FINANCIAL STATEMENT: See discussion below. DESCRIPTION: In the process of conducting tasks associated with the East Dublin General Plan Amendment/Specific Plan Studies and EIR, it has been determined (by Staff, Sponsoring Property Owners and the Consultant) that there is a need to carry out additional work that was not included in the work program of the original Agreement between the City and Wallace Roberts & Todd. This additional work focuses on geologic and biologic aspects of the General Plan study and EIR. Staff is asking the Council to provide the go ,:head to enter into the appropriate agreement amendments necessary to carry out these additional tasks . Additional Geotechnical Work The City' s General Plan calls for the avoidance of allowing development on hillsides where slopes are predominateliy 30 percent or more, on lands containing geologic hazards, and on lands containing significant ridgelines and visually prominent slopes. Adherence to these policies could potentially render a large portion of the General Plan Amendment study area non- developable. Sponsoring property owners have indicated strong interest in allowing consideration of more intensive development in the General Plan study area (more intensive than current General Plan policies allow) . In order to study the potential for more intensive development, additional geological work must be carried out by the consultants. Wallace Roberts & Todd would oversee the production of the additional geotechnical work, using Harlin-Miller Tait as the geologist to perform research and analysis. The tasks to be carried out as part of this work are specifically outlined in Exhibit A-1 of Attachment 1 of this report. The cost to complete this additional work is $24,440.00. Model Construction _ The. City needs to ..ba able,,tq,cvai:,ate the e:c' ects of alterna-five plan's' on the visual quality of hillsides. In order to assist in this endeavor, a model of the stud;r area (showing contour and property lines as well as existing roads) would be constructed by California Model Design at a cost of $3,745.00. Additional Biological Jo rk In order to fully comply with all requirements of the California Environmental Qualitv Act (as well as other applicable State and Federal regulations) , the need has arisen to conduct additional biological work in the General Plan Amendment study area. This additional biological work will focus -2- on conducting surveys for the San Joaquin Kit Fox and other sensitive plant and animal species in order to verify their existence or non-existence in the General Plan study area. If sensitive species do exist, appropriate mitigation measures must be established to reduce the loss of these species. Wallace Roberts & Todd would oversee the production of the additional geotechnical work using BioSystem Inc. as the biologist to perform the surveys , analysis, monitoring and mitigations. The tasks to be carried out as a part of this work are specifically outlined in Exhibit A-1 of Attachment 1 of this report. The cost to complete this work is $43,405.00. In the event the surveys find that the Kit Fox or other sensitive plant and animal species, are not present, the cost for additional work will be $25,450.00 rather than $43,405.00, since there would be no need to perform work outside of the initial surveys. The total cost of the additional work is as follows: Geotechnical - $24,440 Model - 3,748 Biological - 43 ,405 -or- 25,450 (if no sensitive plant and/or animal species are found Total $71,593 -or- $53,638 The Agreement Amendments Three separate agreement amendments are attached for your review. Please refer to Attachments 1, 2 and 3. Each of those agreements must be entered into prior to having the consultants perform the additional geotechnical, biological and model construction work. It is recommended that the City Council review Attachments 1, 2 and 3 (the agreements) and adopt Exhibits A, B and C, the resolutions approving the agreement amendments. In addition, it is recommended that the City Council: 1) authorize the City Manager to sign the agreements between a) the City and Wallace Roberts & Todd, and b) the City anr' sponsoring property owners; and 2) authorize the Mayor and City Clerk to sign the agreement between the City and Alameda County; with the signings to occur after monies have been received from sponsoring property owners to pay for the additional geotechnical and biological work. It should be noted that of the fourteen (14) different sponsoring property owners, ten (10) have decided to fully participate in paying for the entire cost of the additional work. Attachment 4 shows breakdown of those costs at the $71,593 additional study cost level. 'Attachment 5 shows a breakdown of those costs at the $53,638 additional study cost level. Attachment 6 provides a breakdown of individual sponsoring property owners total monetary participation in the costs of the entire GPA/SP study and EIR, inclusive of the additional geotechnical and biological work, if sensitive plant and animal species are found in the General Plan study area (at the $71,593 cost level) . Attachment 7 provides a breakdown of individual sponsoring property owners total monetary participation in the cost of the entire CPA/SP study and EIR, inclusive of the additional geotechnical and biological work, if sensitive plant and animal species are not found in the General Plan study. area (at the $53 ,638 cost level) . In Attachments 2 and 3, it should be noted that all monetary figures and blank spaces marked with asterisk(s) represent new costs associated with the amendments to the agreements.
