Easements and Accepting Easements 2) Location Map RECOMMENDATION: t `Adopt Resolution FINANCIAL STATEMENT: Maintenance within the easements is paid for by Landscape Maintenance Assessment District 86-1. DESCRIPTION: On September 8, 1986, the City Council approved the Final Map for Tract 5511, accepted the offer of dedication of certain streets within the tract subject , to improvement, and rejected the offer of dedication of certain easements, including landscape maintenance easements (L.M.E. ) and landscape access easements (L.A.E. ) within the Tract. The conditions of approval for Tract 5511 provided that the developer, Rafanelli and Nahas, establish a homeowner's association or initiate formation of a maintenance assessment district for the purpose of maintaining certain roadway landscaping and for cutting firebreaks and providing slope maintenance on the slope behind the houses on Crossridge Road. The City of Dublin Landscape Maintenance Assessment District 86-1 was formed and serves this . purpose. The City Attorney has determined that in order for the City to maintain the areas within the easements, the City must first rescind the rejection and accept the offer to dedication for both the landscape maintenance easements (L.M.E. ) and landscape access easements (L.A.E. ) . Improvements within Villages I, II, and VI have now been accepted, and the maintenance crew must begin to maintain the landscaping within the easement areas, including the cutting of firebreaks on the slope per the Dougherty Regional Fire Authority' s requirement. Staff recommends that the City Council adopt the resolution rescinding the rejection of the landscape maintenance easements and landscape access easements and accepting the easements for the purpose of maintenance and access respectively. ---------------.------------------------------------------------------------- ITEM N0. COPIES TO: Rafanelli & Nahas RESOLUTION NO. -89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- RESCISSION OF REJECTION OF OFFER OF DEDICATION OF LANDSCAPE MAINTENANCE EASEMENTS AND LANDSCAPE ACCESS EASEMENTS WITHIN TRACT 5511 AND ACCEPTANCE OF OFFER OF DEDICATION WHEREAS, by Resolution No. 92-86 adopted September 8, 1986, the City Council of the City of Dublin did reject the offer of dedication of Landscape Maintenance Easements (L.M.E. 's) and Landscape Access Easements (L.A.E. 's) in Tract 5511 shown on that certain map entitled "Tract 5511" filed September 19, 1986, in Book 163 of Maps at Pages 48 throug'a 58 thereof, records of Alameda County, California; and WHEREAS, the hereinafter described Landscape Maintenance Easements and Landscape Access Easements as shown on said map are required for maintenance of certain landscaping improvements and certain slope areas and for access thereto; NOW, THEREFORE, BE IT RESOLVED pursuant to the authority of Section 66477.2(a) of the Government Code of the State of California, that the City Council hereby rescinds the previous rejection of the offer of dedication of those certain Landscape Maintenance Easements and Landscape Access Easements within Tract 5511. BE IT FURTHER RESOLVED that the offer of dedication for maintenance purposes of Landscape Maintenance Easements, and for access purposes, of Landscape Access Easements, made by Rafanelli and Nahas, a California General Partnership, dated August 28, 1986, on the aforesaid map of Tract 5511 be, and the same is hereby accepted as to the hareinabove described portion thereof only; and BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to cause a certified copy of this resolution to be recorded at the office of the Recorder of Alameda County.
