Adopt Resolution upholding Zoning Administrator's action denying Variance request, or give Staff direction and continue the item. FINANCIAL STATEMENT: None. DESCRIPTION: Background: The existing 17 foot tall freestanding Kentucky Fried Chicken sign erroneously received Alameda County approval on September 30, 1981; a building permit was issued on October 5, 1981; and on December 21, 1981, the County Zoning Administrator notified the property owner and sign company that the freestanding sign was not in compliance with the Zoning Ordinance. The notification indicated that in order to comply with the Ordinance, the Applicant would need to remove the 17 foot tall sign and apply for a low profile sign (maximum 6 foot height, and maximum 24 square foot sign area) , or relocate the sign beyond the required 30 foot frontyard setback area, or apply for a Variance to retain the sign. The Applicant subsequently applied for a Variance. On March 3, 1982, the Alameda County Zoning Administrator denied the Applicant's Variance request to allow the 17 foot tall freestanding sign within the front setback and not within the middle one-third of the lot. ------------------------------------------------------------------------------ COPIES TO: Representative Owner File PA 87-068 ITEM NO. 6+ File V-8422 The Applicant appealed the Zoning Administrator's decision to the Dublin City Council. On May 24, 1982, the City Council continued the appeal indefinitely pending completion of the sign study and adoption of the Sign Ordinance revisions. Consequently, the sign has been in place for approximately five and one-half years. Since the Applicant has recently filed a Site Development Review (SDR) request for a storage addition, it would be appropriate to resolve the sign issue at this time. The City's Sign Ordinance revisions adopted May 12, 1986, did not result in changes affecting the Applicant's Variance request. Section 8-87.34 b) of the City's Zoning Ordinance relating to freestanding signs prohibits the location of freestanding signs within required setback areas. The existing 17 foot tall freestanding sign is set back 15 feet from the front propertyline (within the required 30 foot front setback) . The intent of Section 8-87.35 of the Zoning Ordinance relating:to alternate types of freestanding signs is to allow certain types of signs (1) low profile sign, 2) office building master identification sign, 3) service station display structure, 4) shoppingcenter ,master identification sign, and 5) C-2-B-40 directory sign) within the required setback area. Subject to approval of a Site Development Review, the Applicant may utilize a low profile sign with a 6 foot maximum height and a 24 square foot maximum sign area within the front setback area. In order for the Applicant to retain the existing sign in its present location, the City Council would need to overturn the County Zoning Administratar's denial by adopting a Resolution making the following affirmative findings based on fact: 1) the Variance authorized doe's not constitute a grant of special privilege inconsistent with the limitations on other properties in the vicinity; 2) special conditions and extraordinary circumstances apply to the property and do not apply to other properties in the vicinity, so that the strict application of this Chapter deprives the property of rights enjoyed by other properties; 3) the Variance authorized meets the intent and purpose sought to be achieved by the regulations in this Chapter; and 4) the Variance authorized does not adversely affect the orderly development of property and the preservation of property values in the vicinity. Staff recommends the City Council uphold the Zoning Administrator's action denying the Variance request in that 1) granting the Variance would constitute a grant of special privilege, 2) there are no special circumstances related to the physical characteristics of the site which would warrant granting the Variance, 3) the Variance request is inconsistent with the intent of the Sign Ordinance, and 4) the Variance request adversely affects the orderly development of property in the vicinity. Should the City Council decide to grant the Variance request, or if additional information is needed, the City Council should continue the item to allow Staff to prepare a Resolution approving the application or provide the necessary information. -2- RESOLUTION NO. - 87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -----------------------------------------------------------7------------------ UPHOLDING THE ZONING ADMINISTRATOR'S DECISION DENYING V-8422 KEITH HOLMES SIGN VARIANCE FOR KENTUCKY FRIED CHICKEN WHEREAS, Keith Holmes filed an application for a Variance, V-8422, to allow retention of a freestanding sign located in a required 30 foot front yard setback and not in the middle one-third of the lot in a "C-2-B-40" (General Commercial) District, located at 6797 Village Parkway (Kentucky Fried Chicken) ; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found.to be categorically exempt; and WHEREAS, upon holding a public hearing on March 3, 1982, and considering all reports, recommendations and testimony, the Zoning Administrator made the following findings of fact: a) • There are no special circumstances applicable to the property which deprive the property of privileges enjoyed by. other property in the vicinity under the identical zoning classification as the property has no extraordinary circumstances which deprive it of the opportunity for`the permitted low-profile sign