FINANCIAL STATEMENT: None DESCRIPTION: This item was considered before the Council at its March 13, 1989 meeting. During this meeting several business owners expressed concerns regarding the Applicant's proposed, and Planning Commission approved, donation station location along the shopping center' s easterly property line. The Council continued consideration of this item and directed Staff, the Applicant and business owners to meet to further review other on-site alternative locations, especially on the north side of the site and on the south side of the Goodwill building. ------------------------------------------------------------------------------ COPIES TO: Applicant Owner ITEM NO. J�• PA 88-150 -1- Staff did meet with the Applicant and a majority of the business owners who attended the previous Council meeting and expressed concerns. Reviewed were three potential locational areas. A site to the south side of the Goodwill building, the Applicant's original proposed site, and a site on the north side. Staff has prepared a summary of the key concerns expressed with each location. Other concerns not listed were discussed but not determined to be significant or result in a detrimental impact to nearby businesses. Consideration of .a location on this site would require a separate application and hearing process as it is a separate legal parcel and not a part of the subject site parcel. Additionally, the Applicant indicated this location had •been discussed with the property owner who had indicated they would not authorize a location in the front. Shopping center business owners also expressed concerns over the trailer in this location that it would be highly visible from the main thoroughfare. Given the initial conclusion of this site, further consideration was eliminated and analysis centered on the two remaining options - the Applicant's original location and a site on the northern portion. The Applicant' s original location which received Commission approval has a minimal impact to nearby -apartment residents across Star;aard"Drive, however, had several key concerns identified. Major concerns seemed to be visual impact, security, and parking impacts to the nearby businesses. Although not the preferred alternative of the businesses, several potential mitigation measures were discussed that could lessen the impacts the operation could have on the nearby businesses. These mitigation measures involve requiring the Applicant to install a fence along a portion of the easterly property line to create a visual barrier and to contain discarded items outside of the trailer on-site; install three parking spaces for those utilized for the trailer; and have the Applicant participate with other businesses in having an on-site after hours security guard. Even with these potential mitigation measures business owners expressed concerns that the added parking would be farther away from their place of business, therefore inconvenient for customers and employees and that the property line fence might be minimally effective as the trailer would be 13' tall where a fence is 6- 8' tall. A site along the northern portion of the property was the most preferred by the business owners. The Applicant had indicated that the property owner would be agreeable to a site in this area. Concerns identified for this alternative were visual impact, security and parking. The trailer would be more visible to the apartment area across Starward and visual impact to the Koto Restaurant which has windows on the north side of the building. Potential mitigation measures were discussed. Suggested was requiring screening plants/trees to be installed in the planter area along Starward and having the trailer located as close to the driveway as would be safe for traffic circulation so not to be in the restaurant window view area. Security concerns were minimized as the site would have lighting from on-site building lights as well as from street lights which are located along Starward near the trailer site. Additionally, the trailer would be more visible to Starward where police patrol cars could easily observe and monitor the site. After analyzing the options above, Staff has prepared two draft resolutions; one for the alternative north side and one for the original easterly site for Council consideration. RESOLUTION NO. - 89 Jr J A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ------------------------------------------------------------------------------ MODIFYING THE PLANNING COMMISSION ACTION APPROVING PA 88-150 GOODWILL INDUSTRIES DONATION STATION CONDITIONAL USE PERMIT FOR A 25 FOOT LONG TRUCK TRAILER LOCATED IN THE SHAMROCK VILLAGE SHOPPING CENTER PARKING LOT ALONG THE NORTH .SIDE NEAR GOODWILL STORE, 7767 AMADOR VALLEY BOULEVARD WHEREAS, Sonny Escudero, representing Goodwill Industries, filed an application for a Conditional Use Permit to locate a 25 foot long truck trailer for a Donation Station in the Shamrock Village Shopping Center near Goodwill store, 7767 Amador Valley Bouleard. WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the Planning Commission held a public hearing