AGENDA STATEMENT
CITY COUNCIL MEETING DATE: March 14, 1988
SUBJECT Authorization to submit claim for 1988-89
Transportation Development Act (TDA) Funds
EXHIBITS ATTACHED Resolution, Opinion of Counsel
RECOMMENDATION 1 . Authorize the City Finance Director to file and
execute the necessary documents to claim TDA
funds .
2. Authorize the preparation of the contract for
services between the City of Dublin and LAVTA.
FINANCIAL STATEMENT: The City will receive $11 , 671 In TDA funds for Fiscal
Year 1988-89. The City received $12,345 of TDA funds
in 1986-87, and $11 , 436 in 1987-88. The City ' s
General Fund budgeting level for paratransit is
$2, 000.
DESCRIPTION The City is currently a member of the Joint Powers
Authority (JPA) with the cities of Danville and San Ramon to provide
paratransit services to the elderly and handicapped . The JPA contracts with
the Community Services Group , a nonprofit corporation, to operate and manage
the transportation services to accomplish the tasks of the paratransit
program . Money used to pay for the cost of the services in Dublin have come
from the following areas :
1 . Dublin ' s General Fund
2 . Transporation Development Act (TDA)
3. Passenger fares
4. Contribution from operator
This year , the Council is asked to authorize Staff to contract with the
Livermore-Amador Valley Transit Authority to provide the paratransit
services for Dublin seniors and the handicapped : The proposed budget from
LAVTA for the Dublin paratransit program in 1988-89 is $20,453. The funding
for this program is expected to come from' the following sources :
1 . TDA funds $11 , 671
2 . Fares $3,100
3. Dublin ' s General Funds $2 , 000
4. LAVTA system-wide contribution $3, 682 .
The amount absorbed by Dublin ' s General Fund equals a decrease of $12 , 586
below the amount budgeted in 1987-88. The reason for this reduction is the
lower cost of providing the services .
The Council needs to know that there may be some additional unbudgeted costs
or balances available from the San Ramon Community Services Group contract
at the end of this year . The difference has not been finalized , but is
composed of the following items :
1 . The SRCSG experienced a substantial increase in the amount of
vehicle insurance premiums over the amount budgeted in the 1987-88
year . The City ' s net share of this increase has not been determined
yet , but could amount to approximately $3,000 gross.
2. The City helped to pay for the acquisition of another van for the
SRCSG which is due to be delivered between April and June of this year.
The City ' s equity in this van amounts to $3,014.
Staff recommends that Dublin contract with LAVTA to provide the paratransit
program services for 1988-89, and that Council authorize Staff to file the
claim for TDA 4. 5 funds for that same year .

OF THE CITY OF DUBLIN

AUTHORIZING THE FILING OF A CLAIM WITH THE
METROPOLITAN TRANSPORTATION COMMISSION
FOR ALLOCATION OF DEVELOPMENT ACT (TDA) FUNDS
FOR FISCAL YEAR 1988-89
WHEREAS, the Transportation Development Act (TDA) , (PUC
Codes Division 10, Part 11, Chapter 4 Section 99200 et. seq. )
provides for the disbursement of funds and defines the limited
use of the funds to include the cost of paratransit services; and
WHEREAS, claimants requesting TDA funds must submit their
request to the Metropolitan Transportation Commission by April 11
1988 ( 21 Cal . Ad. Code Section 6630 . ) ; and
WHEREAS, the City of Dublin is authorized to be a claimant
and required TDA funs for the purpose of defraying a portion of
the costs associated with Paratransit Services for fiscal year
1988-89 .
NOW, THEREFORE, BE IT RESOLVED that the City Manager or
Finance Director is authorized to execute and file the TDA
Article 4 . 5 and 8-TRANSIT claimant 's form and all necessary
documents with the MTC to satisfy the claiming requirements; and
FURTHERMORE BE IT RESOLVED that the MTC be requested to
grant the allocations of funds as specified in the Claim
documents .

SUBJECT; ELIGIBILITY FOR TRANSPORTATION DEVELOPMENT ACT FUNDS
This communication will service as the requisite opinion of
counsel in connection with the application of the City of
Dublin for an allocation of Transportation Development Act (TDA)
funds .
1 . The City of Dublin is authorized to proved and assist
public transportation by acquisition, construction and
operation of existing or additional transit facilities . This
assistance may be provided directly or by contractual
arrangements with other parties .
, 2 . The City of Dublin is an eligible claimant for
Transportation Development Act (TDA) funds pursuant to PUC
Section(s ) 99275 et. seq.
3 . I have reviewed the pertinent State and local laws, and I
am of the opinion that there is no legal impediment to the
City of Dublin making applications for TDA funds .
' Furthermore, as a result of my examinations, I find that
there is no pending or threatened litigation which might in
any way adversely affect the proposed projects, or the
ability of the City of Dublin to carry out such projects.