in the front: yard or a freestanding sign`behind the 30 foot setback line; i 1 b) the granting of the application-will constitute a`grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone as approval of a :freestanding sign in the front yard represents a privilege not available to other parcels inthe vicinity; C) the use will be detrimental to persons or property in the neighborhood or to the public welfare as approval of the freestanding sign in the front yard represents a precedent having the effect of removin g the B-40 zoning from the property this should be considered by the legislative body not accomplished by administrative action; and WHEREAS, the Zoning Administrator, unable to make the three I mandatory affirmative findings of fact, denied the Variance request; and i WHEREAS, on March 10, 1982, James McLey of Cal-Neon appealed the Zoning Administrator's action; and WHEREAS, the Dublin City Council held a public hearing on April 26, 1982, and May 24, 1982, to consider said appeal; and WHEREAS, upon considering all reports, recommendations and testimony, the Dublin City Council continued said appeal indefinitely pending completion of the City sign study and Sign Ordinance revisions; and WHEREAS, on May 12, 1986, the Dublin City Council adopted Ordinance No. 7-86 revising the City's Sign Ordinance; and WHEREAS, said Sign Ordinance revisions and subsequent Ordinance amendments did not establish or modify the City's sign regulations affecting the Applicant's request to retain a 17 foot tall freestanding sign within the 30 foot frontyard setback and not within the middle one-third of the lot; and WHEREAS, on April 30, 1987, in conjunction with the Citywide sign survey, the City Zoning Investigator provided written notification to the Applicant and Property Owner that the existing freestanding sign was illegal and must be removed by May 30, 1987; and WHEREAS, the Applicant has not exhausted the appeal process for said sign, and the May 30th deadline was extended pending City Council action on the appeal; and WHEREAS, the City Council held a public hearing on said appeal on June 8, 1987; and HIBIT. i 1191 }t ''�S ._. _. :R�,w41e?: �'�' s�:'S.r .��FSI •4� _ „F. z'�t.��' _ .� _ 'Ei•ffitk WHEREAS, roper notice of said public heaL._-.g was given in all respects as required by law; and WHEREAS, a Staff Report was submitted recommending the appeal be denied; and WHEREAS, the City Council heard and considered all said reports, recommendations, and testimony hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED- THAT THE Dublin City Council does hereby find that: ' 1) The granting of this Variance will constitute a grant of a special privilege inconsistent with the limitations on other properties in the vicinity, in that all properties within the City are limited by the City's zoning regulations for the specific district in which the property is located. All properties within the C-2-B-40 General Commercial District are required to maintain a 30 foot frontyard setback in which no freestanding signs shall_be located, except for those alternate types of freestanding signs identified in Municipal Code Section 8-87.35. .of the Zoning Ordinance (i.e. , low profile signs six foot maximum height and 24 square foot maximum sign area) and subject to Site Development Review approval. i t 2) There are no special conditions or extraordinary circumstances related to the physical characteristics of this property which are unique and which do not apply to other properties in the vicinity, $o that the strict application of the sign regulations does not deprive the property of rights enjoyed by other properties; in that although the site is irregularly shaped and slightly smaller in area than that required in the C-2-B-40 district (site area existing = 37,069. square feet required site area: — 40,000 square feet) these conditions do not affect the property development's ability to maintain the required 30 foot frontyard setback nor does it affect the placement of a low profile sign. With respect/ to placement of the sign not within the middle one-third of the a lot, special circumstances do exist in that the site is currently developed with a driveway located in the approximate middle one-third of the lot. Placement of a freestanding sign within, the middle one-third of that lot would be a detriment to the site. 3) The granting of this Variance does not meet the intent and purpose of the Sign Ordinance in that the sign is not compatible with adjacent land uses, and the sign (due to its size and location) represents excessive signage which results in a loss of prominence for other business sites in the vicinity. 4) The granting of this Variance adversely affects the orderly development 3 of property and preservation of property values in the vicinity in that the s sign does not conform to the C-2-B-40 district setback requirements. The most significant feature Of the "13" District requirements is a 30' front setback. The 17.5' high sign may occupy no portion of this setback. The plans "Approved as to Zoning" for the installation of this sign indicated a ' 15' front setback and a 30' side setback. The side setback was based on the 90' frontage width of the lot that was indicated on the plans submitted for building permit. In actuality, the frontage width is 16012 requiring a minimum 53.33' side setback. As previously stated, the Zoning District requires a 30' front setback. For these reasons, both the actual side and the front setback are less than the Zoning Ordinance