DESCRIPTION: Senate Bill 140 provides for State participation in the amount of $300,000,000 in FY 1990-91 to be matched by local funds on a 50-50 basis for use on local roads. The local funds can be provided from the General Fund or from local sales tax (including Measure B) but may not be provided from Gas Tax revenue or developer contributions. All cities and counties are eligible to submit projects. This being the case, it is anticipated that the $300,000,000 spread over the projects submitted will not reach the maximum 50% matching but will probably be in the 10% to 20% range. After all the projects are received and tallied, agencies will have the ability to withdraw projects at will if the matching is too low to bother with. These funds have not, as yet, been appropriated, but there is a proposal to obtain them from an increase in the State gasoline tax. If this program is successful, it may be extended into future years. Local jurisdictions desiring to participate in this program must submit applications for funds by June 30, 1989 and advertise the projects for construction by June 30, 1991. Staff is recommending that the City apply for funding on the following projects: Annual Street Overlay for 1990-91 and 1991-92 This project is made up of two years of overlay projects (from the CIP) plus the repair of pavement failures for streets that are to be overlaid, which is budgeted under the Street Repair Operating Budget. Currently this project is scheduled to be funded +50% by Measure B funds, +45€ by General Funds, and 5% by Gas Tax revenue. If the City's application is successful, the City could receive up to 50% from SB 140, thereby freeing up all the gas tax as well as General Funds for other projects. Estimated Budget: Construction Cost $437,154.52 Construction Engineering (10% maximum) 43,715.45 Total: $480,869.97 Funding: SB 140 (50% maximum) $240,434.99 Local (GF or Measure B - 50% minimum) 240,434.99 Total: $480,869.67 ---------------------------------------------------------------------------- J ITEM NO. # t0 COPIES TO: Pavement Rehabilitation This project is made up of two years of slurry seal projects, including the repair of pavement failures for the streets to be slurried, which is budgeted in the Street Maintenance Operating Budget. Currently, this project is funded completely by gas tax revenue. If the City's application is successful, the City could receive up to 50% funding from SB 140. The local matching funds (minimum 50%) would have to come from some other source than gas tax revenue. , This would allow use of the gas tax funds for other projects. Estimated Budget: Construction Cost $402,250.00 Construction Engineering (10% maximum) 40,225.00 Total: $442,475.00 Funding: SB 140 (50% maximum) $221,237.50 Local (GF or Measure B - 50% minimum) 221,237.50 Total: $442,475.00 Staff recommends that the City Council adopt the resolution authorizing the Public Works Director to apply for SB 140 funding for these projects. -2- RESOLUTION. NO. 49 A RESOLUTION OF THE. CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- AUTHORIZING DIRECTOR OF PUBLIC WORKS TO SIGN APPLICATION FOR STATE-LOCAL TRANSPORTATION DEMONSTRATION PROGRAM FUNDS (SB 140) WHEREAS, Senate Bill 140, which was adopted by popular vote in June, 1988, allocates $300,000,000 in State funds to-identify and construct locally supported transportation projects that require a minimum of State planning and review; and WHEREAS, local jurisdictions which desire to participate in this program are required to submit applications for these funds by June 30, 1989, and advertise the projects for construction by June 30, 1991; and WHEREAS, the City of Dublin's annual street overlay and annual street rehabilitation projects could be eligible for matching funds; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin authorizes the Director of Public Works to sign the application for State-Local Transportation Demonstration Program Funds (SB 140) . AYES: NOES: ABSENT: Mayor ATTEST: City Clerk STATE-LOCAL TRANSPORTATION DEMONSTRATION PROGRAM INTERIM DISTRICT GUIDELINES ' GENERAL The purpose of these interim administrative guidelines is to facilitate the processing of ap- plications which will be submitted by local entities for the State-Local Transportation Demonstration Program (SB 140). There are two reasons why these guidelines are being called interim. The first is because they have been prepared over a short period of time and there may be significant areas which have not been given proper review. The second reason is that the Legislature will have to determine if this will be an ongoing program beyond the 1990-91 fiscal year. The legislative intent of this program is to identify locally supported projects which can be constructed in the immediate future with a minimum of State planning and review. In order to carry out this legislative intent, the following respective roles must be strictly ad- hered to: HEADQUARTERS LOCAL STREETS AND ROADS ENGLYEERS Headquarters staff will provide guidance to the District on policy direction and provide sup- port assistance. DISTRICT LOCAL STREETS AND ROADS ENGINEERS (LS&R) The District LS&R Engineers will have primary responsibility for the implementation of the program to ensure that applications submitted are complete. The following guidelines shall apply to District processing of applications submitted: 1.The District Local Streets and Roads Engineer will receive the completed application from the local entity. 