BACKGROUND:
In April 1987, as a result of the citywide sign survey conducted in September
1986, the property owner and tenants were notified by the City's Zoning
Investigator of all illegal signs identified on the property at 7016-7150
Village Parkway.
Illegal signs identified included Wall Signs, Freestanding Signs and illegal
A-Frame Signs. The illegal Freestanding and A-Frame Signs were subsequently
removed.
The property owner subsequently filed an application for 1) a Conditional Use
Permit and Site Development Review for two C-2-B-40 Directory Signs/Special
Easement Signs and 2) Site Development Review for Sign Program for business
identification Wall Signs which exceed the height, length and sign area
regulations established by the City's Zoning Ordinance.
On May 2, 1988, the Planning Commission approved the Site Development Review
for C-2-B-40 Directory Sign and Sign Program and the Conditional Use Permit
for special easement sign subject to Conditions of Approval (see Attachment 1
and 2, Planning Commission Resolutions) .
On May 12, 1988, the Applicant appealed the Planning Commission's action
stating that "The Conditions of Approval are such that under them it is almost
impossible to meet the needs of the rear tenants for whom these signs are to
benefit. . . " (see Attachment 4, Applicant's Appeal Letter) .
Staff met with the Applicant on May 26, 1988 to discuss the Planning
Commission Conditions of Approval. Staff indicated Conditions of Approval
were worded in such a way as to allow Staff to review and approve the precise
location of the Directory Sign on either the southern or northern side of the
driveway once plans were submitted. The Applicant indicated he would hire a
sign company to draw up plans in compliance with the Conditions of Approval.
Staff agreed to postpone schedulipg the appeal for City Council pending the
Applicant's re-submittal of glans.
Staff met with the sign compan)f representing the Applicant on August 31, 1988
to discuss the Conditions of Approval. The proposed signs did not comply with
the Conditions of Appropval as the signs included tenant identification on
parcels which the tenants were not located and one sign was located in the
public right-of-way. Staff indicated the Applicant must submit plans in
compliance with the Conditions of Approval with the exception that the signs
may be located at the north side of the driveway subject to review and
approval.
On September 9, 1988, the Applicant requested Staff to schedule the appeal for
the November 14, 1988 City Council Meeting as he would be unavailable for the
October Council Meetings.

Although the Applicant's appeal letter does not specify which Conditions of
Approval would be difficult to comply with, it appears the Applicant has
difficulty with Condition #5, 6 and 10 (see Attachment 1, Resolution No. 88-
024) .
ANALYSIS:
Special Easement C-2-B-40 Directory Signs - Site Development Review and
Conditional Use Permit.
The site layout and development of the property consists of a group of
buildings fronting directly on Village Parkway and another group of buildings
situated directly behind the front buildings. This layout has caused signage
difficulty for tenants located in the rear buildings who wish to increase and
enhance business identification from Village Parkway (see Attachment 13: Site
Plan) .
The C-2-B-40 Directory Sign is the appropriate type of sign to achieve
identification for the rear businesses. The Applicant is requesting approval
of two single faced C-2-B-40 Directory Signs. The Applicant proposes to
locate Sign "B" within the front planter area at 7124-7150 Village Parkway
(APN 941-210-2-2) and locate Sign "A" in the planter area in front of Wolds
House of Hobbies at 7100 Village Parkway (APN 941-210-5-4) (see Attachment 14:
Assessor Parcel Map) . The Applicant proposes to situate the single faced
directory signs parallel to the front property line. The proposed maximum
sign height is 6 feet with a maximum sign area of 16 sq. ft. (4 ft. x 4 ft.) .
The Applicants proposed tenant identification for each directory sign is
indicated on Attachment 5.
Three of the tenants identified on Sign "B" are located on the adjacent parcel
(APN 941-210-5-4) . A Conditional Use Permit (for Special Easement Signs) is
required to locate business identification signs on parcels other than the
parcel on which the business is located. However, the Special Easement Sign
can only be granted for parcels without direct access or frontage on an
improved public right-of-way. Additionally, said properties must be
interconnected with a traversable non-revocable, non-exclusive recorded access
easement.
Both parcels have direct access on Village Parkway. Additionally, in
reviewing the property profile provided by the Applicant, there does not
appear to be a recorded access easement between the two properties.
Therefore, H & K Manufacturing, Valley Auto Clinic and Electra Door are not
permitted business identification on Sign "B" . These businesses may locate
identification signs on Directory Sign "A" . Also, John's Transmission, Amador
Ceramics and Dublin Garden would not be allowed on Sign "A" because Sign "A"•
is on a different parcel. Signs for these businesses would need to be located
on the parcel where the business is located.
Staff and the City Attorney's office have spent a significant amount' of time
reviewing the Applicant's Special Easement/C-2-B-40 Directory Sign Site
Development Review request related to the parcels involved in the application.
It appears the parcels indicated on the County Assessor Maps may not be
legally subdivided lots, . in particular APN 941-210-5-5. This parcel was
recorded in December 1982 after the City had incorporated. The City's Zoning
Ordinance defines a lot as "a separate parcel of land shown and identified as
such on the records of the County Recorder or on the Final Map of an approved
and recorded subdivision. . . " .
If APN 941-210-5-5 is a legally subdivided lot, it is the only lot in this
application which would qualify for the Special Easement Sign, in that the lot
would not have direct access on a publicly improved street. Approval of the
Conditional Use Permit for the Special Easement Sign was contingent upon the
Applicant providing verification of a legal subdivision or submit an
application for a Tentative Parcel Map in compliance with the California
Subdivision Map Act within 90 days and obtain Final Map approval within 6
months, or the Applicant may locate the C-2-B-40 Directory sign on the legally
subdivided lots (as permitted through the Site Development Review process) .
However, it is noted that a landlocked parcel (regardless of existing
easements) does not meet the City's minimum standards for subdivision