requirement. This prior Zoning Approval was revoked on December 11, 1981 when we became aware of the error. -- -- . Your alternatives appear to include at least two procedures. (1) Comply with u the Ordinance by removing the sign. Compliance could include replacing it with a "low profile" sign, not exceeding 6' copy height or 24 sq. ft. in aggregate area or relocating the sign at least 30' from the front property line. KEITH HOLMES, V-8422, to allow retention of a freestanding sign located in a required 30' front yard and not in the middle 1/3 of the lot in an '!C-2-B-40' (General Commercial, 1 acre minimum building site area, with 30' front yard) District, located at 6796 Village Parkway, west side, 150' north of the intersection with Dublin Boulevard, Dublin, Assessor's No. 941-210-33. Mr. Roger Hamblin of Harman Management Corporation was present to give testimony. He explained that approximately $10,000 in expenses has been incurred so far for this sign which was carefully designed to follow the instructions and require- ments of the Planning Department. He listed all the various signs surrounding. the intersection. Mr. Flynn replied that -prior to 1974, there were no restrictions on signs in ;+ in this zone and the sign described by Mr. Hamblin were built prior to current regulations. Mr. Keith Holmes spoke, stating that he felt he should not have to be asked to cover someone else's mistake. He stated that someone should be responsible for overlooking the particular circumstances of this matter. Mr. Flynn informed the men he will correspond with the City of Dublin and ask regarding the retention of the combining district. The matter was continued to March 3, 1982, the taking of testimony remains open. 12. DAVID D. County Public Works Building, 399 Elmhurst Street; Hayward, California; and WHEREAS it satisfactorily appears from affidavits on file that proper notice of said public hearing was given in all respects as required by law; and WHEREAS this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt, class 5 h; and W14EREAS a Pre-Hearing Analysis: was submitted recommending the application be denied; and WHEREAS applicant appeared at said meeting and presented testimony . in support of the application; and WHEREAS the Zoning Administrator did hear and consider all said reports, recommendations and testimony as hereinabove set forth; Now Therefore BE IT RESOLVED that the Zoning Administrator finds that: (a) There are no special circumstances applicable to the property which deprive the property of privileges enjoyed by other property in the vicinity under the identical zoning classification as 'the prbpetty has no extraordinary circumstances which deprive it of the opportunity for the permitted low-profile sign in the front yard or a free-standing sign behind the 30 foot setback line; (b) The granting of the application will constitute a grant of special privileges-inconsistent with the limitations upon.other properties in the vicinity and zone as approval of a free-standing sign Y '' in the front yard represents a privilege not available to other parcels in the vicinity; (c) The use will be detrimental to persons or property in the'',neighbochood or to the public welfare as approval of the free-standing sign in the front yard represents a precedent having'the effect of removing the B-40 zoning from the'property--This should be -,.considered by the legislative body-not accomplished by'admihlstrative action. . . At this time .l .was given verbal guidance and*a''tab 1. e'.. to determine size, height and setback. My drawings were ulti- mately approved by planning, who said they were familiar with the property. The plans were then submitted to the Building Department where they were reviewed, and approved. The sign was then installed as approved by the Planning and Building Departments'. At this time we were advised by Planning that approval*was mistakenly given by the County. Before construction started, our sign company, the district _ . manager and myself went to the County to receive sign regulations i as to size, height, and location. We submitted drawings, render-, ings, and plot plans to the County. After receiving the permit to install the sign:,we had the County inspect the excavation, we than proceeded to install the sign— After final inspections were made we were told by the County of Alameda that we were in violation of local city ordinance and that they had given us the wrong informa- tion as to zoning requirements. ~ ti We were willing to install any size, shape, and color of sign that they would allow, but now we feel 'that we should not have to pay for mistakes made by. county employees. The sign is not in poor condition as others on the Bouleyard, and maybe this could give us j .time to change our'sign when others in the area are remodeled. This . would also allow us to expense the cost over a few years. We don't want to make enemies with the Alameda County or the Dublin City Council as we would suffer with future dealings with these government agencies. Any help and support from the Chamber of Commerce would be very much appreciated as this is something . that could happen to any businessman. in-the area. ` It is very had for a small businessman to make a profit in ` these economic times as you can see from the closing of many business outlets in the area. It is also very frustrating when you follow instructions to the letter 'and later be told that the job is wrung, especially when you deal with people who don't have- to spend their own money.
