Adopt Resolution Approving Memorandum of Understanding FINANCIAL STATEMENT None DESCRIPTION At the June 23 , 1987 meeting of the Dublin City Council , the Council approved a Memorandum of Understanding between the City of Dublin, Dublin San Ramon Services District and the City of San Ramon regarding transfer of service responsibility relating to fire protection and suppression and park and recreation services. In addition, the Council adopted a resolution requesting negotiations with the County regarding District property tax proceeds. Both Alameda and Contra Costa Counties have approved the transfer of District property tax proceeds to the respective Cities of Dublin and San Ramon. In the meantime, staff of both Cities have been working on transfer agreements for real property and personal property and development of all the necessary documents to effect the transfer of park and recreation services by July 1 , 1988 . In the interim it has been suggested that both Cities assume the responsibility for all recreational and aquatic activities and programs to include scheduling of all District aquatic and park and recreational facilities within each of their respective territorial boundaries , effective January 1 , 1988 . The Cities would be entitled to all of the fees and charges collected, as well as establishing fee schedules for the related programs and services. The District would continue to be responsible for maintenance of the facilities until July 1 , 1988 or until such time as the facilities are transferred to the Cities. Correspondence stating the District ' s position is contained in Exhibits A, B and C. Additionally a Memorandum of Understanding has been developed for approval by each City and the Dublin San Ramon Services District (Exhibit D) . The City ' s Recreation Department has had the responsibility of scheduling the Shannon Community Center since July of 1984. In July of 1987 the City assumed the scheduling responsibility for the Dublin Sports Grounds . Consequently staff does not feel that the Recreation Department will be impacted by accepting the responsibility for facility scheduling as proposed in the Memorandum of Understanding. ----------------------------------------------------------------- COPIES TO: ITEM NO. 8• _I Q) AGENDA STATEMENT December 14 , 1987 Page Two Assumption of the aquatic programming responsibility will have a greater impact on the Recreation Department, however staff is in favor of transferring this responsibility from the District to the City. According to the Hughes , Heiss Associates Report dated December 15 , 1986 , the cost for aquatic programs for the Valley Community Swim Center is estimated to be $38 ,297 for 1988-89 . Revenue for aquatics programs during this same time period is estimated to be $26 ,500 . If the Council is in favor of accepting the responsibility for aquatic programming at VCSC, staff will develop a revised budget as well as job descriptions and fee schedules for Council review at a future meeting. It is staffs recommendation that the Memorandum of Understanding be approved and the resolution attached in Exhibit E be adopted. Box 2340 Dublin, CA 94568 Dear Richard: At its regular meeting of November 3 , 1987, the District 's Board of Directors adopted a policy permitting the City of Dublin to determine fee schedules for all of the District ' s parks located in Dublin , as well as Shannon Park Community Center, effective January 1 , 1988. The Board determined that the City should collect and retain all such fees, along with scheduling use of facilities. If you have any questions about this , please call me . Box 2340 Dublin, CA 94568 Dear Richard: At its regular meeting of November 17, the District 's Board of Directors officially stated its position regarding the future of the Valley Community Swim Center. The Board will look to the City of Dublin to provide full aquatics programming services at the Valley Community Swim Center effective January 1 , 1988. The District plans to con- , tinue to maintain the facility through June 30, 1988, at which time we assume the City will be our successor and take over complete control of and responsibility for the pool. On November 4, 1 sent a copy of our agreement with the School District for the Valley Community Swim Center to Ms. Libby Silver of your City Attorney 's office . In order to afford you the opportunity to plan and schedule for the City ' s aquatics program commencing calendar year 1988, the Board asked me to call your attention to the fact that in accordance with past practice , due to the lack of an agreement with the Amador Valley Joint Union High School District , the District does not plan to heat the pool between Ju'-n-e 1 and June 30, 1988. In the past the San Ramon Olympic Pool has been used during Easter vacation for recruiting and training of aquatics personnel, etc . , so you should be able to make arrangements for use of that facility . Box 2340 Dublin, CA 94568 Dear Richard: In my letter of November 18 regarding the Valley Community Swim Center, I informed you that the pool would not be heated until June 30, 1988. This was incorrect; as in the past , the District plans to begin heating the pool on June 1 , 1988. Please accept my apologies for any inconvenience this misunderstanding may have caused . Item 8. 1 Exhibit D Missing Memorandum of Understanding dated November 20, 1987 RESOLUTION NO 104 -87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ----------------------------------------------------------------- A RESOLUTION APPROVING MEMORANDUM OF UNDERSTANDING REGARDING THE ASSUMPTION OF SCHEDULING RESPONSIBILITY FOR AQUATIC AND PARK AND RECREATION FACILITIES AND THE CONDUCT OF AQUATIC AND RECREATIONAL PROGRAMS WHEREAS, the representatives of the City Councils of Dublin and San Ramon and the Dublin-San Ramon Services District (DSRSD) have met to discuss the transfer of certain services currently being provided by DSRSD to areas within the boundaries of the Cities of Dublin and San Ramon; and WHEREAS, on July 15 , 1987 , the representatives of the City Councils of the Cities of Dublin and San Ramon and the Board of Directors of DSRSD entered into a Memorandum of Understanding providing for the transfer of service responsibilities from the District to the respective Cities; and WHEREAS, to facilitate the orderly transfer of such services it is desirable, from time to time, to enter into interim agreements ; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby find that: 1 . The Memorandum of Understanding, attached hereto as Exhibit A, is hereby approved and ratified and the Mayor is authorized and directed to sign it.