purposes. To date the Applicant has not provided verification that the lot
was legally subdivided in compliance with the California Subdivision Map Act
or the City' s Subdivision Ordinance.
Condition No. 10 of Resolution No. 88-24 requires that the Applicant modify
the southern most driveway to allow for ingress and egress rather than exit
only as currently exists, subject to the review and approval of the Planning -
Director and Traffic Engineer. As the situation currently exists the southern
driveway does not permit vehicles to enter. resulting in vehicles parking on
the adjacent property or circling the block in search of parking when the
first two driveways are missed. The City' s traffic committee has reviewed the
Conditions of Approval and the site and recommends that the southern driveway
be modified to accommodate vehicles entering the property as there is
insufficient driveway width to accommodate two way traffic.
TJKM, the City' s Traffic Consultant, has prepared a memo with recommendations
for conversion of the southern driveway to an enter only driveway including
recommendations for pavement directional arrows, "DO NOT ENTER" and "STOP"
pavement markings (see Attachment 6, TJKM memo and Figure 1) . Staff
recommends modification to Condition #10 to require conversion of the southern
most driveway from exit only to enter only in compliance with the memo and
Figure 1 from TJKM dated received November 7, 1988. Additionally, Staff
recommends a 45-day time limit for compliance with this condition.
The Applicant' s appeal letter does not note any particular problem with the
Sign Program. However, the Site Development Review approval includes the
directory signs and the Sign Program. The following is a background on the
Sign Program:
Sign Program Site Development Review
Under a previous Alameda County approval (S-291 approved November 19, 1969) a
sign program for the site was established restricting the maximum sign area
per business to 40 square feet. The sign program also established a maximum
of 60 sq. ft. per group of locator signs for businesses located in the rear
buildings.
The City wide sign survey conducted by the Zoning Investigator in September
1986 revealed that the majority of business identifiction signs located on the
Applicants property were illegal, -in that the signs did not comply with the
approved sign program. This was primarily due to the fact that the tenants
use of signs painted directly on the building face do not require building
permits. The lack of a requirement for a building permit or sign permit makes
the monitoring and regulation of wall painted signs difficult from a zoning
standpoint.
Staff notified the Applicant on September 29, 1987 that the sign program
submitted was inadequate, as the proposal did not establish uniform or
compatible signage for the development. The Applicant's proposal did not
include placement of signs, sign type, letter height, sign length or sign
area, items which are standard items contained in sign programs. Follow-up
correspondence with the Applicant in November 1987 and January 1988 did not
result in the submittal of any additional sign program information by the
Applicant. However, the Applicant did subsequently indicate he still wanted
to pursue the matter.
Staff recommended the Planning Commission deny the Applicant's request for
approval "en masse" of the existing wall painted signs and recommended
approval of the sign criteria prepared by Staff outlined in Figure 1 (see
Exhibit A) .

