AYES: NOES: ABSENT: Mayor ATTEST: City Clerk AGREEMENT REGARDING IMPLEMENTATION OF NONPOINT SOURCE CONTROL EVALUATION PROGRAM Alameda County Flood. Control and Water Conservation District, a local public agency of the State of California: City of Alameda, a municipality of the State of California; City of Albany, a municipality of the State of California; City of Berkeley, a municipality of the State of California; City of Dublin, a municipality of the State of California; City of Livermore, a municipality of the State of California; City of Piedmont, a municipality of the State of California; City of Pleasanton, a municipality of the State of CaiifUrrrid; AGREE this day of 1988, as follows: RECITALS: A. The San Francisco Bay Regional Water Quality Control Board, having accepted a nonpoint source control evaluation plan from Alameda County, requires that local agencies in the County of Alameda, including the parties to this agreement, shall implement and complete the evaluation plan by June 30, 1991. B. This agreement will provide for the allocation of responsibility for the work and for distribution of the costs allocated to the seven cities not in an Alameda County Flood Control Zone where benefit assessment fees are paid. AGREEMENT: 1 . In accordance with the Water Quality Control Plan for the San Francisco Bay Basin (Basin Plan) , the Alameda County Flood Control and Water Conservation District (hereinafter District) is assuming a sig- nificant coordination role in the implementation of this program and shall undertake to secure the services of a consultant in accordance with _....._Dist.r. ict procedures..on se_tecti_on_of,__p.r.-o.f.e..s.s.ion.al..-c.o.nsult_ants ... .._Th �. _. .. . District ' s contract with the consultant will contain a hold harmless and indemnity provision for the benefit of all parties to this agreement. - 1 - 2. A Task Force consisting of representatives of agencies specified in "Exhibit A" hereto, so marked and made a part hereof, shall oversee and direct the preparation by the consultant so engaged of the proposal men- - tioned in Recital A above. 3. The parties shall share* in meeting the costs of the proposal in the proportions stated in the schedule thereof marked "Exhibit B" attached hereto and made a part thereof. The indicated amounts are based on popula- tion and area of the respective jurisdictions and the sampling density for the Alameda Creek and the Bay Plains drainage areas. 4. The total costs to be so apportioned shall not exceed $1,370,000. 5. This agreement shall be effective upon the execution by the Alameda County Board of Supervisors. 6. County will invoice each city in March of each year. Any adjust- ments in total costs will be made in final March invoice. 7. There are seven cities within Alameda County where flood control benefit assessment fees are collected. Their costs will be paid from the appropriate flood control zone benefit assessment reserves.
