HomeMy WebLinkAbout4.02 Authorize Claim for TDA Funds W, CITY OF DUBLIN ' o Q ' AGENDA STATEMENT CITY COUNCIL MEETING DATE: March 23, 1987 SUBJECT Authorization to Submit Claim for 1987-88 Transportation Development Act (TDA) Funds EXHIBITS ATTACHED Resolution; Opinion of Counsel RECOMMENDATION : /1) Authorize the City Manager to file and execute the necessary documents to claim TDA funds 2) Authorize the continuation of City participation in the Tri-City Paratransit JPA to furnish Paratransit Services FINANCIAL STATEMENT: The City will receive $11, 436. 00 in TDA funds for Fiscal Year 1987-88. The City received $12, 345 in TDA funds for Fiscal Year 1986-87. The total recommended subsidy for Fiscal Year 1987-88 is $14, 586. The City' s subsidy for Fiscal Year 1986-87 is $11, 773. DESCRIPTION Dublin is currently a member of a Joint Powers Authority (JPA) with the Cities of Danville and San Ramon to provide Paratransit Services for the elderly and handicapped. The JPA contracts with the Community Services Group, a nonprofit corporation, to operate and manage the transportation services to satisfy the needs of the elderly and handicapped. Money used to pay for the cost of these services in Dublin come from the following services : 1. Passenger fares 2 . Contribution from operator 3 . Dublin' s General Fund 4. Transportation Development Act (TDA) 5. Senior Citizen subsidy The proposed budget for operating the Paratransit Service in Dublin for 1987-88 equals $38, 182 . The JPA met, reviewed, and concurs with the proposed 1987-88 budget. It is estimated that the total of all revenues for the Paratransit Services , excluding Dublin ' s subsidy, that are allocated to Dublin will equal $23, 596 : Revenue Estimates 1. Passenger fares $ 4, 350 2 . Operator contribution 7, 491 3. TDA 11, 436 4 . Senior Citizen Subsidy 319 $23, 596 The balance of the expenses would be absorbed by Dublin ' s General Fund and equals $14, 586. This represents an increase of $2, 813 in Dublin ' s subsidy when compared to Fiscal Year 1986-87. The reason for this increase is attributable to a 5% increase in the operator ' s operating costs for Fiscal Year 1987-88 and a reduction in Dublin ' s TDA funds . ---------------------------------------------------------------------------- COPIES TO: ITEM NO. AGENDA STATEMENT: Paratransit Services Page 2 It should be noted that for the first six months of 1986-87, 310 of the rides were from Dublin, while Dublin contributed only 26% of the funding when considering TDA funding and the City' s subsidy. Given the reduced level of TDA funding to Dublin, Staff believe the modest increase in the City' s subsidy is warranted. In 1986 the City requested LAVTA (Livermore Amador Valley Transit Authority) to submit a proposal to provide paratransit services to the City of Dublin. A study conducted by LAVTA, which was recently released, identifies the inability of that agency to serve the paratransit needs of Dublin' s elderly and handicapped until 1988-1989. The major constraint to the consolidation in 1987-1988 is the requirement of another vehicle. Because the Tri-City JPA is operational, provides the needed services, and since LAVTA has requested postponing the date of consolidation, Staff recommends that Dublin continues to provide paratransit service for 1987- 1988 through the existing JPA. »�r r}a .+-t u^:., c'F� ::f Yry'�.hA ak�t��"� i�� a S f. �i S � !2. .r ny 3.�C' r -",w✓ i;«+r ." - y. . .3 ",r'y�.`',' i . n RESOLUTION NO. - 87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -------------------------------------- AUTHORIZING THE FILING OF A CLAIM WITH THE METROPOLITAN TRANSPORTATION COMMISSION FOR ALLOCATION OF TRANSPORTATION DEVELOPMENT ACT (TDA) FUNDS FOR FISCAL YEAR 1987-88 WHEREAS, the Transportation Development Act (TDA) , (PUC Codes Division 10, Part 11 , Chapter 4 section 99200 et s.eq) provides for the disbursement of funds and defines the limited use of the funds to include the cost of paratransit services ; and WHEREAS, claimants requesting T. D. A. funds must submit their request to the Metropolitan Transportation Commission by April 1 , 1987 (21 Cal . Adm. Code § 6630. ) ; and WHEREAS, the City of Dublin is authorized to be a claimant and requires T. D. A. funds for the purposes of defraying a portion of the costs associated with Paratransit Services for fiscal year 1987-88. NOW, THEREFORE, BE IT RESOLVED that the City Manager is authorized to execute and file the T. D. A. Article 4. 5 and 8-TRANSIT claimant ' s form and all necessary documents with the M.T. C. to satisfy the claiming requirements ; and FURTHERMORE BE IT RESOLVED that the M.T.C. be requested to grant the allocations of .funds as specified in the Claim documents . AYES : NOES : ABSENT: Mayor ATTEST: City Clerk • TO: METROPOLITAN TRANSPORTATION COMMISSION FROM: City of Dublin DATE: March 23, 1987 SUBJECT: ELIGIBILITY FOR TRANSPORTATION DEVELOPMENT ACT FUNDS This communication will serve as the requisite opinion of counsel in connection with the application of the City of Dublin for an allocation of Transportation Development Act (TDA) funds . 1 . The City of Dublin is authorized to provide and assist public transportation by acquisition, construction and operation of existing or additional transit facilities . This assistance may be provided directly or by contractual arrangements with other parties . 2 . The City of Dublin is an eligible claimant for Transportation Development Act (TDA) funds pursuant to PUC Section (s ) 99275 et. seq. 3. I have reviewed the pertinent State and local laws, and I am of the opinion that there is no legal impediment to the City of Dublin making applications for TDA funds . Furthermore, as a result of my examinations , I find that there is no pending or threatened litigation which might in any way adversely affect the proposed projects, or the ability of the City of Dublin to carry out such projects .