The Staff prepared sign program promotes uniformity in signage among the
tenants by establishing maximum sign area, letter height and length, and by
designating location of signage. The sign program does not exceed the maximum
dimensions permitted by the Zoning Ordinance through the Site Development
Review process. In processing one single Site Development Review for the
signs on the site it eliminates the need for each tenant to file a separate
Site Development Review application and $105 fee for each individual sign.
All signs will require zoning approval prior to placement. The proposed sign
program criteria permits larger signs than some of the existing business signs
and smaller than others. Those signs which are nonconforming with this Sign
Program because they are larger may continue until a new planning application

is processed for the individual business. Additionally the sign program
establishes a 60 day time period for illegal signs to comply with the new
provisions.
Staff recommends the City Council adopt the draft Resolution upholding the
Planning Commission's action approving PA 87-122 with a revision to Condition
#10 requiring conversion of the southern driveway to an "Enter Only" driveway
and establish a 45-day time period for compliance with Condition #10.

I. INTENT
The intent and purpose of%this Sign Program is to establish uniform and
compatible signage for business identification of the businesses/tenants
located at 7016-7150 Village Parkaay (commonly known as Don Hucke's
Buildings) . Uniformity and compatibility of Signage may be achieved through
restrictions on sign placement, letter height, sign length and sign area.
II. GENERAL PROVISIONS
1) Provisions established in this Sign Program are considered the
maximums allowed per business tenant space. Total signage per tenant
space shall not exceed the maximums established in this Sign Program.
2) Each business/tenant space is permitted one primary frontage for
signage and two secondary frontages for signage, provided the tenant
--- frontage is situated adjacent-to a public road-jay or public open space
area, such as a private street or driveway, open plaza or square or
parking lot located on site.
3) The total sign area permitted per tenant space shall consist of the
total sign area permitted for each tenant space primary frontage and -
secondary frontage. A tenant's sign area square footage not utilized as
-gall signage may be utilized within the appropriate C-2-B-40 Directory
freestanding sign, subject to compliance with the established provisions
for said directory sign.
4) Method for calculating sign height, sign length and sign area shall be
subject to the provisions established in the City's Zoning Ordinance.
Additionally, wall signs situated on a background of contrasting color
from the tenant's building color or on a board or similar material shall
be considered a can sign for the purposes of calculating sign area, sign
height and sign length.
5) Specific signage provisions not established within this Sign Program
shall be subject to provisions established in the Sign Ordinance.
III.PRI` ARY FRONTAGE
1, Maximum sign area: Total sign area per tenant space shall not exceed
10% of the surface area of the individual tenant's building frontage
available for signage.
2. Maximum letter height:
A. Signs shall not exceed two rows of letters stacked.
B. Maximum height 4�f #-aividual stacked letters: 13 inches (1 foot 6
inches) .
C. Total sign height for stacked letters: 41 .inches (3 feet 6 inches
includes 6 inches separation between rows).
D. Maximum letter height single r-ow letters or sign can: 36 inches

