DESCRIPTION The current agreement - for Police Services provided by
Alameda County Sheriff ' s Department is scheduled to end as of June 30 , 1986 .
Staff members have met with representatives of the Sheriff ' s Department and
the County Administrator ' s Office to negotiate a contract for continued
service to the City of Dublin.
The level of service and workload indicators are both reviewed in the
attached memorandum. The review attempted to evaluate key areas of
performance to determine potential deficiencies and address concerns
identified by Staff . Given the amount of detail contained in that document,
it will not be repeated within the body of the agenda report. Instead, the
following discussion will focus on the proposed agreement . The substantive
changes made to the agreement have been shown in italics to differentiate it
from language contained in the existing agreement.
The first change occurs on Page 2 within the discussion of the assignment of
personnel . The proposed contract provides for an Exhibit which describes
the number of personnel in each classification to be assigned under the
contract . On an annual basis , the City can request a modification to the
staffing level and the County shall make every effort to provide the
personnel within 90 days . This time frame is necessary in order for the
Sheriff ' s Department to complete the necessary requirements of the Alameda
County personnel system.
The last paragraph on Page 2 discusses an item which was not addressed in
the original agreement . This condition establishes a provision by which the
City can provide input on the selection of the on-site commander . In order
to preserve the legal requirements of having the services provided by an
independent contractor, the actual selection and assignment will be made by
the Sheriff . Staff believes that the inclusion of this language in the
agreement will formalize the procedures to be used in the selection of the
on-site commander .
The agreement also contains modifications to Page 4 relating to the
provision of vehicles . Given that the City has initiated the purchase of 8
marked patrol vehicles , the proposed agreement only addresses the unmarked
vehicles . Staff has worked with County Officials to allow the termination
of the vehicle lease by the City prior to the contract termination date .
The City may find it more cost effective to own the unmarked cars in the
future, however, Staff would recommend that this issue be evaluated after
operational data from the City-owned marked vehicles is available. The
proposed contract requires that the City notify the County of the change by
April 1st. It is anticipated that this will allow adequate time for an
appropriation in the upcoming budget and adequate time for bidding and
purchasing the vehicles .

The proposed agreement contains the same provisions for insurance coverage
as were included in the initial agreement. The language basically makes
reference to an additional insurance agreement between the City of Dublin
and Alameda County . During the period in which the City had liability
insurance coverage, Alameda County was named as an additional insured.
Alameda County then reimbursed the City for its share of the insurance
premium cost . However, the Insurance Agreement provides that if the City
fails to provide the County with insurance, the County shall acquire the
coverage and the City will pay the cost. It is anticipated that the County
will bill the City for insurance costs from March 1, 1986 through June 30 ,
1986 . Staff is continuing to work with various groups attempting to
establish risk sharing pools . It has not been determined at this time as to
whether it would be possible for the City to include coverage of County
contract services within the proposed insurance pools . The County has been
placed in a similar situation due to the lack of available insurance . Staff
will continue to pursue various options for the provision of insurance.
Once adequate information is available, a formal report will be made to the
City Council .
The term of the contract is for a three year period, however, it may be
terminated with written notice of 6 months . This contract will cover
services provided through June 30, 1989 . Staff would recommend that the
City Council continue to evaluate the level of service provided on an annual
basis . It appears that the proposed modifications should address any
anticipated requirements for the term of the agreement .
The memorandum. discussing performance criteria recommends a change in the
staffing level for 1986-87 . The change involves reclassifying the position
responsible for narcotics enforcement to a detective sergeant. The program
was initiated as a trial program in Fiscal Year 1985-86 utilizing a deputy
classification. The intent was to determine the level of activity and
evaluate whether an on-going program was necessary. The workload indicators
represent an adequate degree of activity to continue with specialized
enforcement. The continuation of a formal narcotics enforcement program
will require the assignment of a detective sergeant classification. Staff
has also recommended the addition of one patrol officer. These changes are
reflected in the Organizational/Staffing Chart labeled Exhibit A-1 . The
current staffing is outlined in Exhibit A. The additional cost for the
proposed increase would be $54 , 135 . Staff would request that the City
Council determine the staffing level desired for Fiscal Year 1986-87 .
Staff would recommend that the City Council review the services provided,
select the desired staffing level , and authorize the Mayor to execute the
proposed agreement .

