FINANCIAL STATEMENT : No measurable cost to City. Fees will
offset expenses .
DESCRIPTION : At the City Council meeting of April 27 ,
1987 , a public hearing was held in connection with the ac7op on
of—T'Fie Fire Safe Roofing Ordinance . After the public hearing was
closed , the matter was referred to Staff to investigate the
feasibility of requiring spark arrestors to be installed within a
specified time and to review the standards for spark arrestors .
The issue of spark arrestors has been resolved by the
introduction of an ordinance requiring spark arrestors to be
installed when work exceeding $ 1 ,000 . 00 is being done , or when
property is sold .
Section I of the ordinance deletes the provisions that exempts
single family dwellings & accessory buildings from the
requirement for permits .
Section II of the ordinance establishes the following three
roofing areas :
Roofing Area 1 requires a Class B roof covering or non-
combustible roofing material . Any reroofing in this area must
comply with requirements for new construction . Reroofing should
not be a problem because all buildings in the area have concrete
tile roofs .
Roofing Area 2 requires a Class C roof covering or non-
combustible roofing material . Any reroofing in this area must
comply with requirements for new construction . There are 71
houses in Tract 4930 , ( Estate Homes ) and 146 houses in Tract
5511 , ( The Gregory Group ) in Area 2 . Any reroofing of buildings
with wood shingles or wood shakes will have to have materials of
Class C or better .
Materials available for Class C are fiberglass shingle , metal
tile , perlite tile , pressure treated wood shingles and shakes and
concrete or clay tiles . Because of the added weight , the
installation of concrete or clay tile would probably require
reinforcing wood trusses .

In Roofing Area 3 approximately 50% of the roofs have wood shakes
and 5,0% havi composition a-sphalt shingles,. ; In .this .area-,
buildings may be reroofed in kind . However , a composition
asphalt shingle roof could not be replaced with wood shakes .
This ordinance also deletes the exception which provides that
permits are not required for re-roofing single family dwellings
and accessory buildings .
Exhibit 2 is a Resolution whereby the City Council finds that the
Fire Safe Roofing Ordinance is necessary because of climatic and
topographical conditions . State law requires the findings to be
made whenever local building regulations are adopted that differ
from the regulations adopted by the State .
Exhibit 3 is a Resolution establishing permit fees for reroofing .
Permits will now be required for reroofing single family
dwellings and accessory buildings so ' it is necessary to establish
` a fee . A fee of $20 . 00 , which is the minimum permit fee , is
proposed .
It should be emphasized that the intent of requiring a permit is
to assure that the applicant will be advised of the material
requirements in the three. roofing areas . Inspections will be
made ar,d will be limited to assuring that the proper materials
have been used . Inspections made after the roofing has been
completed cannot assure compliance with other aspects of the
code .
It is also proposed to revise the permit fees for reroofing all
other buildings . Under the present code , .permits are required
for reroofing all buildings except single family dwellings and
accessory buildings . Under the present fee schedule the permit
fee is based upon the valuation of the reroofing work . On large
commercial and industrial buildings the fee collected exceeds the
costs to the City. To make the fee schedule more equitable , it
is proposed to reduce the fee by 50% .
It is also proposed that this resolution become effective on the
effective date of the Fire Safe Roofing Ordinance .

