AGENDA STATEMENT
CITY COUNCIL MEETING DATE: August 8, 1988
SUBJECT East Dublin Studies Resolution establishing a
procedure for reimbursement of the cost of the
preparation of the East Dublin Specific Plan;
and East Dublin Studies Reimbursement Agreement
between The City of Dublin and Property Owners
sponsoring the costs of the East Dublin Specific
Plan

FINANCIAL STATEMENT None
DESCRIPTION The attached Resolution and Agreement represent
the final products necessary for review and acceptance by the City Council
regarding the preparation of the East Dublin General Plan Amendment/Specific
Plan studies and EIR.
Exhibit A is a copy of the Draft Resolution establishing a procedure for
reimbursement of the costs for the preparation of the East Dublin Specific
Plan. Section 65456 of the Government Code of the State of California permits
cities to recover the cost of the preparation bf specific plans. It is
required by law that this procedure be established by either adopting a
resolution or ordinance that puts this reimbursement action into effect. The
City Attorney has determined that a resolution is most appropriate because of
its flexibility if revisions are necessary in the future. It is the intent of
this resolution to create a policy and procedure for the collection of fees to
recover the cost of preparation of the East Dublin Specific Plan.
The fees are imposed on any and all Property Owners within the boundaries of
the East Dublin Specific Plan Study Area. The fees are based on a cost-per-
acreage rate. A formula for calculating the fee is included in the
Resolution. Any Property Owner in the Specific Plan Study Area who has
previously entered into an agreement with the City to sponsor the cost of the
East Dublin Specific Plan (and who has paid an amount equal to or greater than
their required fee for participation) will be exempt from payment of any fees
pursuant to this Resolution. It is possible that these Property Owners could
be reimbursed in the future. Staff recommends that the City Council review
and adopt the Draft Resolution (Exhibit A) establishing a procedure for
reimbursement of Specific Plan costs.

Exhibit B is a copy of the Draft Agreement between the City of Dublin and
Property Owners for reimbursement of the costs of the East Dublin Specific
Plan study. In the event that the City recovers any of the costs of preparing
the Specific Plan from Non-Sponsoring Property Owners (which would be
collected by the City when those non-sponsors seek governmental approvals
which are consistent with the Specific Plan) pursuant to Government Code
Section 65456, the City shall reimburse Sponsoring Property Owners. That
reimbursement shall be based upon the proportion that the individual
Sponsoring Property Owner's additional Specific Plan costs bear to the total
additional Specific Plan costs. For example, if Sponsoring Property Owner "A"
contributes 25% of the total additional Specific Plan costs, Sponsoring
Property Owner "A" will be reimbursed 25% of any costs the City recovers from
Non-Sponsoring Property Owners.
Staff recommends that the City Council review and approve the draft
Reimbursement Agreement between Property Owners and the City (Exhibit B) and
authorize the City Manager to enter into an agreement with each Specific Plan
Sponsoring Property Owner.

ESTABLISHING A PROCEDURE FOR REIMBURSEMENT
OF THE COST OF PREPARATION
OF THE EAST DUBLIN SPECIFIC PLAN
WHEREAS, The City of Dublin is preparing a Specific Plan for
the East Dublin Area, which is delineated on Attachment A hereto;
and
WHEREAS, the East Dublin Specific Plan ("Plan") is being
prepared with the assistance of the consultant firm of Wallace
Roberts & Todd and other associated consultants; and
WHEREAS, the preparation of the plan will require some
amount of time from City Staff; and
WHEREAS, the cost of the Plan (which is estimated to be
$500, 240 plus City Staff costs) is a significant expenditure of
public funds; and
WHEREAS, the Specific Plan is being prepared to provide
policies, standards, and procedures for development and
management of the East Dublin Specific Plan Area, which policies,
standards and procedures will help achieve orderly and well-
planned development for The City of Dublin by providing measures
necessary to protect valuable natural resources, to accommodate
increased traffic, increased demand on public services, and
increased population; and
WHEREAS, it is expected that the Plan will promote the
general good of The City of Dublin, will be of direct, immediate
and long-term economic benefit to property owners, developers,
and entrepreneurs in the East Dublin Area; and
WHEREAS, Section 65456 of the Government Code of the State
of California permits the recovery of the costs of the
preparation of the Specific Plan, including costs incurred
pursuant to Division 13 of the Public Resources Code (CEQA) ; and
WHEREAS, it is the purpose and intent of this Resolution to
establish a policy and procedure for the collection of fees to
recover the cost of preparation of the East Dublin Specific Plan;
NOW, THEREFORE, BE IT RESOLVED THAT The City Council of The
City of Dublin does hereby find that:
a) Fees shall be imposed on any and all Property Owners '
lands within the boundaries of the East Dublin Specific Plan Area
if and when an application is submitted to The City of Dublin for
a permit, governmental approval or annexation which is consistent
with the East Dublin Specific Plan.
b) Said fees shall be based on a cost-per-acreage rate and
calculated by the following formula:
(i) Rate = Total cost of preparation of The Specific
Plan divided by total acreage within the Specific Plan Study
Area; and

Fee = Rate x Property Owner's acreage as set
forth in the East Dublin Specific Plan.
(iii) To compensate for the fluctuating change in the
value of the U.S. Dollar, the fee shall be adjusted annually
by multiplying it by the U.S. Department of Labor Bureau of
Labor Statistics Consumer Price Index for the San Francisco
Bay Area (all urban consumers) for the preceding year.
C) Any Property Owner who has entered into an agreement
for payment of a portion of the costs of the East Dublin Specific
Plan Study and who has paid an amount equal to, or greater than
the fees which would be imposed pursuant to this Resolution shall
be exempt from payment of such fees or shall receive a refund, as
the case may be.

