CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: April 10, 1939 SUBJECT: Acceptance of Improvements: Village II "Cotton Wood" of the Villages at Willow Creek (Report by: Public Works Director Lee Thompson) EXHIBITS ATTACHED: 1) Resolution Accepting Improvements 2) Location Map RECOMMENDATION: ?(41) Adopt Resolution to accept the work completed. Authorize Staff to accept maintenance bond at a future date. FINANCIAL STATEMENT: A maintenance bond in the amount of $162,095.25 to guarantee against defects will be provided to the City. Signal maintenance costs will be incurred by the City for the Dougherty Road/Amador Valley Blvd. traffic signal. Landscape and soundwall maintenance costs are paid by Landscape Maintenance Assessment District 86-1. Interior street im•orovements are private and will not be maintained by the City. DESCRIPTION: The Final Map for the Master Tract 5511 was approved by the City Council on September 8, 1986. A separate Tract Developer Agreement was approved for Village II Cotton Wood on July 27, 1987. Improvements constructed under this portion of Tract 5511 include the traffic signal at Dougherty Road and Amador Valley Boulevard, soundwall, landscaping, irrigation, and sidewalk on Dougherty Road and Amador Valley Boulevard, and landscaping along Wildwood Road. The landscaping and soundwall are to be maintained by the City through Assessment District 86-1 monies. Improvements in Village II have been inspected by the City Engineer and determined to be complete. At the time the City and Rafanelli and Nahas executed the contract for the Tract improvements, the subdivider was required to provide a performance bonds in the amount of $648,381.00 to provide the necessary security for the performance of work involved. As the work is now completed, the performance security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code, to an amount necessary to guarantee maintenance of the work for a one-year period following acceptance of the work. The subdivider will provide a maintenance bond in the amount of $162,095.25, which is 25% of said improvement estimate, and which is sufficient to cover the one-year maintenance guarantee period. ---------------------------------------------------------------------------- ITEM NO. rf� % COPIES TO: Rafan-_lli & Nahas e c RESOLUTION N0. -89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- FOR THE ACCEPTANCE OF IMPROVEMENTS, VILLAGE II "COTTON WOOD" (VILLAGES AT WILLOW CREEK) WHEREAS, the owner-subdivider of the aforesaid Tract previously entered into a contract with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: a) Subdivider: Rafanelli and Nahas b) Tract Location: Westerly of Dougherty Road and northerly of Amador Valley Boulevard. c) Tract Size: 248 apartment/condominium units d) Resolution Approving Final Map: No. 92-86 e) City Streets Affected: None WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, the subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance of the work by tae said City of Dublin; and WHEREAS, as the improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Cede of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract be, and they are hereby approved and accepted subject to the aforesaid one-year guarantee; and 2. The aforesaid original performance bond security requirement be reduced from the amount of $648,381.00 to a revised security requirement in the amount of $162,095.25, upon acceptance by Staff of the replacement maintenance bond in the said amount of $162,095.25 as security for the aforesaid one-year guarantee period, and the Mayor of this City Council be, and he is hereby authorized and directed to execute the said bond on behalf of the said City of Dublin; and 3. The said original performance bond in the amount of $648,381,00 posted in connection with the work inyvclved iii the construrtion of said Tract be hereby released upon acceptance of said maintenance bond.