OF THE CITY OF DUBLIN

UPHOLDING THE PLANNING COMMISSION ACTION APPROVING PA 87-122 HUCKE SIGNS
CONDITIONAL USE PERMIT REQUEST FOR A C-2-B-40 SPECIAL EASEMENT DIRECTORY SIGN
AT 7016 - 7150 VILLAGE PAPXTAY
WHEREAS, Don Hucke, the property owner and Applicant filed an
application for Site Development Review for two C-2-B-40 Directory Signs and
Sign Program for Wall Signs and a Conditional Use Permit to allow a Special
Easement Sign at 7016-7150- Village Parkway; and
WHEREAS, the Planning Commission held a public hearing on said
application on April 18, 1988 and May 2, 1988; and
WHEREAS, proper notice of said public hearings was given in all
respects as required by law; and
WHEREAS, the request is categorically exempt in accordance with
the provisions of the California Environmental Quality Act; and
WHEREAS, a Staff Report was submitted recommending the application
be conditionally approved; and
WHEREAS, the Planning Commission heard iand considered all said
reports, recommendations, and testimony hereinabove set forth; and
WHEREAS, on May 2, 1988, the Planning Commission adopted
Resolution No. 88-024 approving PA 87-122 Site Development Review request for
C-2-B-40 Directory Sign and Sign Program for Wall Signs and adopted Resolution
No. 88-025 approving PA 88-87-122 Conditional Use Permit for Special Easement
Sign; and
WHEREAS, the Applicant appealed the Planning Commission action
approving PA 87-122 Conditional Use Permit and Site Development Review; and
WHEREAS, the City Council held a public hearing on the Appeal on
November 14, 1988; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the City Council heard and considered all reports,
recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT'RESOLVED THAT THE Dublin City Council does
hereby find:
a. The use as proposed is required by the public need in that the proposed
signs provide business identification for businesses which may not have
direct access on a public street.
b. The proposed use would be properly related to other land uses and
transportation and service facilities in the vicinity, in that the sign
will comply with all applicable zoning regulations.
C. The use, if permitted under all circumstances and conditions of this
particular case, will not materially affect adversely the health or
safety of persons residing or working in the vicinity, or be materially
detrimental to the public welfare, or injurious to property or
improvements in the area, as the sign does comply with and meet the
intent of the Sign Ordinance to promote uniformity of signage.
d. The use will not be contrary to the specific intent clause or performance
standards established for the district in which it is to be located, in
that the sign complys with the sign regulations and promotes uniformity
and orderly development, which is a primary intent of the City's Sign
Ordinance.
BE IT FURTHER RESOLVED that the Dublin City Council does hereby
conditionally approve PA 87-122 Hucke Signs Conditional Use Permit for a
Special Easement C-2-B-40 Directory Sign subject to the following Conditions of
Approval and Conditions of Approval for the related Site Development Review
request:
Unless otherwise stated, all Conditions of Approval shall be complied with
prior to the establishment of the use of the property and shall be subject to
Planning Department review and approval.
1) The Applicant shall provide verification to the satisfaction of the
City Attorney, City Engineer and Planning Director that the parcels as shown on
- -� the assessor parcel map are legally subdivided parcels or submit an application
for Tentative Map in compliance with City Subdivision Regulations within 90
days and receive Final Map approval within 6 months; or process a lot line
adjustment within 90 days.
2) The Applicant shall comply with all applicable Conditions of Approal
for the related Site Development Review application for the C-2-B-40 Directory
Signs- including but not limited to sign location, dimension and sign copy

AND SIGN PROGRAM FOR WALL SIGNS AT 7016 - 7150 VILLAGE PARKWAY
WHEREAS, Dod Hucke, the property o,mer and Applicant filed an
application for Site Development Review for two C-2-B-40 Directory Signs and
Sign Program for Wall Signs and a Conditional Use Permit to allow a Special
Easement Sign at 7016-7150 Village Parkway; and
WHEREAS, the request is categorically exempt in accordance with the
provisions of the California Environmental Quality Act; and
WHEREAS, notice of Public Hearing was given in accordance with
California State Law; and
WHEREAS, a Staff analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning- Commission held'-a public hearing on April 18,
!� 1988, and May 2, 1988, to consider all reports, recommendations, and testimony;
and
WHEREAS, on May 2, 1988 the Planning Commission approved PA 87-122
Hucke Signs Site Development Review and Conditional Use Permit; and
WHEREAS, the Applicant appealed the Planning Commission action
approving PA 87-122 Conditional Use Permit and Site Development Review; and
WHEREAS, the City Council held a public hearing on the appeal on
November 14, 1988; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the City Council heard and considered all reports
recommendations and testimony hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does
hereby find that:
A. All provisions of Section 8-95.0 through 8-95.8, Site Development Review,
of the Zoning Ordinance are complied with.
B. Consistent with Section 8-95.0 this application, as modified by the
Conditions of Approval, will promote orderly, attractive and harmonious
development, recognize environmental limitations on development;
stabilize land values and investments; and promote the general welfare by
preventing establishment of signs having qualities which would not meet
the specific intent clauses or performance standards set forth in the
Zoning Ordinance and which are not consistent with their environmental
setting.
C. The approval of the appl?cation as conditioned is in the best interests
of the public health, safety and general welfare.
D. General site considerations, including site layout, vehicular access,
circulation and parking, setbacks, height, public safety and similar
elements have been designed to provide a desirable environment for the
development.
E. General architectural considerations , including the character, scale and
quality of the design, building materials and colors, and similar
elements have been incorporated into the project in order to insure
compatibility of this development with its design concept and the
character of adjacent buildings and uses.
F. The project is consistent with the policies in the General Plan and the "
Dublin Downtown Specific Plan.
BE IT FURTHER RESOLVED that the City Council does hereby
conditionally approve PA 87-122 Hucke Site Development Review as shown by
materials labeled "Exhibit A" on file with the Dublin Planning Department
subject to the approval df the related Conditonal Use Permit and to the
following Conditions:
CONDITIONS OF APPROVAL
Unless otherwise stated, all Conditions of Approval shall be complied with
prior to the issuance of building permits and establishment of use, and shall
be subject to Planning Department review and approval.
1) Wall Signs on the site shall conform to the sign program prepared by
Staff dated April 14, 1988 labeled Exhibit"A" Figure 1 on file with the Dublin
Planning Department and shall conform with the Conditions of Approval.
2) The approved sign program shall regulate the letter height, sign
-� length, sign area, copy restriction, location, compliance and approval of wall
signs. Sign provisions not specifically provided for in the sign program shall
be regulated by the City's Sign Ordinance.
3) This approval shall supercede all previously approved sign programs
for the site.
r -4) This approval is for one C-2-B-40 Directory Sign per legally
subdivided parcel.
5) C-2-B-40 Directory Signs shall not be. located within the public
right-of-way.
6) C-2-B-40 Directory Signs shall provide business identification for
businesses located on the parcel on which the sign is located.
7) C-2-B-40 Directory Signs shall be single faced, situated
perpendicular to Village Parkway. The sign copy shall face south bound traffic
and may include the address range on the back face of" the sign.
8) C-2-B-40 Directory Signs shall maintain a minimum sight distance

