HomeMy WebLinkAbout4.10 Accept Quitclaim Deed Alamo Creek 6-10 - �5 CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: July 25, 1988 SUBJECT: Quitclaim Deed from Rafanelli and Nahas to the City of Dublin AND Quitclaim Deed from the City of Dublin to Rafanelli and Nahas Relative to Alamo Creek EXHIBITS ATTACHED: 1) Resolutions 2) Quitclaim Deed from Rafanelli and Nahas to the City of Dublin 3) Quitclaim Deed from the City of Dublin to Rafanelli and Nahas 4) Map of Area 5) Cross Section Through Area Showing Drainage Pattern RECOMMENDATION: Adopt Resolutions; authorize Mayor to execute quitclaim deed from City to Rafanelli and Nahas and to s accept quitclaim deed from Rafanelli and Nahas to City. FINANCIAL STATEMENT: No financial consideration associated with quitclaim deeds. DESCRIPTION: During the grading of Tract 5511 (the Villages) along Alamo Creek, the final grading did not exactly match the design of theoretical grading due to physical variances in the terrain. The fence between the two loop roads and the easterly top of bank of Alamo Creek was required by Zone 7 to be located at the high point from which the land would drain one way to the creek and the other way to the street. This variation is generally in the one- to two-foot range and runs on both sides of the theoretical line. To correct this line so that the fence is the dividing line between the street right-of-way and the creek right-of-way, a recorded lot line adjustment is necessary. The two attached deeds establish this new line, and both the City and Rafanelli and Nahas. must quitclaim their rights to those lands which now vary from the new boundary line so that when Rafanelli and Nahas deed the creek area to Zone 7, the deed will be for those parcels bounded by the existing fence. In the quitclaim deed from Rafanelli and Nahas to the City, the area transferred to the City for street right-of-way in Lot G is 0.0049 acres, and the area in the quitclaim to Rafanelli and Nahas from the City in Lots E and F is 0.1366 acres. The net effect of this lot lire adjustment will be a gain of .13 acres to Rafanelli and Nahas from the street right-of-way, which will be passed on to Zone 7 for Alamo Creek. Both sides of the line are open space; the street side is to be more intensely landscaped. Staff does not believe this amount of land transfer is significant. Staff recommends that the City Council adopt the resolutions (1) approving the City's quitclaim to Rafanelli and Nahas and authorizing the Mayor to execute same and (2) approving Rafanelli and Nahas' quitclaim to the City and authorizing the Mayor to accept same. ---------------------------------------------------------------------------- ITEM NO. BE IT FURTHER RESOLVED that said quitclaim is contingent upon execution of quitclaim deed from the City of Dublin to Rafanelli and Nahas approved by Resolution No. _-88 adopted by the City Council of Dublin on July 25, 1988.
