HomeMy WebLinkAbout4.2 Slope and Drainage Easement Tract 5402 CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: August 25, 1986 SUBJECT: Abandonment of Slope and Drainage Easement Tract 5402 EXHIBITS ATTACHED: Resolution Authorizing Execution of Quitclaim Deed Quitclaim Deed Plat Maps Showing Location of Easement Letter from Transamerica Title dated August 6, 1986 RECOMMENDATION: Adopt Resolution Authorizing Mayor to Execute Quitclaim Deed ' FINANCIAL STATEMENT: None DESCRIPTION: The County of Alameda originally requested this slope and drainage easement in 1965, in conjunction with the development of Tract 2690, for the purpose of constructing Castilian Road and Padre Way and in order to clear the slope above the road to avoid any sloughing onto the street. The easement was intended to be abandoned as development proceeded up the hill. The City of Dublin succeeded to the County's interest in the easement upon incorporation. This easement is located on Tract 5402 (the "Dolan School Site") , which is now being developed by Far West Associates. The site has been graded and the slope eliminated; so there is no longer any need for the easement. Transamerica Title has submitted the attached request for execution of a Quitclaim Deed on behalf of Far West Associates. Staff recommends that the City Council approve execution of this Quitclaim Deed. ---------------------------------------------------------------------------- ITEM NO. COPIES TO: Transamerica Title Far West Associates RESOLUTION N0. -86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AUTHORIZING EXECUTION OF A QUITCLAIM DEED AND ABANDONMENT OF SLOPE AND DRAINAGE EASEMENT TRACT 5402 WHEREAS, the County of Alameda acquired a slope and drainage easement for the construction of Castilian Road and Padre Way in Tract 2690 in 1965; and WHEREAS, the City of Dublin succeeded to the County's interest in said easement upon its incorporation; and WHEREAS, construction of said Tract and said streets is complete and said easement is no longer needed by the City; and WHEREAS, the slope has been graded in the course of development of Tract 5402 and no longer exists; and WHEREAS, the property owner has requested that the City execute a Quitclaim Deed for abandonment of this easement; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin authorizes the Mayor of the City of Dublin to execute said Quitclaim Deed. The background is this: The County of Alameda, as a condition to approval of Tract 2690, required in 1965 that a slope easement be acquired adjacent to the tract, said easement to be abandoned as development proceeded up the hill . The location of this easement is shown on the enclosed plats of Tract 2690 and Tract 5402. The City of Dublin succeeded to the County's interest in Castilian Road and Padre Way, and to the appurtenant slope easement, upon its incorporation. As you know, Tract 5402, on which this slope easement is located, has been graded and the slope has been eliminated. Since it is no longer needed, it would be appreciated if you would arrange to have the enclosed Quitclaim Deed approved by the City, executed and acknowledged.
