RECOMMENDATION Waive the Encroachment Permit Fee and Authorize the City Engineer to Issue the Encroachment Permit. FINANCIAL STATEMENT: Minimal administrative costs associated with the issuance of the permit. DESCRIPTION Mr. Raymond Riordan, on behalf of residents along Burton Street, has requested permission to close the street on July 4, 1989 for a block party. The closure would affect the entire street which runs between Tamarack Drive and Amador Valley Boulevard. The residents of Burton Street have made a similar request each year for the past several years . Mr. Riordan has indicated that this is their 9th Annual Fourth of July event. Staff has prepared recommended Conditions based on those approved for the 1988 Street Closure. The applicant has concurred with all of the Conditions . In the past, the City Council has waived the cost of the issuance of an encroachment permit. The City currently offers as a service an Insurance program which meets the $1 million requirement for encroachment permits . The applicant reimburses the City for the premium and the City absorbs administrative and surcharge costs . The Burton Street residents have purchased a policy under this program. A copy of the issued insurance certificate is attached. Staff recommends that the City Council authorize the City Engineer to issue a permit including the proposed conditions and that the permit fee be waived. ---------------------------------------------------------------------------- COPIES TO: Ray Riordan ITEM NO. May 30, 1989 Mr. Paul Rankin Assistant City Manager w City of Dublin PO Box 2340 Dublin, CA 94568 RE: Request to Close Burton Street on July 4, 1989 Dear Mr. Rankin: Recently, you and Ms. Betty Heller discussed the requirements for closing Burton Street for our ninth (9th) annual July 4 celebration for 1989. Last year, you and -.I met on several occassions for our previous July celebration. Once again, I will ensure all permits, insurance and requests are complete for our July 4 festivities. As requested in your May 22 letter to Ms. Heller, this letter is our formal request for street closure and a list of the expected events. On behalf of all Burton Street residents (aka: Burton Street Benchers) , I composed the following. On July 4, 1989 we wish to close Burton Street between Tamarack Drive and Amador Valley Boulevard, restricting vehicular traffic, from 10: 00 am to 10:00 pm. (Emergency vehicle access will be accomodated. ) Limiting vehicle movement on our street increases safety for our children, friends, and adults as they move between homes where various activities will take place and provides a safe area for our "safe n sane" fireworks display, bar-b-que, and dining area for all to congregate. A complete list and schedule of our activities will be drafted later, but 'will include low risk activities: cake walk, pie throwing, egg toss, and water balloon toss. Game booths (bean bag toss, basketball shooting, etc. ) will be set up on private property. The events will be limited to current residents and some past residents. The number of participants will not exceed 47 . No alcohol will be served or sold. Over the last eight years, safety and responsible behavior have been our foremost objective at all our neighborhood events. Prior to last year's list of conditions, we initiated neighborly conscientious guidelines. Our past functions, actions, and fun have been well organized and supervised. We have a spotless safety record at all our neigborhood functions. As we did last year, we wholeheartedly accept and will comply with the Conditions of Encroachment outlined last year (1988) . (As you mentioned in your letter, the City Staff intends to process our request with the conditions set last year. ) A revised Conditions of Encroachment list is enclosed. Number 10 of the conditions requires a Certificate of Insurance. We wish to apply for the insurance program the City of Dublin utilizes. The enclosed application and check for $65. 00 completes the requests set in your May 22 , 1989 letter. As I remember from last year,, 'the City Council approved the closure first, then we filled out the permit. Does the same procedure hold this year? If not, please send us the permit to complete. All other documents are enclosed. We appreciate your thoroughness and willingness to help us plan our event. When our local government and neighborhoods work together, we all benefit. The date of the street closure shall be July 4, 1989. 2 . The hours of the street closure shall be 10:00 am to 10: 00 pm. 3 . Sufficient barricades shall be provided by the homeowners. Due to the use of barricades after dark, barricades shall be equipped with flashing safety lights. 4 . Barricades shall be supervised by responsible person(s) in the event traffic or emergency vehicles need to enter or exit Burton Street. 5. Noise shall be maintained at an acceptable level. 6. Responsible person(s) shall insure that any consumption of alcoholic beverages is limited to adult attendees. No sales of alcoholic beverages are permitted by this permit. 7 . Barricades shall be removed from the public street at the conclusion of the event. In no case shall barricades remain in the street after 10: 00 pm. 8. Permittee shall be responsible for removing all litter and debris from the public street. 9. Any use of fireworks shall be limited to authorized "safe and sane" fireworks. The use of such fireworks shall -be supervised by adults and in accordance with all .manufacturer's instructions. 10. Applicant shall provide a Certificate of Insurance which names the City of Dublin as an additional insured for the event. The minimum acceptable limits of insurance is $1 million per occurrence. 11. Applicant shall complete Encroachment Permit Application and submit an acceptable Certficate of Insurance or obtain required insurance no later than June 30, 1989.
