FINANCIAL STATEMENT: Claimant requests the following in damages:

DESCRIPTION Mr. Filstead has filed a claim as a result of an
incident which occurred between himself and Mr. Frank Caruso. Mr. Filstead
contends that the altercation involved the Dublin Police Department.
George Hills Company has completed a review of the claim and recommends
denial. Although Mr. Caruso is a volunteer Reserve Sheriff Deputy, he was
off duty at the time of the incident. Therefore, the altercation was a case
of private citizen versus private citizen. Additionally, the City maintains
an agreement with the County of Alameda which protects and holds the City
harmless .
Therefore, Staff recommends that the City Council deny the claim and direct
Staff to notify the claimant and ABAG PLAN Corporation.