on said application on February 6, 1989; and WHEREAS, the request is categorically exempt in accordance with the provisions of California Environmental Quality Act; and WHEREAS, a Staff Report was submitted recommending the application be conditionally approved; and WHEREAS, the Planning Commission heard and considered all said reports, recommendations and testimony hereinabove set forth; WHEREAS; on February 6,, 1989, the Planning Commission adopted Resolution No. 89-003, approving PA 88-150 Conditional Use Permit for a donation station trailer; and WHEREAS, the Applicant appealed the Planning Commission action approving PA 88-150 Conditional Use Permit; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the City Council held a public hearing on the Appeal on March 13, 1989; and continued the public hearing to March 27, 1989; and WHEREAS, the City Council heard and considered all reports, recommendations and testimony hereinabove set forth. -1- EAN �'• 5�� dVie. % -6 E, v .......... 7" 14. g T & i'r rY T21 NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby find: a. The use is required by the public need in that it provides a location� for the general public to drop off reuseable items. b. The use would be properly related to other land uses and transportation and service facilities in the vicinity. C. The use, if permitted under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare, or injurious to property or improvements in the area, as all applicable regulations will be met. d. The use will not be contrary to the specific intent clause or performance standards of the General Plan and zoning established for the district in which it is to be located in :that conditions have been applied to insure conformance with the zoning regulations. BE IT FURTHER RESOLVED THAT THE Dublin City Council does hereby approve said application as shown on attached Exhibit B-1 subject to the following conditions: CONDITIONS OF APPROVAL Unless stated otherwise, all Conditions of Approval shall be complied with prior to issuance of building permits or establishment of proposed land use activity and shall be subject to Planning Department review and approval. 1. The Donation Station truck trailer shall be located in the Shamrock Village parking lot areas near the Goodwill store and the Medical Center building, as generally depicted in Exhibit B-1. 2. The Donation Station shall not interfere with or obstruct vehicular access or movement within the parking lot. 3. Hours of operation shall be from 10 a.m. to 5:30 p.m. , 7 days a week. After hours, the trailer shall be locked and secured. 4. Parking lot and building lighting shall be maintained and operational during non-daylight hours. 5. The Applicant, Goodwill Industries, shall be responsible for maintaining the Donation Station and parking lot surrounding the truck trailer in a clean and orderly manner. No items shall be left at the truck trailer for more than 24 hours at a time. 6. The Applicant shall provide on-site signage indicating hours of operation drop-off instructions for after hours and a telephone number for use in case of emergency. Said signage shall be limited to two signs each a maximum of 8 square feet of area. A minimum of three (3) additional parking spaces shall be added at the northeast portion of the site to offset that which is occupied by the donation trailer operation. Plans shall be submitted to the Planning Department for review and approval prior to installing. 8. Additional 15 gallon screening trees shall be installed in front of the trailer location within the planter area along Starward Drive to soften visual impact. 9. The trailer shall be•located in close proximity to the street light along Starward Drive and as close as is possible toward the driveway at the northeastern portion of the site. 10. The Applicant shall install a 6' tall vinyl clad chain link fence to screen the bottom of the trailer and contain after hours items discarded on-site. Plans shall be submitted to City Planning Department for final review and approval prior to installation. 11. This permit shall expire on March 26, 1990 and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. The Donation Station truck trailer shall be located in the Shamrock Village parking lot areas near the Goodwill store and the Medical Center building, as generally depicted in Exhibit B-2. 2. The Donation Station shall not interfere with or obstruct vehicular access or movement within the parking lot. 3. Hours of operation shall be from 10 a^m. to 5:30 p.m. , 7 days a week. After hours, the trailer shall be locked and secured. 