RECOMMENDATION Authorize City to become a participant and approve an
additional appropriation from the Contingent Reserve
to the City Manager Training Account in the amount of
$1, 875.
FINANCIAL STATEMENT: Cost will be based on number of participants . Based
on current commitments, the cost will not exceed
$1, 875.
DESCRIPTION The City of Concord has taken the lead role in
organizing an Employment Training Consortium. The intent is to provide
quality training seminars on issues related to employment.
The law firm of Libert, Cassidy & Frierson represent public sector
management on issues related to employment and labor relations .
Representatives of the firm are often guest speakers at League of California
Cities functions . The firm has formed similar training groups throughout
the State.
NERTC has established a proposed agenda for the first year of operation
which is shown in the letter dated December 9 , 1986 . The topics deal with
relevant issues for all agencies, given the potential for litigation in the
personnel field. A unique feature of the Consortium is that an agency will
be allowed to send as many participants as they desire. This provides an
opportunity to provide training opportunities throughout the organization.
The individuals attending each seminar will depend on the topic and its
relevance to one ' s regular job duties .
In addition to the seminars, the law firm will provide a regular newsletter .
This will outline recent developments in personnel legislation and court
decisions . Representatives of the firm will also be available for telephone
consultation with member agencies . This can be an important resource on
complicated issued related to personnel .
The cost of participating will be divided evenly among the member agencies.
Mr . Liebert has indicated that the total cost would be $15, 000 . Mr. Nelson
of the City of Concord has received commitments from seven cities.
Therefore, the maximum cost for membership to the City of Dublin would be
$1, 875 . This cost would be reduced if more cities join the consortium.
Minimal costs for transportation and meals would also be incurred; however,
sufficient funds for these costs are budgeted. NERTC offers the City of
Dublin an opportunity to obtain high caliber training for employees at a
minimal cost . The group of cities organizing the consortium have placed an
emphasis on topics which are of interest to all agencies . The seminars will
address issues other than negotiating and dealing with labor
representatives . Often these are the focus of seminars conducted by
statewide organizations .
Staff recommends that the City Council authorize the City' s participation in
NORCAL Employment Relations Training Consortium and authorize a budget
transfer of $1 , 875 from the Contingent Reserve .

Representatives from nine cities met with John Liebert on December 4
and selected the 1987 dates and topics for the training consortium
being formed. They tentatively named the group the NORCAL
EMPLOYMENT RELATIONS TRAINING CONSORTIUM.
John Liebert and members of his law firm, Liebert, Cassidy and
Frierson, will be presenting the following programs:

The annual fee to the group for this training is $15, 000 which is to
be shared equally among the agencies participating. The fee
includes a syllabus for attendees at each session, telephone
consultation, and a newsletter (copy enclosed) . If your city
intends to become a member, please send a confirming letter to John
Liebert (address below) with a copy to me no later than December 31,
1986. John will then divide the fee by the number of participating
agencies and prepare individual service agreements for each city.
The only additional cost might be for lunches if the group wishes to
have lunch served at the full-day sessions.

relations. Thus, the firm represents agencies in negotiations ,
arbitrations and fact findings, administrative proceedings before
a variety of local , state and federal boards and commissions, and
before state and federal trial -and appellate courts.
While we are proud of our record of quality representation
of agency management in this broad spectrum of adversary
proceedings , our greatest source of accomplishment comes from our
success in counselling , training and advising our clients on the
best ways to avoid becoming party to such proceedings in the
first instance. A prime example of the firm' s emphasis on this
"preventive maintenance" approach is the services it provides to
a number of local agency Employment Relations Consortiums
throughout the State.
What is an Employment •Relations Consortium (ERC)?
An ERC is a number of -local agencies--- (cities, counties and
special districts) , or school and college districts, in a
geographic area joining together for the purpose of securing
quality employment relations training and consultation services
on a very economical basis.
What Kind of Training and Advice is Encompassed in an ERC?
The two kinds of services covered by consortium membership
are unlimited telephone consultation and training workshops .
The subject matter of training workshops are determined
annually by the ERC members. Most commonly agencies prefer to
emphasize workshops directed to their first line supervisors and
middle managers who are generally not the ones that are exposed
to such training at League of California Cities, County
Supervisors Association and similar professional organization
conferences. Also, ERC agencies commonly choose to include a

"dinner workshop" presentation for members of their governing
bodies and top level managers; and half-day "general discussion"
sessions for the agencies' personnel and labor relations
managers.
Attached at Tab 1 are copies of schedules of some of the
current ERCs that reflect the variety of subjects covered in
these workshops.
Who Provides the Training and Advice?
Liebert, Cassidy & Frierson consists of approximately
fifteen attorneys , who, by virtue of their professional
background and experience, possess the highest level of expertise
regarding all facets of public sector employment relations.
Because of our emphasis on "preventive maintenance" through
the conducting of training workshops and similar presentations ,
the various members of the firm have extensive experience in
conducting training programs. In addition, the firm' s staff
includes a full-time Director of Management Training , who, in
addition: to his record of success as a Trainer, has many years
experience in developing and administering employment relations
programs for public agency supervisors and managers.
Guest participants may be invited to assist in the
presentations with respect to certain types of workshops. For
example, mediators from the State Mediation and Conciliation
Service commonly participate in Negotiation/Mediation Workshops ,
and arbitrators are often participants in workshops that cover
arbitration, discipline and fact finding hearings.
What Approach is Used in Presenting Workshops?
ERC workshops avoid the lecture approach. Rather, they
utilize a variety of training techniques that facilitate audience
participation and that emphasize practical application of the
subject matter. Case studies , in-basket exercises , pre-tests ,
and simulated exercises are examples of training techniques
utilized. Workbooks are developed that consist to a large extent
of check lists and sample forms designed to provide supervisors
and managers with a practical reference tool that they can
utilize on a day-to-day basis.

What are Some Examples of Current ERCs?
Examples of local agency ERCs are:
The Inland Valley ERC, consisting of the Cities of Beaumont,
Chino, Colton, Fontana, Ontario, Rancho Cucamonga, San
Bernardino, Upland and Victorville.
The Monterey Bay Area ERC, comprised of Monterey County and
the Cities of Carmel , Gonzales , Monterey, Hollister , Pacific
Grove, Salinas, Santa Cruz, Seaside and Watsonville .
The Orange County ERC, made up of Orange County and the
Cities of Anaheim, Brea, Cypress, Garden Grove, Huntington Beach,
Irvine, La Habra, Orange, San Clemente, San Juan Capistrano and
Tustin.
The San Gabriel Valley ERC, the member agencies of which are
Alhambra, Arcadia, Claremont, Covina, Downey, Duarte, E1 Monte,
Glendale, Glendora, La Verne, Los Angeles Community Development
Commission, Monterey Park, Ontario, Pasadena, Pomona, South E1
Monte and West Covina.
The' Ventura/Santa Barbara Counties ERC, the members of which
are the Counties of Santa Barbara and Ventura, the Cities of
Carpinteria, Fillmore, Oxnard, Port Hueneme, Santa Barbara, Santa
Paula, Simi Valley, Thousand Oaks and Ventura, and the South
Coast Area Transit Authority and the Ventura Regional Sanitation
District.
How is an ERC Established, and What Does it Cost?
To establish an ERC a group of agencies in a geographic area
merely enter into simple consortium agreements with Liebert,
Cassidy & Frierson. An example of such an agreement appears at
Tab 2 .
The Consortium fee per agency varies from $1 , 300 to $2 , 000
per year , depending upon the number of agencies, the number of
workshops scheduled , and whether fees are equalized between
members or are varied based on size of agency. - -