SUBJECT: Police Services Contract Evaluation
DATE : April 24, 1986
This memorandum will review the Staff evaluation of the police services
provided by the Alameda County Sheriff ' s Department . A contract evaluation
form for use by the City Councilmembers is also attached. You previously
received a copy of the 1985 calendar year report which outlines police
activities during that year . This evaluation will discuss some of the key
indicators found within that report. In addition, as a result of this
review, modifications to the existing contract have been negotiated with
the Sheriff ' s Department representatives and are provided in a draft
agreement for police services .
Quality of Service Provided - Patrol Service
The Sheriff ' s Department provided the City with 12 patrol officers and 4
patrol sergeants . They have access to 6 marked police vehicles which are
identified with the City seal and Dublin Police Services markings . The
following outline identifies the level of services provided during the past
2 calendar years :

The above indicators represent the workload changes within the patrol
services division. As noted, citations have increased by approximately 6%
and accidents investigated have increased by approximately 8% . In
addition, the vehicle usage noted by the number of miles driven corresponds
with the increasing demand for patrol service throughout the community .
The City Council has approved and awarded a bid for 8 new patrol vehicles
which will be owned by the City . It is anticipated that the City will take
delivery of these vehicles in early July. The additional vehicles will
assure that patrol service quality does not decline . These vehicles will
be serviced locally in an effort to reduce the amount of time currently
required transferring County vehicles to the Alameda County Service
Facility in San Leandro.

The City contract services have always provided for patrol services
directed by 4 patrol sergeants and 12 patrol officers . Given the
population increases and growth throughout the community within the past 3
years, it is Staff ' s recommendation to increase the number of patrol
personnel for Fiscal Year 1986-87 . This would provide a total of 13 patrol
officers to service the community.
Traffic Enforcement
The Dublin Police Services currently assigns patrol deputies to general
patrol duties without designating specialized positions . This allows the
flexibility to assure that all personnel are well equipped to respond to a
variety of calls for service. The police services currently have 2 patrol
officers who perform as accident investigators . This involves review of
accident reports submitted and they would be called upon in the case of a
serious accident to provide investigative follow-up . The Dublin Police
have proceeded with the use of radar which has been a valuable tool in
addressing complaints regarding speeding vehicles . All patrol officers
have been trained in the use of the two radar devices . The following
outline indicates traffic enforcement data for the years 1984 and 1985 :

It is apparent that the increase growth within the area, both residential
and commercial, is increasing the amount of traffic on City streets . As a
result, the workload indicators reflect an increase in patrol time devoted
to traffic enforcement .
Staff believes that the addition of a patrol deputy recommended above will
help address these needs . At the same time, it will maintain the
flexibility of having all patrol deputies available to respond to calls for
service regardless of their nature . The additional personnel can be
deployed in a manner which will address specific concerns related to
traffic . This can be accomplished through scheduling the individual to
work during time periods when traffic enforcement is most desirable . It is
Staff ' s recommendation that the City pursue this method of traffic
enforcement and reevaluate the need for a specified traffic enforcement
deputy or unit in future years .
Criminal Investigations
There are currently 3 sergeants who are assigned to criminal investiga-
tions . One sergeant functions 1/2 time in juvenile investigation and 1/2
time in crime prevention. The following workload indicators represent the
rather consistent workload of the investigation division between 1984 and
1985 .

As shown by the above numbers , the workload does not indicate the need for
additional personnel at this time . The existing Staff has been capable of
maintaining a reasonable caseload and has been successful in closing a high
percentage of the cases which were assigned.
Juvenile Investigations
As indicated above, the equivalent of 1/2 of a detective sergeant position
has been assigned to juvenile investigations . This has allowed the Dublin
Police Services to implement a school liaison program which assists the
school administration in juvenile matters and counseling of youth and
parents . The response to this type of program has been positive and a
complement to efforts made by the school system. The most significant
level of activity among juvenile arrests has been misdemeanor arrests and
not felony arrests . In 1984 , a total of 37 felony arrests were made
compared to 62 in 1985 . A total of 71 misdemeanor arrests were made in
1984 and 149 were made in 1985 . The juvenile investigation and detective
sergeant deals mostly with the more serious felony matters . Therefore,
Staff does not recommend any change in personnel assigned to this position
at this time . Many of the misdemeanor arrests are actually handled by the
patrol officers . It appears that the services demanded in the area of
juvenile investigations are being met with the existing staffing level .
Narcotics Investigations
In July of 1985, the Dublin Police Services implemented a pilot narcotics
investigation program. This involved the assignment of a deputy to drug
enforcement . Although the program was only in effect for 6 months of
calendar year 1985 , its impact can be seen through the comparison of
workload indicators shown below:

