SUBJECT Consideration of Revision to Alameda County Solid
Waste Management Plan

FINANCIAL STATEMENT: None
DESCRIPTION At the regular City Council meeting on September 28,
1987, the City Council adopted the Waste Management Plan, as proposed by the
Alameda County Solid Waste Management Authority.
At the time of the public hearing, there was discussion related to possible
amendment language being proposed by the City of Hayward. The purpose of
the amended language was to clearly identify that the Authority policy was
to maintain at least 50 years of permitted landfill capacity, on a
continuous basis. Nine cities have now adopted the Plan, including the
proposed amended language. State Law requires that a majority of the cities
containing a majority of the population must adopt the Plan. As identified
in Mr. Mercer' s memorandum, the County has not received enough approvals to
adopt the Plan, and therefore, has requested that cities which did .not adopt
the amended language, consider doing so.
On October 28, 1987, the Alameda County Solid Waste Management Authority met
to review the proposed amended language. The Authority voted unanimously to
approve the language and request that cities which had not adopted the
amended language reconsider their action. The proposed resolution contains
an exhibit which identifies the language as adopted by the City Council and
the proposed replacement language.
The first substitution would more explicitly identify that a new application
for the importation of solid waste could not occur until an engineering
study certified that at least 50 years of permitted landfill capacity is
available. The language goes further to describe that an agency from
outside of Alameda County could not be approved if the mitigation would
reduce the permitted landfill capacity to less than 50 years. The second
change would assure that the policy is consistent with other sections within
the Plan. As noted in the memorandum, the Authority originally intended
that the policy be established to maintain at least 50 years of permitted
landfill capacity for Alameda County waste on a continuous basis . Each
proposal for importation would need to insure in-place mitigation before any
importation could begin.
Staff has prepared a resolution which would amend the City Council ' s action
of September 28, 1987 by including the proposed replacement language.
Staff would recommend that the City Council approve the amendment and adopt
the resolution.

OF THE CITY OF DUBLIN

APPROVING AN AMENDMENT TO THE
. ALAMEDA COUNTY WASTE MANAGEMENT PLAN
WHEREAS, the City Council of the City of Dublin approved
the Solid Waste Management Plan for Alameda County on
September 28, 1987; and
WHEREAS, the Plan must be approved by a majority •of
cities representing a majority of the population; and
WHEREAS, nine cities have adopted the Plan with amended
language; and
WHEREAS, the Solid Waste Management Authority has
reviewed and approved the amendment; and
WHEREAS, the Authority has requested that each City
which adopted the Plan without the amendment consider the proposed
language contained in Exhibit A.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Dublin does hereby amend its action taken
September 28, 1987, to approve the Solid Waste Management Plan.
The approval shall be amended to include the replacement language
contained in Exhibit A attached hereto and made a part hereof.

PROPOSED REPLACEMENT LANGUAGE FOR SPECIFIC SECTIONS OF
THE ADOPTED SOLID WASTE MANAGEMENT PLAN FOR ALAMEDA COUNTY

11. Prior to November 1, 1988, and at each five-year interval after the -
start of importation, guarantee that there is significant permitted '
landfill capacity in Alameda County to meet the disposal needs of all
Alameda County jurisdictions for a 50-year continuous period.

11. Prior to November 1, 1988, a base line permitted landfill capacity in
the Alameda County shall be established using the engineering
technology currently available.
No new application for the import of waste for an agency outside
Alameda County shall be approved unless an engineering study certifies
that at least 50 years of permitted landfill capacity is available in
Alameda County for all the jurisdictions in Alameda County. The
engineering study shall be based upon the regulations and technology
prevailing at the time of application.
In no event shall any application from an agency outside of Alameda
County be approved with mitigation which would on the date of approval
reduce the permitted landfill capacity available to Alameda County
jurisdictions to less than 50 years.

(c) Any proposed plan amendment to import waste for disposal in
Alameda County will be considered only after clear independent
evidence is presented demonstrating that either sufficient fully
permitted landfill capacity exists within Alameda County to serve
the needs of all County jurisdictions for a minimum 50-year
continuous period; or that mitigation fees are provided by the
project proponents to acquire such additional capacity.
Mitigation fees shall be provided to acquire replacement capacity
or to achieve source reduction.

SUBJECT: REQUEST FOR CITY COUNCIL TO RECONSIDER REVISED COUNTY SOLID WASTE
MANAGEMENT PLAN
At its October 28 meeting, the Authority reviewed the status of member agency
action on the proposed revised Solid Waste Management Plan, July 29, 1987.
Under State law, a county plan must be adopted 'by a majority of the cities in
the county containing a majority of the incorporated population. In Alameda
County, approval by 8 or more of the 14 cities, with a combined population of
at least 549,199, is needed to adopt the Plan.
To date, nine cities with a combined population of 501,834 (45.7%) have adopted
the Plan with the amended language recommended by Hayward Manager Don Blubaugh.
Four other cities (Albany, Dublin, Fremont and Pleasanton) with a population of
240,346 (21.9%), adopted the Plan with the original July 29 language. The City
of Oakland, with a population of 356,217 (32.4%), rejected the Plan due to in-
sufficient time for review. Oakland intends to review the Plan within 60 days.
At the October 28 meeting, the Authority' voted unanimously to approve the
language recommended by the Hayward City Manager and to resubmit the Plan to
cities that have not yet adopted the new language. Attached is a sample of
the proposed language. The intent of the original and revised language is to
indicate the Authority policy to maintain at least 50 years permitted landfill
capacity for Alameda County waste on a continuous basis. Each proposal to
import waste for disposal in an Alameda County landfill would need to assure
in-place mitigation before any importation could begin.
The Plan will be transmitted to the California Waste Management Board when the
necessary population requirement for approval is met. The position of any city
acting afterwards will also be transmitted to the State.
The Authority urges your city to consider and approve the revised Plan
language as soon a possible at a public meeting. If you have any questions or