9) Prior to the installation of any C-2-B-40 Directory Sign the
applicant shall submit an accurrately drawn and dimensioned site plan depicting
the location of the Directory Signs. The Plan shall include dimensioned
setback from the public right-of-way and driveway entrances.
10) Prior to the `installation of any C-2-B-40 Directory Sign and within
45 days from the effective date of this approval, the Applicant shall modify
the southern most driveway on site to allow "enter only" subject to compliance
with the memo and Figure prepared by TJYM dated received November 7, 198S and
subject to review and approvallof the Planning Director and City Engineer.
11) The Applicant shall provide each existing and all new tenants with a
copy of the approved sign program and Conditions of Approval for the property.
12) The Applicant shall revise the proposed C-2-B-40 directory sign to:
A) increase the total sign area to maximize the sign area for tenant
identification. Total sign area for the single faced sign shall
not exceed 32 square feet;

top or bottom of the sign. Panels reserved for tenant

WHEREAS, Don Hucke, the property owner and Applicant filed an
application for Site Development Review for two C-2-B-40 Directory Signs and
Sign Program for Wall Signs and a Conditional Use Permit to allow a Special
Easement Sign at 7016-7150-Village Parkway; and
WHEREAS, the request is categorically exempt in accordance with the
provisions of the California Environmental Quality Act; and.
WHEREAS, notice of Public Hearing was given in accordance with
California State Law; and
WHEREAS, a Staff analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a public hearing on April 18,
1988, and May 2, 1988, to consider all reports, recommendations, and testimony;
and
NOW,- THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
A. All provisions of Section 8-95.0 through 8-95.8,Site Development Review,
of the Zoning Ordinance are complied with. J.
B. Consistent with Section 8-95.0 this application, as modified by the
Conditions of Approval, will promote orderly, attractive and harmonious
development, recognize environmental limitations on development;
stabilize land values and investments; and promote the general welfare by
preventing establishment of signs having qualities which would not meet
the specific intent clauses or performance standards set forth in the
Zoning Ordinance and which are not consistent with their environmental
setting.
C. The approval of the application 'as conditioned is in the best interests
of the public health, safety and general welfare.
D. General site considerations, including site layout, vehicular access,
circulation and parkin„ setbacks, height, public safety and similar
elements have been designed to provide a desirable environment for the
development.
E. General architectural considerations, includir.g the character, scale and
quality of the design, building materials and colors, and similar
elements have been incgjporated into the project in order to insure
compatibility of this development with its design concept and the
character of adjacent buildings and uses.

Dublin Downtown Specific Plan.

CONDITIONS OF APPROVAL
Unless otherwise stated, all Conditions of Approval shall be complied with
prior to the issuance of building permits and establishment of use, and shall
be subject to Planning Department review and approval;_::_ ; -
1) Wall Signs on the site shall conform to the sign program prepared by
Staff dated April 14, 1988 labeled Exhibit"A" Figure 1 on file with the Dublin
Planning Department and shall conform with the Conditions of Approval,
2) The approved sign program shall regulate the letter height, sign
length, sign area, copy restriction, location, compliance and approval of wall
signs. Sign provisions not specifically provided for in the sign program shall
be regulated by the City's Sign Ordinance.
3) This approval shall supercede all previously approved sign programs
for the site.
4) This approval is for one C-2-B-40 Directory Sign per legally
subdivided parcel.
5) C-2-B-40 Directory Signs shall not be located within the public
right-of-way.
6) C-2-B-40 Directory Signs shall provide business identification for
businesses located on the parcel on which the sign is located.
7) C-2-B-40 Directory Signs shall,be single faced, situated
perpendicular to Village Parkway on the south side of the adjacent driveway:
The sign copy shall face south bound traffic and may include the address range
on the back face -of the sign.