It is anticipated that these statistics justify the continuation of this
program. Given that the program was begun on a pilot basis with a deputy
classification, it is most appropriate to utilize the classification of
detective sergeant to formalize this type of specialized enforcement . The
statistics indicate that the efforts and services provided during the trial
period should be commended and the change in classification in no way
reflects on the effort extended towards narcotics enforcement. However,
the Alameda County personnel system places restraints on the permanent

assignment of individuals involved in specified activities . Therefore, it
is Staff ' s recommendation that the 1986-87 budget include funding to
reclassify the drug enforcement position to a detective sergeant
classification.
Community Programs
The Dublin Police Services continues to attempt to reach the community at
large by providing special interest programs in crime prevention. The
Merchants Alert Program has remained consistent between the 1984 and 1985
years . For the most part, this program focuses on larger retail operations
and many of the smaller business entities have not indicated an on-going
interest in being involved in this type of program. The Neighborhood Watch
Program has been highly successful and allowed the City to reach local
residents . This has been accomplished through the use of a 1/2 time
detective sergeant and a part-time Crime Prevention Assistant . The program
on residential safety has already reached over 1450 residents and conducted
a total of 97 meetings through calendar years 1984 and 1985 . It appears
that the current staffing level is capable of continuing to provide
services in this area.
In addition, police services have been directly involved in community
awareness programs through school presentations, group talks with service
organizations , and television and radio messages . Again, the existing
personnel is adequate to address these areas and continue to maintain a
high profile in the community programs .
Business Office Services
The Dublin Police Services Business Office is presently staffed by 2
clerks . Their schedules have been arranged to provide for 9 1/2 hours per
day of office staffing. This staff provides report processing, record
maintenance, telephone and citizen contact, evidence security, corres-
pondence, statistical record keeping, etc . The provision of these services
adjacent to City Offices allows easy access for residents and members of
the general public who require services directly from the business office.
To increase the efficiency of the office staffing and assure that the
workload could be. handled promptly, a word processing system was added to
the police services office in July, 1985 . It is anticipated that with the
addition of this equipment, the current level of staffing in the business
office is adequate to meet the City' s needs at this time . In addition, the
Office Staff has assumed subpoena procesing from Eden township Substation .
Public Relations and Communication
Public Information Dissemination
The police department has taken strong efforts throughout the past year to
provide information to the general public and press in a timely manner .
During both 1984 and 1985, the police services distributed over 27, 000
pieces of safety literature. This does not include the information

distributed through the community newsletter. The Crime Prevention Program
has relied heavily on literature which is available through state programs
and discussed topics of interest to both residents and commercial
businesses . The Crime Prevention Program has also made an effort where
possible, to print materials identifying the City' s sponsorship of the
program. In addition, pursuant to the City Council suggestion, the Crime
Prevention Program has implemented a literature stand in the Dublin
Library. This has improved access to important information which is
appreciated by members of the community. The Police Services have also
done a good job of keeping the press apprised of information related to
major incidents within the community. Through the structured news
conference approach, accurate information has been provided to the press
during incidents which generate substantial interest . Staff would
anticipate that this type of approach to public information will continue
in the future .
Volunteer Program
The police services continue to complement the services which are provided
with paid personnel through the use of volunteers . In calendar year 1985,
approximately 2 , 591 hours of volunteer reserve officer time was provided to
the City of Dublin. This is equivalent to approximately 1 . 25 additional
full-time personnel . Also, approximately 800 hours of clerical and cadet
services were provided during calendar year 1985 . The volunteer program
benefits the City of Dublin through the services provided and it also
provides an opportunity for individuals who are interested in community
service to participate in an important program.
Administrative Services
Communication of Police Activities to Manager & Council
The onsight commander has done an excellent job , with the communication of
police issues and problems and identifying program needs to the City
Manager and the City Council . Captain Shores continues to attend nearly
all City Council meetings and is available to respond to inquiries which
are brought up at those meetings . Due to the sensitive nature of some
police activities , Staff recognizes that it is not always possible to brief
the City Councilmembers on all police activities . However, the provision
of monthly police activity statistical reports does indicate workload and
crime activity within the community on a regular basis .
Contract Administration and Cooperation
In Fiscal Year 1985-86, the City implemented a new reporting relationship
utilizing a Captain position as the onsight commander and reporting to the
Assistant Sheriff . This reporting relationship appears to have a
beneficial result in the speed with which requests have been able to be
processed with the Sheriff ' s Administrative Offices . It continues to be
somewhat difficult to obtain significant changes to the services provided.
It is hoped that given the 3 years of experience which the Sheriff ' s
Department now has with a contract service, that they will recognize the