4^ Parking lot and building lighting shall be maintained and operational during non-daylight hours. I� 5. On February'6, 1989 the Planning Commission considered and approved the Conditional Use Permit application for the truck trailer donation station, subject to conditions of approval (see Attachment 1 and 2) . On February 16, 1989, the City received three separate letters of appeal regarding the Planning Commission's action from nearby business owners/ operators (two additional letters of appeal were received after the appeal period closed, see Attachment 3) . : Analysis The Applicant's requested approval of a Conditional Use Permit would allow a Goodwill Donation Station to occupy four parking spaces in the easterly portion of the Shamrock Village Shopping Center parking lot (see Exhibit B) . The donation station consists of a self-contained blue and white truck trailer standing 13 feet in height, with a length of 25 feet and a width of 8 feet (see Exhibit C) . The City Zoning Ordinance does not list a specific category for this use; however the use is considered similar to a recycling center. If the station is placed in the proposed location, it's visual pollution will be less than 10 feet from where it can adversely affect many of the citizens of Dublin vino receive their health care at ?=ador Valley Medical Clinic. For all the planning, and good intent, these donation stations often look like garbage tr rr - dumps because of after hours cerations �.°n:cz e_ten don't disappear inc, but have to be cleaned up during the cour immediately in the morn se ll of of the day. While the workers try their best, often times, not a the clean up is done in a tir fashion. i Dr. Davis and I are, currently, the only two physicians in the city of Dublin, and both of us have our practice at Amador Valley nedical Clinic. The people of Dublin who use our facility are ill and need to receive as much environmental consideration as possible. If they experience a clean, attractive environment when they come to the clinic, then the healing process provided by the clinic is enhanced. on the other h-ad •the thought of. having to face an unsightly donation station may even make a patient delay in seeking necessary medical attention. From October 1988 through January 1989 in conjunction with issuance of City building permits, interior and minor exterior alterations were made on an existing, 5679 square foot vacant commercial space within the easterly portion of the Shamrock Village Shopping Center to allay for the operation of a Goodwill Industries Store Retail Outlet. I In January 1989, the Applicant filed an application for a use permit request (PA 88-150) to consider a 25 foot long truck trailer donation station within the easterly portion of the parking lot of Shamrock Village Shopping Center. On February 6, 1989 the Planning Commission considered and approved the Conditional Use Permit application for the truck trailer donation station, subject' to conditions of approval (see Attachment 1 and 2). On February 16, 1989, the City received three separate letters of appeal regarding the Planning Commission's action from nearby business owners/ i operators (two additional letters of appeal were received after the appeal period closed, see Attachment 3). Analysis ' The Applicant's requested approval of a Conditional Use Permit would allow a Goodwill Donation Station to occupy four parking spaces in the easterly portion of the Shamrock Village Shopping Center parking lot (see Exhibit B) . The donation station consists of a self-contained blue and white truck trailer standing 13 feet in height, with a length, of 25 feet and a width of 8 feet (see Exhibit Q . The City Zoning Ordinance does not list a specific category for this use; however.the use is considered similar to a recycling center. Section 8- 48.2(g).. Conditional Uses: C-1 Districts allow "rec;:cling centers when operated in conjunction with a permitted use on the same premises" subject to approval of a Conditional Use Permit. t l Goodwill previously operated, with City use pe^_t aooroval, a donation station within the Dublin Plaza Shopping Center n:.a_ uerv;-ns. The appeal letters submitted indicate a concert reza_ding the trailer impact on parking, circulation/access, visual impact (placement) and after-hour donations. Staff has reviewed the Applicant's proposed location. The resultant loss of four parking spaces does not create a problem as the site has sufficient parking to comply with the City's parking require--ents. Three replacement parking spaces could be provided between the light pole and curb, north of t o trailer, to help off-set the loss of parking in tiis immediate area. Access to this portion of the lot is available fret an on-site drive isle directly off Amador Valley Boulevard. The trailer's location would be ; �. situated behind the building line of the medical offices to the east. The existing Goodwill Store to the southwest also obscures views to the rear portion of the lot. i ' A location on the northerly portion would be more visible to the residential i areas across Starward. Additionally, insufficient space exists north of the J lamp post to� accomm6 date the-trailer. A perpendicular Flacement would' result in the trailer projecting into the drive isle creating on-site traffic safety �. problems. A location farther south or in the front portion of the parking lot would be more visible from the public thoroughfare, Amador Valley Boulevard. An alternative location could be on the westerly portion of the site near The Saw Mill store. The Applicant would have to obtain property owner's consent for this area.