8) C-2-B-40 Directory Signs shall maintain a minimum sight distance
setback from the edge of driveway and public sidewalk intersection subject to
review and approval of the City Engineer and Planning Director.

NOW, THEREFORE, BE IT RESOLVED THAT TEE Dublin Planning Commission
does hereby find:
a. The use as proposed is required by the public reed in that the proposed
signs provide business identification for businesses which may not have
direct access on a public street.
b. The proposed use would be properly related to other land uses and
transportation and service facilities in the vicinity, in that the sign
will comply with all applicable zoning regulations.
C. The use, if permitted under all circumstances and conditions of this
particular case, will not,materially affect adversely the health or
safety of persons residing or working in the vicinity, or be materially
detrimental to the publik welfare, or injurious to property or

Rod Barger stated that the Applicant sent a letter to the Planning Department
stating that they were withdrawing their application for a Variance for four
subdivision sale/lease/rent signs and that they would comply with the
standards of the sign resolutions. There was nothing further to be done on
this project.

Ms. O'Halloran stated that the Applicant is requesting approval of a
Conditional Use Permit (CUP) and Site Development Review (SDR) for signs for
the businesses located at 7016-7150 Village Parkway. This application
consists of two parts: SDR/CUP for special easement signs and SDR for a sign
program for identification wall signs which exceed the ordinance's
restrictions.

Ms. O'Halloran stated that the Zoning Investigator notified the property
owners and tenants of illegal signs, which included wall signs, freestanding,
and A-frame signs. The latter two have been removed. The wall signs are
pending approval of the sign program.
Ms. O'Halloran stated that the site layout has caused signage difficulty for
the businesses and tenants located in the rear of the complex. The Applicant
wishes to locate one directory sign at 7124-7150 Village Parkway and another
directory- in the planter area in front of Wolds House of Hobbies. The
Applicant wants a single faced directory sign parallel to the front property
line with a maximum sign heip t of 6' and a maximum sign area of 16 square
feet.

Ms. O'Halloran stated that in order for the property owner to receive approval
of a special easement sign, the property can not have direct access or
frontage on a publicly improved street and must be interconnected with a
traversable non-revocable, non-exclusive recorded access easement. She
further explained that the lots may not be legally subdivided lots in
particular APN 941-210-5-5 which was recorded in 1982 after the City had
incorporated. She noted -the City had no record of an approved parcel map
creating that lot. Ms. O'Halloran stated the draft resolution of approval
includes 1) a requirement for verification of a legal subdivision, 2) locating
the directory signs perpendicular to the village parkway facing south bound
traffic and 3) that the sign area be increased to maximize the sign area for
tenant identification. She also stated a condition was included requiring the
Applicant to redesignate the southern driveway as an enter only driveway to
facilitate parking and circulation for the property. Ms. O'Halloran stated
the City has received a number of complaints from tenants on the adjacent
property stating customers for the Hucke buildings are parking in their
parking spaces not the Hucke property parking lot.
Ms. O'Halloran indicated the Applicant was requesting approval of a Sign
-- _� Program for all the wall signs as they currently exist. Since that proposal
did not establish uniform or compatible signs for the site, Staff prepared a
Sign Program Exhibit A which includes restriction on the sign area, location,
height and length.
Ms. O'Halloran stated that the Staff proposed Sign Program permits larger
signs and smaller signs from some of the existing signs on the site. She also
indicated that signs which are nonconforming as a result of this program would
not have to comply until such time as the tenants request new signs. However,
illegal signs must comply within sixty (60) days.
Ms. O'Halloran noted Staff recommends approval of the two Draft Resolutions of
approval for PA 87-122.
Cm. Burnham advised he had concerns and questions regarding the southern
driveway. He asked if the one-way driveway could be a two-way driveway.
Ms. O'Halloran indicated that because the driveway is only 18 feet wide, it
could only be one way.
Don Hucke, Applicant, passed out information entitled "Remarks Concerning CUP
PA87-122, Hucke Signs prepared for the Planning Commission meeting, May 2,
1988.
The Applicant stated that what he believed to be a very simple application was
turning into a long drawn out situation which seemed unnecessary.
The Applicant stated that all he wanted to do was to put two directory signs
up so the tenants in the rear of complex would be able to reach customers.
The Applicant described the problems that have arisen since first submitting
his application. He described the ownership of the parcels noting the parcels
are owned by him, his wife and his daughter. The Applicant stated that there
was no subdivision plan ever dfveloped for the parcel transfer which was
deeded to Kathryn F. Hucke. Her continued to describe the question of legality
of a directory sign on Lot 3.