benefits to both agencies in providing services through a contract. The
Sheriff ' s Department has shown an interest in assuring that the services
are provided in an efficient manner through an upcoming review of the
charges incurred for services provided through Eden Township Substation .
The Sheriff ' s Department will conduct a review of the services provided to
determine that the prorata share currently paid by the City, is consistent
with the services actually provided. It is anticipated that the City ' s
share may be reduced due to a reassignment of some duties from the Eden
Township Substation to the Dublin Police Services Offices . In addition,
the proposed draft contract includes language which will formalize the
method by which the City can request additional personnel . This
establishes a time frame for both the request for personnel by the City and
a response by the County. Through this change, it is hoped that future
requests for staffing changes will be able to be handled in a more prompt
manner.
Overall Performance
It seems quite clear that the level of police services have been adequately
provided and very visible throughout the community. The Sheriff ' s
Department has gone through an adjustment period in developing its first
contract service which has now been in operation for 4 years . There
continues to be areas which can be improved, however, the cooperation
between the City and the County will make the necessary refinements to
assure a quality service is continued in the future .
The contract nature continues to provide a scale of economy for the
provision of police services . The consolidation of dispatch services and
the ability to complement the existing personnel with additional deputies
and vehicles for specialized incidents is a positive consideration. The
ability to draw upon the resources of the Alameda County Sheriff ' s
Department is a distinct advantage to the City.
It is Staff ' s recommendation that the City Council review the services and
provide additional input on the overall provision of contracted police
services .

ENFORCEMENT OF STATE LAWS AND CITY ORDINANCES
THIS AGREEMENT, made and entered into this 1st day of July, 1986, by and
between the COUNTY OF ALAMEDA, hereinafter referred to as "COUNTY", and the
CITY OF DUBLIN, hereinafter referred to as "CITY";
RECITALS:
(a) . The CITY was incorporated on February 1 , 1982, and has requested that
the Sheriff of the COUNTY of Alameda continue to provide law enforcement
services in the enforcement of State laws within the area of the CITY until
June 30, 1989.
(b) The CITY is desirous of contracting with the COUNTY for the
enforcement by the Sheriff of CITY police ordinances within the area of the
CITY until June 30, 1989.
(c) The CITY and COUNTY may review annually, in May of each year, the
level of service provided within the CITY and mutually agree on appropriate
adjustments.
(d) The CITY and COUNTY agree that there shall be annual cost-of-living
adjustments and operational cost increases. Annual cost-of-living adjustments
shall include, but are not limited to, salary increases granted by the COUNTY.
The COUNTY shall review and update annually, in May of each year, the cos'c
of providing services to the CITY and provide the CITY with projected cost
adjustments.
THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
I. SERVICES TO BE PERFORMED
(a) The COUNTY agrees, through the Sheriff of the COUNTY of
Alameda, to enforce CITY police ordinances within the corporate limits or C: Trj
to the extent and in the manner hereinafter set forth.

_ The enforcement of such municipal police ordinances shall be in
connection with, and as an incident to, the performance of the Sheriff's law
enforcement functions within the area of the CITY.
The level of enforcement services shall be that same basic
level of service as shown on the organization chart attached hereto as
Exhibit A and made part hereof by this reference.
On an annual basis, the CITY shall review the desired level of
enforcement services with Sheriff's Department representatives. Exhibit A
shall reflect the number of personnel assigned pursuant to the terms or this
agreement. Exhibit A may be modified on an annual basis to reflect desired
changes in the level of service. In no case shall the level of service
provided be less than that which is provided to the unincorporated area. The _
COUNTY shall strive to meet the requested level of service, provided that tae
request would not be detrimental to the provision of adequate police
enforcement.

The CITY may request to meet with the Sheriff or his designate:,-:'
representative to provide input on the selection of the On-Site Commander.
The input shall focus on the type of bac.-ground, experience and other facto,'-3
which are pertinent to the provision of services pursuant to this contract.
The actual selection and assignment shall be at the sole discretion of the
Sheriff.

The rendition of such service, the standards -of performance,
the discipline of officers, and other matters incident to the performance of
such services and the control of personnel so employed, shall remain in the
COUNTY. In the event of dispute between the parties as to the extent of the
duties and functions to be rendered hereunder, * o� the level or manner of
performance of such service, the determination thereof made by the Sheriff of
the COUNTY shall be final and conclusive as between the parties hereto.
Services performed hereunder shall not include the supplying of crossing
guards.
(b) To facilitate the performance of said functions, it is hereby
agreed that the COUNTY shall have full cooperation and assistance from the
CITY, its officers, agents and employees.
(c) For the purpose of performing said functions, COUNTY shall
furnish and supply all necessary labor, supervision, equipment, corrmunica•-,ion
facilities , and supplies necessary to maintain the level of service to be
rendered hereunder .
(d) Whenever the COUNTY and CITY mutually agree as to the noczssity
for any such COUNTY officer or department to maintain administrative
headquarters in the CITY, CITY shall furnish at its own cost and expense n11
necessary office space, furniture, and furnishings, office supplies,
janitorial service, telephone, light, water, and other utilities. In .all
instances where special supplies, stationery, notices, forms and the likz ;�rust
be issued in the name of the CITY, the same shall be supplied by the CITY .at
Its expense.

