Manager to=Execute the Agreement FINANCIAL STATEMENT Cost to City - $3, 975-$4, 075 Sufficient Funds are Available in FY86-87 Budget DESCRIPTION For the past two years the City' s Recreation Department has conducted an Afterschool Recreation Program at Nielsen and Murray Schools. At Murray School the program has exclusive use of a vacant classroom in which to conduct activities. At Nielsen School the program utilized the Multi-Use Room from September to November and April through June. During the months of November through March, the program was relocated to Shannon Center as the Multi-Use Room was utilized for school sponsored basketball. Understandably, the attendance in the Nielsen program dropped dramatically after the move to Shannon Center, and continued to remain low upon the return to Nielsen School in April . In order to alleviate this problem, staff approached the School District about the possibility of putting a portable classroom on the school grounds for use by the Afterschool Program. The School District was agreeable and suggested sharing the classroom, as they were also in need of additional classroom space. Thus funds for this purpose were included in the Recreation Department FY86-87 Budget. Exhibit A is the Joint Facility Use Agreement for the portable classroom located at Nielsen School . The agreement is for a two year period with the option to renew at that time. The School District will have use of the classroom from 12 : O1a.m. to 2 : OOp.m. The City will have use of the classroom from 2 : O1p.m. . to 12 midnight. On days when school is not in session, the City will have exclusive use of the classroom. The cost to lease the portable classroom is $5, 250 per year with Dublin' s share amounting to $2 , 625 . Additionally, the City will reimburse the District for janitorial service in the amount of $1, 350 per year. The City agrees to share the cost of site preparation which shouldn' t exceed $100 . Thus the total cost to the City is $3, 975 to $4 , 075 for the period commencing November 1, 1986 and ending October 31, 1987 . It is the recommendation of staff that the Council take the following action: 1. Approve the Joint Facility Use Agreement 2 . IRW 7 EXHIBIT, A CITY OF DUBLIN JOINT FACILITY USE AGREEMENT, THIS AGREEMENT, made and entered into this ', day of , 1.986, by .and between MURRAY SCHOOL DISTRICT, 7416 Brighton Drive, ' Dublin, California, hereinafter- referred to` as District, " and the: CITY OF DUBLIN, 6500 Dublin Blvd.`, Dublin, - . California, hereinafter referred to as .City. This agreement is for the joint, use of a portable classroom -located •at '. Nielsen. : School, 7500 Amarillo Road, Dublin, California. 1 . The District has leased a_portable classroom located at Nielsen School for the joint use of the �-District and the City. 2 . The District shall have the use of the classroom each day from 12 : O1a.m. until 2 :OOp.m. -. The City shall have the use of the classroom from 2: Olp.m: to 12 midnight. On days when school is not in session, the City may have exclusive use of the classroom. 3 . The hours and days of use may be. changed by a mutual agreement of the School Principal and City Recreation Director. 4 . The term of this agreement shall be for the period commencing November 1, 1986, and ending October 31, 1988. In consideration of this joint use, the City shall pay to the District $2, 625 dollars per year_ beginning November 1, 1986. This agreement may be renewed annually if mutually agreed to by District and City. City and District agree to share -in the cost of preparing the site at Nielsen School for the portable. classroom. 5 . District agrees to pay for all utilities furnished to the City under the terms of this agreement. 6 . Major maintenance of buildings and grounds shall be at District' s expense. Maintenance for the purposes of repair or replacement due to vandalism, negligence, or malicious mischief 'shall be at District's expense, unless the expense results from City use of the building. 7 . On days that school is in session, the District will provide custodial services for which the City will reimburse the District $1,350 to be paid in monthly installments of $112 .50 . On days that school is not in session, the City will be responsible for providing custodial services. 8 . The City shall have use of school restroom facilities, and non-exclusive use of surfaced area, playground, court yard area of Nielsen School.