AGREEMENT
FOR REIMBURSEMENT OF PAYMENT
OF THE COSTS OF THE
EAST DUBLIN SPECIFIC PLAN STUDY
THIS AGREEMENT is made and entered into this day of
, 1988, between THE CITY OF DUBLIN, a Municipal corporation,
hereinafter referred to as "The City" and
owner of certain real property known as APN
hereinafter referred to as "The Property Owner" .
R E C I. T A L S
WHEREAS, The City will begin the process of preparing an amendment
to its General Plan which area is generally referred to as the East Dublin
General Plan Amendment Study Area (see Exhibit "A") upon execution of this
Agreement; and
WHEREAS, The City will begin the process of preparing a Specific
Plan (see Exhibit "B") for the area proposed to be encompassed within the East
Dublin General Plan Amendment Study Area upon execution of this Agreement; and
WHEREAS, The Property Owner owns acres
(APN(S) ) which is within the area covered by the General
Plan Amendment Study and the Specific Plan ("East Dublin Area") ; and
WHEREAS, The City and The Property Owner have entered into an
"Agreement between the City of Dublin and Sponsoring Property Owners for
Payment of a Portion of the Costs of the East Dublin General Plan Amendment
Study, Specific Plan Study and Environmental Impact Report" (See Exhibit C)
whereby The Property Owner has paid to The City the amount of $
as "Additional Specific Plan Costs" ; and
WHEREAS, by entering into this Agreement, The Property Owner
understands and agrees that Section 2 of this Agreement entitled Reimbursement
to Property Owner, amends and supersedes Section 5 entitled Reimbursement to
The Property Owner of the "Agreement Between The City Of Dublin And Sponsoring
Property Owners For Payment Of A Portion Of The Costs Of The East Dublin
General Plan Amendment Study, Specific Plan Study And Environmental Impact
Report" ; and
WHEREAS, the Specific Plan covering The Property Owner's property
will be prepared as defined in Section 65450, et seq. , of the Government Code
as a guide for the development and use of said property described herein;
WHEREAS, the following owners of property within the East Dublin
Area ("Sponsoring Property Owners") have contributed their estimated
proportional share of the cost of preparing the East Dublin Specific Plan.

WHEREAS, Sponsoring Property Owner has paid to The City an amount
of money as "additional Specific Plan Costs" consisting of Sponsoring Property
Owners' proportional share of the costs of the Specific Plan ascribed to the
parcels owned by Non-Sponsoring Property Owners;
NOW, THEREFORE, The City and The Property Owner agree as follows:
1. Prior Payments to The City. The Property Owner is a
Sponsoring Property Owner and has paid to The City the following amounts as
its proportional share of the cost of preparing the Specific Plan, the
Environmental Impact Report and related documents as more fully described
above:

Section 65456, The City shall reimburse The Property Owner in the amount of
The Property Owner' s payment of the "Additional Specific Plan Costs, " as set
forth in paragraph 1, above, as follows: The Property Owner' s reimbursement
of any costs recovered by The City shall be in that proportion of the amount
recovered by The City which The Property Owner's "Additional Specific Plan
Costs" contribution bears to the total "Additional Specific Plan Costs"
payments made by all Sponsoring Property Owners, but not to exceed the amount
of $ Such reimbursement shall not include interest.

3. No Liability. It is specifically agreed that by entering
into this Agreement, The City does not bind itself to approve a Specific Plan
for the East Dublin Area.
4. The foregoing recitals are a part of this Agreement.

