HomeMy WebLinkAbout5.1 Valley Artists Request to Waive Use Policy CITY OF DUBLIN /� l AGENDA STATEMENT CITY COUNCIL MEETING DATE: November 14 , 1988 SUBJECT Request from Valley Artists to Waive the Rental Policy for the Shannon Community Center EXHIBITS ATTACHED A) Correspondence from Florence Scudder B) Membership Roster RECOMMENDATION Uphold the recommendation of the Park and Recreation Commission FINANCIAL STATEMENT None DESCRIPTION At the June 13 , 1988 meeting of the Dublin City Council , the Council approved the revisions to the Facility Use Policy for the Shannon Community Center. One of the revisions to the policy was to establish guidelines for continuous use of the Center. As stated in the policy, continuous use of the Center is reserved for City of Dublin, Dublin School District and Non-profit Community Groups with 510 of their membership residing within the City of Dublin and/or the Dublin San Ramon Services District. At the September 26 meeting of the Council , the policy was further revised to delete Dublin San Ramon Services District from the definition. Staff has received correspondence from Florence Scudder representing the Valley Artists (Exhibit A) , who asks that an exemption be granted to the Facility Use Policy in order to allow their club to continue meeting at Shannon Center. As you can see by the membership roster shown in Exhibit B, the Valley Artists have a total of 70 members. The residency of the membership is as follows : Castro Valley 1 Danville 5 Dublin 11 Livermore 8 Pleasanton 11 San Francisco 1 San Ramon 29 Sunol 2 Walnut Creek 2 With only 16% of their membership residing within the City of Dublin, the Valley Artists do not meet the residency requirements for a Community Group established by the Facility Use Policy. By way of history, the Valley Artists submitted a grant application to the City in March of 1986 . The objective of the grant was for support of meeting facilities, equipment and services for the Valley Artists. The total dollar amount requested was $2 , 898 . As there was no formal policy established relative to granting funds to non-profit organizations , the City Council referred the matter to the Park and Recreation Commission, directing them to consider development of a policy to address requests of this type. At the June 23 , 1986 meeting of the Dublin City Council , the Commission recommended against direct funding of non-profit groups. Instead they recommended that the City provide in-kind services such as utilization of Shannon Center at no cost or an equipment lending library. The City Council concurred with the Commissions recommendation. Consequently, in July of 1986 the Valley Artists applied to use Shannon Center at no cost for their monthly meetings as well as their annual art show. Their request was approved provided that they could furnish the City with a valid certificate of liability insurance. Unfortunately the Valley Artists were not able to obtain insurance at an affordable cost, so they were forced to continue meeting at an alternate facility. ----------------------------------------------------------------- ITEM NO. Y,5J, Copies to: Florence Scudder, Valley Artists AGENDA STATEMENT - quest from Valley Artists November 141, 1988 Page Two In September of 1987 the Valley Artists once again approached the City about utilizing Shannon Center as they had been able to obtain the required insurance. They were granted a permit for January through June of 1988 and informed that they would need to renew their permit on an annual basis. They utilized the East Room from 7-10pm on the first Tuesday of each month and also the weekend of May 13-15 for their Spring Art Show. The Park and Recreation Commission considered the request of the Valley Artists at their regular meeting of November 8 , 1988 . It was the consensus of the Commission that the Dublin community is somewhat lacking in the area of cultural arts and that the Valley Artists are working to fill this void. Therefore, it was their recommendation that the Valley Artists be allowed to utilize Shannon Center at no cost for their monthly meetings as well as their Spring and Fall art shows. However, due to the renovation of Shannon Center , the facility will not be available for the Spring 1989 show. Staff has developed the following options for consideration by the Council: 1 . Deny the request 2. Uphold the July 1986 decision to allow free use by the Valley Artists 3 . Waive the residency requirement under the Community Group Classification, thus allowing them to utilize the facility for $8 per hour 4 . Waive the area of the policy which prohibits continuous use by non-residents , thus allowing them to utilize the facility for $37 per hour As one of the goals adopted by the City Council is "to investigate opportunities for assisting in the promotion of historical and cultural activities in Dublin" , staff recommends that the Council uphold the recommendation of the Park and Recreation Commission. Box 2340 Ref.: Use of Shannon Center Dublin, CA 94568 by The Valley Artists Dear Mayor: On behalf of The Valley Artists, a non-profit California corporation of about 65 members, located in Dublin since 1970, 1 wish to present for your consideration a major problem which the recent Council action has created for us by new rules for the use of Shannon Center. In 1987 we were given permission by the Director of Parks & Recreation to use the Shannon facilities for about six monthly evening meetings a year, as well as for our Spring Arts & Crafts Show held one weekend each May. Our Spring 1987 show, in new facilities, with a street banner to advertise it, was a huge success, bringing in people from all over the Valley. Accordingly, last year the officers and membership were under the impression that The Valley Artists had finally found an excellent place for their meetings, and also ample room for the art shows (see enclosed photos). We were indeed grateful, as prior arrangements had always been too crowded, hard for the public to find, and in general much too small for our shows. In 1987, to make all the enabling arrangements for our use of the Shannon facility, we did the following at a considerable cost to our small group and its equally small budget: 1. Had a permanent banner made to hang across San Ramon Road. 2. Took out a $ 1 million liability insurance policy. i 3. Printed our membership applications with the Shannon Center address (see enclosure). 4. Gave up our meeting space at the Dublin-San Ramon Senior Center (The White House at 9300 Alcosta 2 Boulevard, San Ramon), on the assumption we could continue at Shannon. Because of the Council's recent action, we are currently without a home, but with a failed commitment which is an embarrassment to us. We are a Dublin group, and have been so for the last eighteen years. To our knowledge, we are the only cultural arts group in Dublin. We are open to the public, not just to Dublin residents. We believe that Dublin should be proud, as a beginning City, to have such a group as ours. Our dues and the proceeds from our workshops have not been sufficient to support all our expenses. Some businesses pay on a regular basis for displaying works of our artists in their offices as part of their interior decoration. From the Tri-Valley Community Fund, for both 1986 and 1988, we have had specific materials assistance and also support for judges' fees at the Art Show. We barely get by financially, and would be unable to pay the $37 per hour under the new rules for outside groups at Shannon. We have been struggling to survive all these years, and now when we would expect help from the City, we are faced without the support which would make it possible for us to stay in Dublin. Without the Dublin base, how can we get new members from Dublin, in order to guarantee a 51 9 Dublin resident membership ? We did have a chance to qualify when the region included all of the DSRSD area of San Ramon, but this also has been changed. If the City of Dublin would make the necessary concession to allow us continuing use of the Shannon Center, we believe we could grow in Dublin resident membership and would thereby qualify. We are a small group, have tried to attract membership by being open to the general public, and now find ourselves being financially excluded from our own home community. This is a day of work for those who can do their own thing best in the company of others. Valley Circuit: A chance to have your finished work hung in local businesses and offices. This way you sell your art ! Annual Art Show: (At least one show per year) You are assured of hanging space and a chance to sell. Workshops: By qualified instructors, as many as we can fit in.