The Applicant suggested using a sign 4'x5' , parallel to the street. He also
recommended the removal of a small tree and the moving of the traffic sign for
his sign location. He states that any other location would be impractical and
would reduce the number of parking spaces in the complex.
Don Hucke stated that he and the tenants prefer sign "A" to be placed on the
north side of the big center drive, in front of Wold's Hobbies. He would like
this sign to have the same design as the directory at 6591 Sierra Lane.
The Applicant indicated he was speaking for all the tenants in opposing the
change of the far south driveway from an exit to an entrance only.
Don Hucke commented on items 1-15 in the resolution for special easement
directory signs.
Cm. Burnham asked Mr. Hucke if the north entrance driveway should be one or
two-way access. Mr. Hucke indicated that this was not his driveway since it
was not on his property.
-y --` Ken Begun, 2284 Lakewood Place, Martinez, CA 94553, stated parking has been a
problem for the adjacent property as customers parking at Box World use his
parking spaces. Mr. Begun suggested that an enter/exit driveway should solve
the parking problem.
Jack Keets, 4689 Jefferson Court Place, Pleasanton, CA 94566, indicated he was
apposed to the -driveway change and stated that sign painting and building
painting was expensive and requested the Commission consider this in their
action.
Kathy Lee, 1893 Spruce, Dublin, CA 94568, owner of Amador Ceramics, commented
on her business not doing well and stated that the directory signs are needed
to help direct customers to her.
The Applicant pointed out that the sales revenue for the tenants on this site
is 5 to 7 million dollars a year and this contributes to City taxes
significantly.
Cm. Barnes asks, if there were any more comments. There being none the Public
Hearing was closed.
Cm. Tempel suggested having lettering on both sides of the directory signs.
Ms. O'Halloran commented that if lettering is on both sides, the letter size
would be reduced. One single sided sign would provide larger lettering and
tenant identification.
The Planning Commission discussed the merits of a single faced sign as opposed
to a double faced sign.
Cm. Tempel noted a double faced,sign was appropriate.
C. Burnham commented that address size are critical and may interfere with the

The Planning Commission -discussed the issue of the south driveway with the
concensus being that issue of exit and entrance should be reviewed.
Ms. O'Halloran stated the police department has reviewed the southern driveway
proposal and does not have a problem with Staff's recommendation.
Cm. Burnham saw no problem with all driveways being exit/entrance; however, he
asked if there were any legal problems with that.
Ms. O'Halloran suggested that Condition #10 of the Resolution could be
modified to have an ingress/egress subject to review and approval of the
} Traffic Engineer and Planning Director.
s Cm. Burnham asked if Staff has comments on Hucke's request and/or documents.
Ms. O'Halloran noted that a parcel map must be processed to subdivide parcels
=: :_— and that the Applicant must verify the subdivision was legally created.
Cm. Burnham asked if the tenants and property owner have been sent letters
concerning illegal and nonconforming signs.

Ms. O'Halloran indicated the letters were sent out, however, enforcement of
illegal wall signs has been postponed pending action on the Sign Program. She
nat.ed that the Staff proposed Sign Program allowed the wall .signs to exceed
the height and length restrictions and allows the sign area to be increased to
the maximum permitted under the Site Development Reft-ew process (10% of
primary frontage and 7.5% of secondary frontage).
Cm. Burnham asked if each tenant has own marked parking spaces.
Ms. O'Halloran stated that the Site Plan approved by the county did not
designate parking to specific tenants. She noted required parking is based
upon the use of the building and designating parking is up to the property
owner.

properties located on major arterial streets such as Village Parkway or Dublin
Boulevard should be single faced signs situated perpendicular to the street.
She further stated that if the Commission did not want to restrict the signage

which should be considered when taking action on a Site Development Review
application for freestanding Directory Signs.

