sale of School District
(i . e . government ) property .

Approximate Date of Acquisition: March 31, 1986
Approximate Cost of Acquisition: The estimated market value of
the property is $57, 000 - $87, 400. However, the
City of Dublin is qualified under Education Code
Section 39397. 5 to purchase the property at 25% of
fair market value. Therefore, the anticipated
cost would be $14,250 - $21,850. This cost only
includes the purchase price of the property. The
costs of appraisals, surveys, preliminary title
reports and title insurance fees are estimated at
$9, 500.
