HomeMy WebLinkAbout4.05 Accept Improvements Village I t' CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: February 13, 1989 SUBJECT: Tract 5826 (Village I - Cross Creek) Acceptance of Improvements (Report by: Public Works Director Lee Thompson) EXHIBITS ATTACHED: 1) Resolution Accepting Improvements 2) Location Map RECOMMENDATION: OKAdopt Resolution Accepting Improvements in Tract 5826 FINANCIAL STATE?•LENT: City will incur landscaping maintenance costs for landscaping along Amador Valley Boulevard and Dougherty Road, which will be paid for through the Tract 5511 Maintenance Assessment District DESCRIPTION: In November of 1987, the City of Dublin approved the developer agreement for Tract 5826, "Cross Creek" (Village I of the Villages at Willow Cree':) . This Village is a 56 apartment/condominium development located at the southwest corner of Amador Valley Boulevard and Dougherty Road. Public improvements within Tract 5826, which consist of landscapinc* along Amador Valley Boulevard and Dougherty Road and the concrete sourd%,,-all along the Dougherty Road frontage, have been completed in accordance wit-T, thy_ approved plans and specifications and to the satisfaction of the City Engineer. The interior private streets, curbs, sidewalks, and drainage facilities have also been completely constructed. Staff recommends that the City Council adopt the Resolution accepting improvements in Tract 5826. - ------- --------- - -- ----- -- -- -- -------------------------- -------- ----------- ITEM NO.A10 COPIES TO: Rafanelli & Nahas RESOLUTION NO. -89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- FOR THE ACCEPTANCE OF IMPROVEMENTS TRACT 5826 (VILLAGE I - CROSS CREEK) WHEREAS, the owner-subdivider of the aforesaid Tract previously entered into a contract with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: a) Subdivider: Rafanelli and Nahas b) Tract Location: Southwest quadrant; Amador Valley Boulevard and Dougherty Road c) Tract Size: 56 apartment/condominium units d) Resolution Approving Final Map: No. 93-87 e) City Streets Affected: None (private streets) WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, the subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as the improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract be, and they are hereby approved and accepted subject to the aforesaid one-year guarantee; and 2. The aforesaid original performance bond security requirement be reduced from the amount of $217,204 to a revised security requirement in the amount of $54,301, upon acceptance by Staff of the replacement maintenance bond in the said amount of $54,301 as security for the aforesaid one-year guarantee period, and the Mayor of this City Council be, and he is hereby authorized and directed to execute the said bond on behalf of the said City of Dublin; and 3. The said original performance bond in the amount of $217,204 posted in connection with the work involved in the construction of said Tract be hereby released upon acceptance of said maintenance bond. 8 1'A ' t i - i.r ..,• i L s.
