FINANCIAL STATEMENT: The City and County have agreed to a property tax agreement that was previously approved by the City Council. DESCRIPTION: Pursuant to the provisions of the Cortese-Knox Local Government Reorganization Act of 1985 relating to annexations, three specific actions must occur prior to the City Council proceeding with the proposed Public Lands Annexation: 1) the City Council must summarize the LAFCO Resolution for the annexation; 2) the City Council must conduct a public hearing to consider protests of the annexation; 3) the City Council must adopt a Resolution making findings regarding the written protests and take action on the annexation. ------------------------------------------------------------------------------ ITEM NO. co. Summary of LAFCO Resolution On September 11, 1986, LAFCO approved the proposed Public Lands (Camp Parks) Annexation finding that: 1) the proposed annexation is consis- tent with procedures and policies of LAFCO; 2) the annexation will permit the provision of municipal services by Dublin to the annexation area. LAFCO approved the annexation subject to the following conditions: 1) That correction of the maps be made as may be required. 2) That the City of Dublin is designated the conducting authority and authorized to initiate proceedings. 3) That LAFCO recommends that the City of Dublin study the property to determine if there are areas within the property which may be benefited by freeway improvements and, if such benefits are found, to support the creation of an assessment district or similar vehicle for the financing of the cost of construction of that portion of the freeway improvements which confer special benefits on areas within the property. 4) That LAFCO recommends that the City of Dublin participate jointly with the City of Pleasanton and any other public agencies having jurisdiction within the property in formation of a joint powers or other special purpose entity or commission, for the purpose of defining a "scope of work" for the freeway improvements, determining the cost thereof, and retaining an "engineer of work" to determine the boundaries of the benefited area. The object of the City of Dublin's participation with other public agencies shall be to attain an official determination of the extent of improvements, cost of improvements, and proportion of costs to be borne by the benefited area. II. Public Hearing The City Council must conduct a public hearing to hear and consider written or oral protests or evidence made concerning the annexation. Protests are limited to land owners or registered voters within the proposed annexation area. All written protests must include the following: 1) state whether it is made by a land owner or registered voter; 2) the name and address of the owner of the affected land and the street address of the land; 3) the name and address of the registered voter as it appears on the registration affidavit; and 4) . the date and signature. Any protests without a date and signature may be disregarded. III City Council Resolution The City Council must adopt a Resolution making findings concerning the value of the protest and take action on the annexation. 1) If a "majority protest" of 50% of the registered voters (26 of 52 voters) protest the annexation, the City Council must abandon the proceeding. Staff has requested from the County Assessor the assessed value of land within the proposed annexation area. If available this information will be presented at the October 13, 1986, City Council meeting. 2) If written protests have been received by a) 25% (13 of 52 voters) of the registered voters, or b) by at least 25% of the land owners who own 25% of the assessed value of the land within the annexation area, the City Council can order the annexation subject to confirmation by the registered voters residing in the annexation area. -2- YR- . � ! . . 3) If written protests have been filed a) by less than 25% of the registered voters (less than 13 of 52 voters), or b) by less than 25% of the land owners owning less than 25% of the assessed value of the land within the annexation area, the City Council can order the annexation without an election. Two Resolutions have been prepared for adoption depending upon the outcome of the public hearing. Staff recommends the City Council: A) Conduct the public hearing to consider any protests or objections to the proposed annexation. B) Determine the value of any protests received. C) Depending on the value of any protests, take one of the following actions: 1) adopt a Resolution approving the annexation (Attachment I); or 2) direct Staff to prepare a Resolution approving the annexation subject to election and continue the matter to the October 27, 1986, City Council meeting; or 3) adopt a Resolution disapproving the annexation (Attachment II). -3- ,r RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ------------------------------------------------------------------ RESOLUTION APPROVING "CITY OF DUBLIN ANNEXATION #2 - PUBLIC LANDS (CAMP PARKS ) " WHEREAS, the Dublin City Council has initiated the annexation of certain inhabited territory designated as "City of Dublin Annexation #2 - Public Lands (Camp Parks) "; and WHEREAS, LAFCO has, at the times, in the form, and in the manner provided by law, considered the petition of the City; and WHEREAS, LAFCO has authorized the City to proceed with the annexation by LAFCO, and has approved the annexation subject to the following terms and conditions: a) Correction of the map and description as may be required by the Director of Public Works, ex-officio County Surveyor; and b) Designate the City of Dublin as the conducting authority and authorize the City to initiate proceedings for the proposed annexation in compliance with this resolution; and c) The Alameda County Local Agency Formation Commission recommends that the City of Dublin study the Property to determine if there are areas within the Property which may be benefited by the Freeway Improvements and if such benefits are found, to support the creation of an assessment district or similar vehicle for the financing of the cost of construction of that portion of the Freeway Improvements which confer special benefits on areas within the Property; and d) The Alameda County Local Agency Formation Commission further recommends that the City of Dublin participate jointly with the City of Pleasanton and any other public agencies having jurisdiction within the Property in formation of a joint powers or other special purpose entity or commission, for the purpose of defining a "scope of work" for the Freeway Improvements, determining the cost thereof, and retaining -an "engineer of work" to determine the boundaries of the Benefited . area. WHEREAS, notice of the public hearing was duly given in accordance with law; and WHEREAS, the Council held a public hearing at 7: 30 p.m. , October 13, 1986, at the City Council ' s regular meeting place, to consider testimony concerning the