FINANCIAL STATEMENT : No cost to City.
DESCRIPTION : This ordinance is part of the program to
incorporate provisions of County Ordinances into the proposed
Municipal Code .
This ordinance requires swimming pools to be enclosed by a fence
or a fence and portions 'of the building . The technical
requirements are the same as the. County Ordinance . Section 5
contains additional requirements for any doors from a garage to
the pool enclosure to be self-closing and clarifies present
enforcement practice . An exception in the County Ordinance that
allows the omission of a fence on large acreage where the pool has
a large setback from public roads has been dropped because it
would not be applicable to Dublin .

N AN ORDINANCE OF THE CITY OF DUBLIN
REGULATING THE ENCLOSURE OF SWIMMING POOLS
The City Council of the City of Dublin , does ordain as follows :
Section 1 : Article 8 of Chapter 6 , of Title 3 of the Alameda
County Ordinance code as adopted by the City of Dublin is hereby
repealed .
Section 2 : DEFINITIONS
SWIMMING POOL . A swimming pool shall mean an outside
body of water, created by artificial means designed or used for
swimming or other imersion purposes , any portion of which is 2 feet
deep or more . It shall include a fish pond or wading pool .
Section 3 : Enclosure .
Every swimming pool shall be enclosed by a fence or
portion of a building wall not less than four and one-half (412 )
feet in height . Openings other than gates in the fence shall not
exceed four (4 ) inches in horizontal dimension. Horizontal rails
or members of the fence shall be so spaced that the fence is not
readily climbable .
Section 4 : Gates .
Each gate providing access to the pool through the fence shall
be equipped with a self-closing , self- latching device designed to
keep the gate securely closed at all times when not in actual use .
The latching device of the gate shall be at least four (4) feet
above grade .
Section 5 : Doors .
Where a garage forms part of the pool enclosure any doors from
the garage to the pool enclosure shall be equipped with a self-
closing , self- latching device designed to keep the door securely
closed when not in actual use . The latching devise of the door
shall be at least four (4 ) feet above the floor .
Section 6 : Maintenance.
The owner or the person in possession of the premises shall
maintain the gates , doors , and fence in good condition at all
times .
Section 7 : Enforcement .
The provisions of this ordinance shall be enforced by the City
Manager or his designated representative.
Section 8: POSTING OF ORDINANCE
The City Clerk of the City of Dublin shall cause this
ordinance to be posted in at least three ( 3 ) public places in the
City of Dublin in accordance with Section 36933 of the Government
Code of the State of California .
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF
DUBLIN ON THIS TH DAY OF 1986 .