AN' ORDINANCE OF THE CITY OF DUBLIN AMENDING ORDINANCE"02=84 W T
ESTABLISHING FIRE HAZARD AREAS AND ESTABLISHING VARIOUS REQUIREMENTS
FOR FIRE RETARDANT ROOFS IN THOSE AREAS
The City Council of the City of Dublin does ordain as follows:
Section I
Section 12. 1 of Ordinance 02-84 is amended by deleting Item 12.
Section II
Section 22.33, Section 3202(b) on page 529 of the 1982 Uniform Building Code
is amended to read:
(b) Fire Retardancy, when required.
1 . Map of Fire Safe Roof areas. A map of Fire Safe Roof areas, as
prepared by the Dublin San T-a-m—on-75ery ices District Fire Department and the
City of Dublin, is attached hereby as Exhibit "A" and incorporated herein by
this reference. Said map may be amended from time to time by including areas
which are annexed to the City within one of the three roofing areas. Said
ammendments may be made by the Building Official after consultation with the
Chief of the Dublin San Ramon Services District Fire Department.
2. Roofing -Area 1. Any new roof and any alteration, repair or replacement
for buildings housing R & M occupancies shall use roof covering material that
conforms to Class B or better when tested in accordance with UBC Standard 32-
7, or shall be made of concrete, ferrous or copper metal, clay, slate or
similar non-combustible material.
3. Roofing Area 2. Any new roof for buildings housing R or M occupancies
shall use roof covering material that conforms to Class C or better when
tested in accordance with UBC Standard 32-7, or shall be made of concrete,
ferrous or copper metal, clay, slate or similar non-combustible material.
Any roof covering alteration including replacement or repair made within a 12
month period which:
A. Does not exceed 25% of the projected area of the existing roof may use
material similar to the existing roof covering material.
B. Exceeds 25%, but does not exceed 50% of the projected area of the
existing roof shall use roof covering materials as required for new
roofs.
C. Exceeds 50% of the projected area of the existing roof, the entire
existing roof shall be replaced with materials as required for new
roofs.
4. Roofing Area 3. Any new roof for buildings housing R & M occupancies shall
use roof covering material that conforms to Class C or better when tested in
accordance with UBC Standard 32-7, or shall be made of concrete, ferrous or
copper metal, clay, slate or other similar non-combustible material. Any
alterations, including replacement or repairs may be material similar to the
existing roof covering material, but may not use materials having a lessor
fire retardancy.
5. Other Occupancies: Any new roof covering and any alterations, repairs or
replacement of roo covering material for buildings housing all other
occupancies shall conform to the requirements in set forth in Roofing Area 1.
6. Other Provisions. Skylights shall be constructed as required in Chapter
34. en ouses sal be constructed as required in Chapter 36. For use of
plastics in roofs, see Chapter 52. For solar energy collectors located above
or upon a roof See Section 1714.

Section III. Effective Date and Posting of Ordinance.
Th,s Ordinance shall take'effect•"and -be`in force tH'rty,"(-30)'^days from and
after the date.of its passage. The City Clerk of the City of Dublin shall
cause this Ordinance to be posted in at least three (3) public places in the
City of Dublin in accordance with Section 36933 of the Government Code of the
State of California.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

FINDINGS AS TO WHY AMENDMENTS
TO THE UNIFORM CODES ARE NECESSARY
WHEREAS, California Health and Safety Code Section 17958 and
Section 17958.5 allow the City, by Ordinance, to make modifications or
changes to the State Building Standards Code and other regulations adopted
pursuant to California Health and Safety Code Section 17922; and
WHEREAS, California Health and Safety Code Section 17958.5
requires that such changes must be determined to be reasonably necessary
because of local climatic, geographical, or topographical conditions; and
WHEREAS, California Health and Safety Code Section 17958.7
requires that the governing body of the City, before making any modifications
or changes pursuant to Health and Safety Code Section 17598.5, shall make an
express finding that each such modification or change is needed; and
WHEREAS, such findings must be made available as a public
record, and a copy thereof with each such modification or change shall be
filed with the Department of Housing and Community Development, State of
California; and
WHEREAS, the City Council has before it an Ordinance requiring
fire safe roofing materials in certain areas of the City; and
WHEREAS, the City Council hereby determines that the proposed
Ordinance, presented herewith, establishes requirements greater than those
set forth in the California State Building Standards Code, as adopted by the
City of Dublin and set forth in Ordinance 05-84.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does
hereby find that each of the aforementioned changes or modifications which
are set forth in this Draft Resolution are reasonably necessary because of
local climatic conditions in the area encompassed by the boundaries of the
City of Dublin because the City has a hot, dry, windy climate which is
conducive to the spread of fire from building to building.
BE IT FURTHER RESOLVED that a copy of this Resolution and
Ordinance be sent to the State Department of Housing & Community Development.

A RESOLUTION OF THE CITY COUNCIL

FEE SCHEDULE FOR BUILDING REGULATION PERMITS
WHEREAS, Section 12 . 14 of Ordinance 02-84 requires this
City Council to adopt a schedule of fees for permits ,
reinspections , code compliance surveys , moved building
inspections , plan and specification , storage fees , additional plan
checking fees , hourly rates for inspection services not covered by
specific fees ; and
WHEREAS, Resolution 05-84 established said fees ; and
WHEREAS , it is necessary to add to the fee schedule set
forth in Resolution 05-84.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City
Council does hereby adopt the following fees for reroofing :
Fee for reroofing single family dwelling and accessory
buildings $20 .00 .
Fee for reroofing all other buildings shall be based on
valuation as setforth in Resolution 05-84, except that the
fee charged shall be 50% of that fee determined by the
valuation of the work .
BE IT FURTHER RESOLVED that this Resolution shall become
effective on the effective date of Ordinance No. -87 .