proposed annexation; and TTAUO'hH tr WHEREAS, all oral and written protests, objections and evidence were considered by the City Council; WHEREAS, after closing the public hearing, the Council determined that written protests have been filed and not withdrawn by less than 25% of the registered voters or less than 25% of the number of owners of land owning less than 25% of the assessed value of land within the affected territory. NOW, THEREFORE, BE IT RESOLVED. THAT THE Dublin City Council does hereby find that: S ection 1. That pursuant to the provisions of the Cortese-Knox Local Government Reorganization Act of 1985, Government Code §§ 56000 et seq. , the Council approves and orders, without election, the annexation of that real property situate in the County of Alameda, State of California (designated as "City of Dublin Annexation #2 - Public Lands (Camp Parks) " and more particularly described in Exhibit "A" attached hereto and incorporated herein by reference, to the City of Dublin. Section 2. The reason for said annexation is to facilitate orderly growth and development of the subject property in a manner consistent with the Legislature's findings and declarations, as contained in Government Code § 56001. Section 3 . The regular county assessment roll will be utilized. Section 4. The real property to be annexed will not be taxed for existing general bonded indebtedness by the City of Dublin. Section 5. That the City Clerk is directed- to send a certified copy of this resolution to the LAFCO Executive Officer. PASSED, APPROVED AND ADOPTED this th day of 1986. Approved as to Form: Gladys Houston, Nputy County Counsel LOCAL AGENCY FORMATION COMMISSION OF ALAMEDA COUNTY RESOLUTION NO. 86-23 WHEREAS, a resolution of application for the City of Dublin Annexation No. 2 - Public Lands (Camp Parks) was heretofore filed with the Executive Officer of the Local Agency Formation Commission; and WHEREAS, said Executive Officer has reviewed said application and prepared a report, including his recommendations thereon; and WHEREAS, an Environmental Impact Report (City of Dublin General Plan, Draft Environmental Impact Report, February 8, 1984; Responses to Comments, Draft Environmental Impact Report, Dublin General Plan, March 30, 1984; City of Dublin General Plan, Supplement to Environmental Impact Report, December 21 , 1984; and City of Dublin General Plan, Responses to Comments on Supplement to Environmental impact Report, City Council Meeting of February 11, 1985) has been prepared on this project in accordinace with the California Environmental Quality Act, and said EIR: 1 . Has been reviewed and considered by the -Local Agency Formation Commission; 2. Is hereby certified by this Local Agency Formation Commission to comply with the requirements of the California Environmental Quality Act and all applicable State and County guidelines; and 3. Is hereby adopted as the EIR for this Commission action; and WHEREAS, the above noted EIR does not indicate any significant impacts of the project which are within the responsibility of this Commission; and WHEREAS, a number of significant measurable and unmeasurable impacts of the project were identified in the EIR and are the responsibility of the Lead Agency (City of Dublin) ; and WHEREAS, the area is within the sphere of influence of the City of Dublin and not within an agricultural preserve; and WHEREAS, at the hearing on September 11, 1986, the Local Agency Formation Commission heard and received all oral and written protests, objections and evidence which were made, presented or filed, and all persons present were given an opportunity to appear and be heard in respect to any matter relating to said application and report; A"'hHMENT, -2- WHEREAS, the Legislature of the State of California has recognized in Section 56001 of the Act that urban population densities and intensive residential , commercial ,and industrial development necessitate a broad spectrum and high level of community services and controls, and that when areas become urbanized to the extent that they need the full range of community services, service priorities need to be established by weighing the total community needs against the total financial resources available for securing community services, and that those community service priorities are required to reflect local circumstances, conditions, and limited financial resources; and WHEREAS, it is the policy of the Alameda County Local Agency Formation Commission to exercise its powers pursuant to the Act in a manner that encourages and provides planned, well-ordered, efficient urban development patterns with appropriate consideration of discouraging urban sprawl , and providing for the orderly development of local agencies with a recognition of local conditions and circumstances; and WHEREAS, the Alameda County Local Agency Formation Commission believes that there may be a benefit to certain areas within the Property and other areas outside the Property by reason of the construction of certain proposed major roadway and freeway interchanges ("Freeway Improvements") adjacent to Interstate 580 at Hopyard Road,. Santa Rita Road, Hacienda Drive, and the auxiliary lanes, between Hacienda Drive and the Interstate 680/580 intersection, WHEREAS, this Commission did find as follows: 1 . The proposed annexation is consistent with the procedures and policies previously adopted by the Commission; 2. The proposed annexation is inhabited; 3. The annexation will permit the provision of municipal services by the City of Dublin to the subject area; and NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED THAT: The City of Dublin Annexation #2 - Public Lands (Camp Parks) be approved subject to the following terms: 1 . Correction of the map and description as may be required by the Director of Public Works, ex-officio County Surveyor; and 2. Designate the City of Dublin as the conducting authority and authorize the City to initiate proceedings for the proposed annexation in compliance with this resolution. -3- 3. The Alameda County Local Agency Formation Commission recommends that the City of Dublin study the Property to determine if there are areas within the Property which may be benefitted by the Freeway Improvements and if such benefits are found, to support the creation of an assessment district or similar vehicle for the financing of the cost of construction of that portion of the Freeway Improvements which confer special benefits on areas within the Property. 4. The Alameda County Local Agency Formation Commission further recommends that the City of Dublin participate jointly with the City of Pleasanton and any other public agencies having jurisdiction within the Property in formation of a joint powers or other special purpose entity or commission, for the purpose of defining a "scope of work" for the Freeway Improvements, determining the cost thereof, and retaining an "engineer of work" to determine the boundaries of the Benefitted area.