2.The District LS&R Engineer will be responsible for a project review with appropriate local and district representatives to determine the following: a. The project will increase the capacity of the highway or guideway or would extend service to new areas; or in case of a local road rehabilitation project, it would ex- tend the useful life of the roadNvav by at least ten vears. D LSR Page 1 b.The applicant has committed, or is capable of committing, to pay the local share to complete the project. c.The project is not receiving any other State funds. d. The applicant has completed, or is capable of completing, all project development work so that the contracts for the project can be awarded no later than June 30,1991. e.Improvements to State highways are consistent with State/Federal standards and are designed to minimize long-term maintenance costs. £The cast estimate included in the application is reasonable. 3.Send completed aplication (save copy for your records) to Headquarters LS&R Engineer. 4. Headquarters will compile a list of eligible projects and send a copy back to the District LS&R Engineer. 5.The District LS&R Engineer will then be responsible for obtaining the required State and local signature on the State- Local Agreement. The District Director will sign the agreement for the State. After all signatures are obtained,send one original of the agree- ment to the local entity, one original to Headquarters, and retain a copy for your files. 6.The District LS&R Engineer shall be responsible for notifying Headquarters of the con- tract award date and the project completion date. 7.All invoices for completed work,or advance of funds requests,shall be approved by the District LS&R Engineer and forwarded to Headquarters for payment. 8. If a final technical inspection is determined to be required, this will be the responsibility of the District LS&R Engineer. LOCAL ENTITY(COUNTY, INCORPORATED CITY,EM. The local entity must submit a complete application to the District Local Streets and Roads Engineer by June 30, 1989 and be prepared to develop a project package which is ready for advertising and construction by June 30, 1991. D LSR Page I TIME FRAMES FOR THE STATE-LOCAL TRANSPORTATION DEMONSTRATION PROGRAM(SB 140) DUE DATE &TASK: 0630-88: Caltrans District Local Streets and Roads Engineers provides notice that project application packages are available to qualified applicants. 07-01-88: Caltrans District and Headquarters Local Streets and Roads Engineers and other staff provide guidance to applicants as they prepare for the Process. 0630-89: Final date which applicants may submit application forms to the Caltrans District Local Streets and Roads Engineer. 0930-89: Caltrans Headquarters Division of Local Streets and Roads provides informal list to all applicants which shows projects submitted to date. This is an administrative date which is not included in the SB 140 legislation. The purpose of this informal list is to notify applicants of the approximate percentage reimbursement rate prior to the final date to offi- cially withdraw a project from the program. 1231-89: Final date by which Caltrans Headquarters Division of Local Streets and Roads compiles a list of the submitted projects. If the requested State Share exceeds the $300 mil- lion, Caltrans computes the pro rata share for the projects, and notifies the applicants of the resulting percentage. Any project dropped after this date will result in a reduction of the $300 million in an amount equal to the State Share of the project cost. 04-01-90: Applicants who wish to proceed with the originally proposed project at the final resulting State Share percentage notifies Caltrans. Some applicants may drop one or more projects if the State percentage share is too low. 05-01-90: Caltrans Headquarters Division of Local Streets and Roads compiles a final list of eligible projects,calculates the amount of State Share funds required (up to $300 mil- lion) and informs the Legislature of the amount. 0630-90: Date by which the Legislature intends to appropriate State Share funds (up to $300 million). 0630-91: THE LAST DATE TO AWARD CONTRACTS.Eligible projects for which ap- plicants have not awarded construction contracts on or before this date must be withdrawn from the current year's program. 0630-93: Last day for applicants to spend all allocated funds. All unused or unspent allo- cated funds will be returned to the State.
