RECOMMENDATION: Adopt Resolution.
FINANCIAL STATEMENT: Within the adopted budget, Staff time has been
provided for a Citywide sign survey and zoning
enforcement.
DESCRIPTION: In June, 1986, the Sign Ordinance adopted by the City Council
went into effect. The intent of the Sign Ordinance is to provide effective
and attractive identification. As part of the implementation of the
Ordinance, Staff has undertaken a Citywide sign survey.
The survey has begun to identify some signs which are illegal. The Ordinance
provides that illegal signs shall be subject to summary removal. Staff is
seeking policy direction from the City Council regarding a schedule for timely
removal of illegal signs.
There are generally two types of illegal signs:
1) Signs that were prohibited or that were installed without appropriate
permits and did not comply with the Sign Ordinance then in effect.
2) Signs that were originally installed with appropriate permits, but then
became non-conforming and subject to an amortization period. With the
end of the amortization period, the signs became illegal.
Some signs in Dublin were made non-conforming by the Alameda' County Sign
Ordinance that went into effect on February 4, 1978. The Ordinance included a
three-year amortization period, which allowed the signs to remain until
February 4, 1981. After that date, if the sign was not brought into
compliance, it became illegal.
It appears reasonable to Staff to base the timely removal of an illegal sign
on 1) whether it was legal when originally installed, and 2) how large and
complex the sign is.
For example, a shorter (less than 8 feet tall) freestanding sign that was
originally legal but is now illegal might reasonably be removed within three
months.
A medium-height (8 feet to 20 feet tall) freestanding sign that was originally
legal might reasonably be removed within six months.
A taller (over 20 feet tall) freestanding sign that was originally legal might
reasonably be removed within 12 months.

Staff recommends that the City Council adopt a schedule for timely removal of
illegal signs as follows:
REMOVAL TIME
A. For illegal signs that were illegal Immediately; within

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ESTABLISHING A SCHEDULE FOR TIMELY REMOVAL OF ILLEGAL SIGNS
WHEREAS, the City Council, at its regularly scheduled meeting of
May 12, 1986, adopted a Sign Ordinance with the intent to provide effective
and attractive identification; and
WHEREAS, said Ordinance went into effect on June 11, 1986; and
WHEREAS, said Ordinance provides, in part, that illegal signs are
subject to summary removal; and
WHEREAS, Staff has undertaken a Citywide sign survey as part of
the implementation of said Ordinance; and
WHEREAS, said survey has begun to identify some signs which are
illegal;
NOW, THEREFORE, BE IT RESOLVED THAT the City Council establishes
the following schedule for the timely removal of illegal signs:
REMOVAL TIME
A. For illegal signs that were illegal Immediately; within
when originally installed, or which 1 day to 1 month,
are prohibited, or which are depending on
