HomeMy WebLinkAboutReso 032-01 SafewayNegDecl RESOLUTION NO. 32-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ADOPTION OF A MITIGATED NEGATIVE DECLARATION FOR PA 00-034 SAFEWAY SITE DEVELOPMENT REVIEW AND CONDITIONAL USE PERMIT WHEREAS, Brandon Farrell, on behalf of Safeway., Inc. has requested approval of a Site Development Review and Conditional Use Permit to allow a with a new 55,256 square foot grocery store, 10,743 square foot of retail, and an 18-pump fueling station with a 314 square foot kiosk located at 7499 Dublin Boulevard; WHEREAS, the applicant. has proposed to pay $274,804 for the grocery store and retail and $129, 536 for the fueling station to offset traffic impacts, before the issuance of a building permit; WHEREAS, the California Environmental Quality Act (CEQA), together with State guidelines and City environmental regulations require that certain projects be reviewed for potential environmental impacts and that environmental documents be prepared; and WHEREAS, an Initial Study was conducted for this project with the finding that with the incorporation of mitigation measures into the proposed project, there would be no significant effects on the environment; and WHEREAS, a Mitigated Negative Declaration has been prepared for this application and is on file in the Dublin Planning Department; and WltEREAS, the City Council did review and use their independent judgment to consider the Mitigate Negative Declaration at a public heating held on March 6, 2001; and WHEREAS, proper notice of said hearing was given in all respects as required by law. NOW, THEREFORE, BE IT RESOLVED THAT THE that the Dublin city Council does hereby find that: A. Although the project could .have a significant effect on the environment, there will not be a significant impact in this case because revisions in the project have been made or agreed to by the project proponent and because a Mitigated Negative Declaration will be adopted that mitigates any impacts of the project to a level of insignificance through the adoption of mitigation measures and a Mitigation Monitoring Program. B. The mitigation measures identified in the Mitigated Negative Declaration are reflected in related Site Development Review conditions of approval. C. The Mitigated Negative Declaration has been prepared in accordance with State and local environmental laws and guidelines. D. The Mitigated Negative Declaration is complete and adequate and reflects the City's independent judgment and analysis as to the environmental effects of the proposed project. NOW, THEREFORE BE IT FURTHER RESOLVED TBAT THE that the Dublin City Council does hereby adopt the Mitigated Negative Declaration for PA 00-034, Safeway Inc. project, including the Initial Study and Mitigation Monitoring Program which are incorporated herein by reference.
