Actual cost for the maintenance crew to install and remove a banner averages $386.00. The encroachment permit fees proposed for oversized vehicles are $35.00 for one trip or $100.00 for an annual permit. These fees help to defray the cost of processing, as well as wear and tear on City streets. DESCRIPTION: At the March 27th meeting, the City Council discussed the issue of nonprofit groups requesting to use the San Ramon Road banner poles to advertise events held outside of Dublin and directed Staff to prepare resol-.1tions to (1) modify the encroachment permit fee schedule to include a $50.00 fae for banner installation and (2) modify the policy for use of the banner poles so that the event may be held outside Dublin and so that an encroachment fee is applied to all banner permits. The Council also stipulated that then was to be no possibility of appealing for a waiver of the fee. Staff is also proposing a second modification to the encroachment fee schedule in order to simplify the fees for oversized vehicles. The current fee schedule provides that the applicant pay the actual cost of "inspection, " with a minimum charge of $25.00. A number of trucking companies requested the option of taking out an "annual permit" that would allow an unlimited number of trips in order to eliminate the need for paperwork each time. Most other agencies have a provision for annual permits. The fees proposed are $35.00 for one-trip permits and $100.00 for annual permits. These fixed-fee permits are to be issued only for loads that do not require staff time for traffic control or other monitoring. The "actual time" provision remains in the proposed fee schedule, with a deposit amount of $250.00, to take care of situations that do require traffic control or staff inspection time. All transportation permits require an insurance certificate indicating $1,000,000 liability coverage. Staff recommends that the City Council conduct a public hearing, adopt the resolution modifying the fee schedule for encroachment permits, and adopt the resolution modifying the policy for use of the banner poles. -- --------------- ----- ------------------------- ----------- ------------------ ITEM NO._� COPIES TO: RESOLUTION NO. -89 L A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- AMENDING RESOLUTION NO. 96-84 ADOPTING FEES FOR MUNICIPAL SERVICES (MODIFYING EXHIBIT 4 ENCROACHMENT FEES) WHEREAS, Resolution 96-84 establishing fee schedules for City Services was adopted by the City Council on August 27, 1984; and WHEREAS, it is necessary to modify the fee schedule for encroachment permits by adding fees for use of the San Ramon Road banner poles and for oversized vehicles; and WHEREAS, said fees do not exceed the estimated reasonable cost of providing the associated services; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the addition of said items to the fee schedule for encroachment permits, which is attached hereto and shall be considered as _. apart of this Resolution. AYES: NOES: ABSENT: Mayor ATTEST: City Clerk CITY OF DUBLIN Exhibit 4: Encroachment Fees (Revision Adopted 4/24/89) Basic Encroachment Permit Fee: $ 10.00 Oversized Vehicle (Transportation) Permit Fees: (Applies to vehicles of dimensions not requiring lane closures or traffic control - see also Item 5 under Inspection Fees) One trip only $ 35.00 Annual permit $100.00 Fee for Use of San Ramon Road Banner Poles $ 50.00 Inspection Fees as follows ($20.00 minimum) : 1) Transverse and longitudinal trenches, road cuts, and other street excavation work, including surface restoration: 1 linear foot to 500 linear feet $25.00 minimum 500 linear feet to 3,000 linear feet $25.00, plus $0.05 per linear foot in excess of 500 linear feet Over 3,000 linear feet $150.00, plus $0.04 per linear foot in excess of 3,000 linear feet 2) Constructing concrete sidewalk, curb, and gutter: 1 linear foot to 50 linear feet $25.00 minimum Over 50 linear feet $25.00, plus $0.15 per linear foot in excess of 50 linear feet Where both sidewalk and curb & gutter are being constructed, inspection fees will be charged for each item. 3) Constructing concrete driveways $20.00 each 4) Constructing drain inlets, manholes, $20.00 each and connections to same. 5) Oversized vehicles or building moves (of a dimension requiring lane closures, traffic control, or Actual cost - $250.00 deposit other inspection time) required Encroachment Permit Fee Schedule, Page 2 Inspection Fees, continued 6) AC Paving, curb & gutter tie-in, etc. 1 square foot to 500 square feet $20.00 Over 500 square feet $20.00, plus $0.04 per square foot in excess of 500 square feet RESOLUTION NO. -89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- AMENDING RESOLUTION NO. 73-83 POLICY FOR THE INSTALLATION OF ADVERTISING BANNERS WITHIN JUBLIC RIGHTS OF WAY WHEREAS, on December 12, 1983, the City Council of the City of Dublin adopted Resolution No. 73-83 approving a policy for the installation of advertising banners within the public right-of-way; and WHEREAS, the City Council wishes to modify tha policy so that nonprofit groups holding activities outside the City of Dublin which benefit residents of the City of Dublin may apply for a permit to -sse the San Ramon Road Banner Poles; and WHEREAS, the City Council wishes to further modify the policy so that the encroachment permit fee is not waived for any applicant; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby amend Resolution No. 73-83 to provida that nonprofit groups holding events outside the City of Dublin may apply for a permit to use the- San-Ramon---Road Banner Poles, and that the encroachment permit fee for usage of the banner poles shall not be waived, as stated in the revised policy attached hereto as Exhibit A. AYES: NOES: ABSENT: Mayor ATTEST: City Clerk EXHIBIT "A" POLICY OF THE CITY OF DUBLIN REGARDING INSTALLATION OF ADVERTISING BANNERS WITHIN THE PUBLIC RIGHT-OF-WAY INTENT: This policy is to regulate the installation, materials, scheduling, removal, insurance, and other items related to banners placed within the City of Dublin public right-of-way. ELIGIBILITY: Nonprofit organizations advertising activities which benefit City of Dublin residents may apply for a permit to erect a-ad maintain a banner. APPROVING AGENCY: The City Council shall be the approving body, with the Public Works Director issuing an encroachment permit. The banner shall be installed by the City of Dublin maintenance department. FEES: The applicant shall be charged an :encroachment permit fee for usage of the banner poles. There shall be no possibility of waiver of the fee. TIME LIMITS: The application for banner installation shall be submitted not later than one month in advance of the desired installation of the banner, and no sooner than one year in advance of the proposed installation. Any one agency may not erect a banner any more frequently than four times in any one calendar year. No banner, for -any- event,-may be erected for longer than two weeks and no more than one banner erected for any one event. LOCATION: The banner shall be erected and displayed at a Location approved by the City Council. MATERIALS: The banner shall be designed and made by a com-Dany whose business it is to design and construct banners. The design shall b-a sufficient to handle wind loads as specified in the latest adopted Uniform Building Code. INSURANCE: The applicant shall carry liability insurance in an amount not , less than $1,000,000 and shall provide a certificate of insurance which names the City, its agents and employees, as additional insureds- OTHER REQUIREMENTS: The City Council and/or the Public Works Director may impose additional conditions as necessary to control banner installation, maintenance, and removal. The City Council may waive or change any of the guidelines within this policy as conditions may dictate on any installation; except that the encroachment permit fee shall not be waived in any case.