It is expressly understood that in the event 'a local
administrative office is maintained in the CITY for any such COUNTY officer or
department, such quarters may be used by the COUNTY officer or department in
connection with the performance of its duties in territory outside of the CITY
and adjacent thereto, provided, however, that the performance of such outside
duties shall not be at any additional cost to the CITY. The COUNTY shall
reimburse the CITY for the cost of providing such facilities to the extent
that such facilities are used for activities outside the City of Dublin.
(This paragraph is not operative under mutual aid- response. )
The COUNTY agrees to provide four (4) unmarked vehicles
equipped with police communications and safety equipment. The age and
condition of the cars shall be comparable to vehicles used for similar duties _
in the unincorporated area of the COUNTY.
The CITY shall pay to the COUNTY a monthly lease cost .rbicb is
established on an annual basis. Also, there shall be an additional charge ?=or
maintenance based on the number of miles of service the vehicle is used.
The CITY shall have the ability to terminate the lease of 2.59
vehicles during the term of this agreement, provided that the CITY notifies
the COUNTY in writing no later than April 1st. The lease shall be terminated
on the 90th day of June following the notice, unless the two parties Mutually
agree to a different date.
(f) The COUNTY agrees to replace police or civilian personnel
assigned to the CITY who have been absent from duty for more than ten (10)
working days as a result of illness or injury. Replacement shall occur at
end of the ten (10) day period during which the employee was absent.

(g) The COUNTY will continue to provide training related to the
provision of municipal police services to personnel assigned to Dublin..
II. LIABILITY
(a) All persons employed in the performance of such services and
functions for CITY shall be COUNTY employees , and no CITY employee as such
shall be taken over by COUNTY and person hereunder shall have any CITY
pension, civil service, or other status or right.
(b) CITY shall not be called upon to assume any liability for the
direct payment of any salary, wages, or other compensation to any COUNTY
personnel performing services hereunder for CITY, or any liability other than
that provided for in this agreement.
Except as herein otherwise specified, CITY shall not be liable
for compensation or indemnity to any COUNTY employee for injury or sickness
arising out of his employment.
(c) The CITY will assume liability and pay cost of defense and hold
the COUNTY harmless from loss , costs or expenses caused by the negligent or
wrongful act or omission of CITY officers, agents and employees occurring in
the performance of agreements between the parties hereto to the extent that
such liability is imposed on the COUNTY by provisions of Section 895.2 of the
Government Code of the State of California. In addition, when liability
arises pursuant to Section 880, et seq. , of the Government Code, by reason o,F
a dangerous condition of public property of the CITY, the CITY shall assume
liability and pay cost of defense and hold the COUNTY harmless from loss,
costs or expenses caused by the negligent or wrongful act or omission of CITI
officers, agents and employees, whether or not arising in the performance of
an agreement between the parties hereto.

III. INSURANCE
Whatever insurance agreement between CITY and COUNTY is in effect
during the term of this contract shall apply hereto and is fully incorporated
herein by reference.
IV. COST AND BILLING PROCEDURES
(a) CITY shall pay for actual .cost of -services provided under this
agreement at rates to be determined by COUNTY in accordance with the policies
and procedures established by the ,Board of Supervisors.
(b) The COUNTY shall deliver to CITY within thirty (30) days after
the close of each calendar month an itemized invoice which covers the actual
costs of all services performed during said month, and CITY shall pay COUNTY
therefore within thirty (30) days after date of said invoice.
If such payment is not received by COUNTY at the office which
is described on said invoice within thirty (30) days after the date of
delivery of said invoice, COUNTY is entitled to recover interest thereof.
Said interest shall be at the rate of one percent (1*) per calendar month or
any portion thereof calculated from the last day of the month in which Atha
services were performed.
V. TERMINATION
This contract shall have an effective date of July 1 , 1986, and
shall run for a period of three (3) years ending June 30, 1989. This contract
may be modified at any time by mutual written consent or terminated upon six
(6) months prior written notice by either party.