AGREEMENT
BETWEEN THE CITY OF DUBLIN AND THE SPONSORING PROPERTY OWNERS
FOR PAYMENT OF A PORTION OF THE COSTS OF THE
EAST DUBLIN GENERAL PLAN AMENDMENT STUDY
SPECIFIC PLAN STUDY
AND
ENVIRONMENTAL IMPACT REPORT
THIS AGREEMENT is made and entered into this 27th day of June, 1988, by
and between the CITY OF DUBLIN, a Municipal corporation, hereinafter referred
to as "The City" , and Mr. and Mrs. Gregory Anderson, owner(s) of certain real
property known as APN(S)99B-3200-6-3, hereinafter referred to as "The Property
Owner" .
WHEREAS, The City will begin the process of preparing an amendment to
its General Plan which is generally referred to as the East Dublin General
Plan Amendment Study (see Exhibit "A") upon execution of this Agreement; and
WHEREAS, The City will begin the process of preparing a Specific Plan
(see Exhibit "B") for the area proposed to be encompassed within the East
Dublin General Plan Amendment Study upon execution of this Agreement; and
WHEREAS, The Property Owner owns 49 acres in the City (APN(S) 99B-3200-
6-3) which is within either the area covered by the East Dublin General Plan
Amendment Study or the area covered by both the East Dublin General Plan
Amendment Study and the Specific Plan; and
WHEREAS, The Property Owner requires professional services in the field
of land use, urban planning, architecture, engineering, geology and fiscal
economics, including environmental analysis as required under California
Environmental Quality Act (CEQA) , for the purposes of preparing the East
Dublin General Plan Amendment Study and Specific Plan for its real property
described above; and
WHEREAS, The City is authorized by Section 37103 of the Governmental
Code of the State of California to contract for special services and advice
set forth under this Agreement; and
WHEREAS, The City intends to contract with Wallace, Robert and Todd
(hereinafter referred to as "The Consultant") to perform these services for
The Property Owner with parcels in what is known as the East Dublin General
Plan Amendment and Specific Plan Study areas; and
WHEREAS , the East Dublin General Plan Amendment Study and Specific Plan
for The Property Owner's property will be prepared as. defined in Section
65450, et seq. , of the Government Code as a guide to the development and use
of said property described herein;

NOW, THEREFORE, The City and The Property Owner agree as follows:
1. Scope of Work. Upon execution of this Agreement, The City will
enter into an agreement with The Consultant to (a) prepare an amendment to the
City's General Plan for the area known as East Dublin; (b) prepare a Specific
Plan as defined in Government Code Section 65450, et seq. , for the area know
as East Dublin, and (c) prepare all other documents, reports and analyses
requisite to the legislative approval of said General Plan and Specific Plan,
including, but not limited to, the preparation of all documents necessary to
comply with CEQA and a fiscal analysis for the preparation of the Specific
Plan.
It is further agreed that by entering into this Agreement, The
City does not bind itself to approve a General Plan Amendment or Specific Plan
for the East Dublin area.
2. Payment To The City. The Property Owner will pay The City the
following amounts as its proportional share of the cost of preparing the
General Plan Amendment, the Specific Plan, the Environmental Impact Report and
related documents as more fully described above:
General Plan (The Property Owner's property
only) $1,677.00
Additional General Plan Costs (The Property
Owner's proportional share of the costs
ascribed to the parcels owned by non-
participating property owners) $1,489.00
Specific Plan (The Property Owner's property
only) $3,474.00
Additional Specific Plan Costs (The Property
Owner's proportional share of the costs
ascribed to the parcels owned by non-
participating property owners) $ 642.00
TOTAL, $7,287.00
3. Method of Payment. The Property Owner agrees to pay The City the
total sum indicated in the preceding paragraph. Payment shall be made in lump
sum, and the funds, together with funds paid by other contributing property
owners, shall be deposited by The City into an interest-bearing account.
Payment by The Property Owner shall be considered full satisfaction of The
Property Owner's obligations under this Agreement.
The funds deposited by The City shall be disbursed pursuant to the
terms of the agreement between The City and The Consultant. At the conclusion
of the agreement between The City and The Consultant, any unused funds and
accrued interest shall be disbursed to The Property Owner in the proportion
The Property Owner's payment bears to the total payments made by other
contributing property owners. The City shall furnish The Property Owner with
an accounting of the funds disbursed to The Consultant.

Failure of The City to execute an agreement with The Consultant
within thirty (30) days of receipt of all funds being paid by contributing
property owners shall result in a refund by The City to The Property Owner of
all deposited funds and accrued interest thereon.
4. Termination of Work. In the event The City decides to terminate
work on the preparation of the East Dublin General Plan Amendment Study and
Specific Plan Study, The City shall refund to The Property Owner that portion
of deposited funds and accrued interest that has not been earned by and/or
paid to The Consultant. Said refund shall be in the proportion The Property
Owner's payment bears to the total payments made by other contributing
property owners.
5. Reimbursement to The Property Owner. In the event The City
recovers any of the costs of preparing the Specific Plan from persons seeking
governmental approval for lands within the East Dublin Specific Plan Area
pursuant to Government Code Section 65456, The City shall reimburse The
Property Owner in the amount of The Property Owner's proportional share of the
"additional Specific Plan costs" not to exceed the amount of $642.00. The
Property Owner's reimbursement shall be in the proportion The Property Owner's
Specific Plan contribution bears to the total Specific Plan payments made by
other contributing property owners.
6. Change of Consultants. In the event that The Consultant is unable
to complete any portion of the Scope of Work as assigned the City reserves the
right to hire similarly qualified consultants to complete the remaining tasks
associated with the Scope of Work.
7. Revisions To This Agreement. In the event that special
circumstances require that this Agreement be amended, mutual written consent
in support of the amendment must be reached between The City and Sponsoring
Property Owners prior to any amendment taking place.
8. Hold Harmless. The City agrees to hold harmless and indemnify The
Property Owner for any and all liability arising out of The City's or The
Consultant' s negligence.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed as of the date and year first above written.