I am herewith appealing the letter dated May 4 , 1988 regarding the

for Directory Signs on my , Mrs. Hucke 's and Mrs. Sutton's property

_ The Conditions of Approval are such that- under them it is almost

SUBJECT: 7016-7150 Village Parkway Southern Exit Only Driveway
_ This memo presents our recommendations for modifying the direction of the
-' southernmost driveway serving the Hucke property located at 7016-7150 Village
E
fParkway.
i The southernmost driveway would serve the property better and .would have less
impact on the neighboring property if it could accommodate only entering vehicles.
Southbound drivers on Village Parkway who are uncertain of a business' location
on-the Hucke Property would still have an opportunity to turn into the site at the
southernmost driveway if they missed the two previous driveways. However, there
is insufficient width for this existing driveway to accommodate both entering and
exiting vehicles. Therefore, it is recommended that this driveway be converted
from an exit-only driveway to an entrance only driveway. This change will also
help to better utilize the existing on-site parking at the front of 7022 Village
Parkway.
Along with the conversion from an exit only to an entrance only driveway, some
on-site signing and pavement legends are recommended to reduce any potential
confusion stemming from the change in the driveway's direction. The additional
pavement markings are primarily directional arrows as well as a "STOP" legend for
southbound on-site traffic. This "STOP" sign is to prevent broadside collisions
between vehicle entering the site via the driveway and on-site vehicles travelling
southbound in the aisle. In addition, two pavement legends direct on-site vehicles
away from the driveway in question to the remaining two exits. A "DO NOT
ENTER"legend is recommended to inform on-site vehicles that the drivewav is
one-way only. These additional recommendations are depicted on the attached
Figure 1.

All of these buildings except Building too. E on Lot 2 were
originally designed for light industrial ::,ack in t := 1550's. Thus
they all had big truck high roll steel doers 12' x 14 ' . The rear
buildings still have these doors while the front buildings have
been filled in ,,ith glass but still retair. .the 14 ft. high
over_incs . This just naturally puts the s cas on all cf the
buildings hic`,er than the 14 ft. limit.

will "take a chance" - ;_t is much bettar. You might ask the
tenants from EOx World or John's Transmission who see the traffic
picture every day . -

Located between I-520 and the proposed Dublin "Restaurant
Row" this zone will be encouraged over time to increase
its pedestrian orientation for restaurant, specialty
retail and entertainment uses.
Zone 9 : Amador Valley Boulevard Cc=ercial
Strategically---situated in a good location relative to
traffic access within the downtown area, this zone will
be encouraged to intensify its development in the future.
A mix of uses with some two or three. story structures is
desired. Design cohesiveness amonc* portions of the area
will be strongly encouraged. Proposals providing direct
access to San Ramon Road will be- considered.
Zone 10 : Villace Parkway Mixed Use
Currently occupied by a wide mix of commercial uses, this
zone will continue to serve a variety of needs in the
future. Visual landscape and building design improvements
will be soueht to compliment the city's substantial
investment in public improvements along Village -Parkway.
Zone 11 Retail/Office.
Located on two streets which serve 1� e nearby residential

transit facility. The need to accommodate these
potentials in the future combined with the property' s
current relative isolation from Dublin Boulevard requires
a different set of development standards than would be
desirable for a future commercial mixed' use project
related to a ��egional transit facility. Interim
standards should:
a) prohibit development which would preclude the
economical development of transit parking.
b) Require recognition that the property is highly
visible from Interstate 580 and does much to
establish the image of Downtown Dublin.
C) Allow for a new street connecting Regional Street
and Golden Gate Drive.
d) Recognize the limited retail potential of the
- : property until --roadway and transit improvements are
implemented.
e) Require an overall master plan emphasizing a mix of
commercial uses for long term change for the area
=prior to the approval of any additional structures
or uses.
Interim Use Zone B:
CurrenC industrial occupied largely by older type
structures, this area is in marked contrast to other
development in the downtown area. While the area will
eventually change, current ownerships patterns and the
relatively sound condition of the structures suggest that
some time may pass before substantial change will occur.
Interim standards are needed to improve the apc_ earance of
this area and should:
a) Require substantial additional landscaping along
the Village Parkway frontage as a condition of any
future property improvements.
b) Encourage improvements to the visual character of
existing structures.
C) Encourage additional landscape improvements to all
parking areas.
Interim Use Zone C:
Auto dealership= uses contained in this zone are felt to
be an asset to Downtown Dublin and will be encouraged to
remain. However; it is realized that in the longer term,
increased land values may eventually:;precipitate a change
in land use. Development standards for this zone will be
