BACKGROUND On July 5, 1989, the Alameda County Zoning Administrator approved Conditional Use Permit 5511, allowing an amendment to the Alameda County Solid Waste Management Plan to provide for the importation of solid waste from Contra Costa County to the Altamont Landfill site for a period of two years. At that meeting, the County Zoning Administrator also approved a Mitigated Negative Declaration addressing environmental impacts associated with the proposed amendment. Prior to the Zoning Administrator taking action on the Mitigated Negative Declaration for the project, this document was referred to each City and special district in the County, for review and comment (City Staff did not find any problems with the document) . After the July 5, 1989 Zoning Administrator action, the Plan Amendment and Mitigated Negative Declaration were forwarded to the Alameda County Waste Management Authority for review. On July 19, 1989, the Alameda County Waste Management Authority considered and approved the Solid Waste Management Plan Amendment (and Mitigated Negative Declaration) by adopting Resolution No. 33 (see Attachment 3) . Resolution No. 33 includes specific mitigation measures applicable to the project. To be adopted, the plan amendment must first be approved by a majority of the cities in the county containing a majority of the incorporated population. State law provides ninety days for cities to review the plan amendment and either approve or disapprove it. This gives cities until ------------------------------------------------------------------------------ ITEM NO. 6., COPIES TO: Planning File 7 October 17, 1989 to act on the proposed plan amendment. In the event that cities fail to act within this time period, the plan amendment would be deemed approved. On August 15, 1989, the Board of Supervisors considered and approved the plan amendment with mitigation measures. The Waste Management Authority is now requesting that the Council consider the Mitigated Negative Declaration and review and approve the proposed plan amendment inclusive of the mitigation measures contained therein. Once approved by a majority of the cities, the plan amendment will be forwarded to the California Waste Management Board, the County Department of Environmental Health, the Regional Water Quality Control Board and Bay Area Air Quality Management District for review and approval. Once approved by these bodies, plan implementation will begin. II. ISSUES Alameda County Staff will be available to make a brief presentation of the plan amendment to Council at tonight's meeting. The Council should pose any questions they have to County Staff. The following amendments are proposed to the Solid Waste Management Plan language: a. Alameda County Waste Management Authority Resolution No. 33 - July 19, 1989, shall be included in its entirety in Appendix H, "Selected Alameda County Solid Waste Management Authority Resolutions" . b. Chapter II, "Objectives and Policies": Amend Policy 3(c) , page II-8, to add the following sentence at the end of the policy: This Plan provides for importation of municipal solid waste from Contra Costa County for two years on an emergency basis, pursuant to Resolution No. 33 of the Authority and for importation of municipal solid waste from the City and County of San Francisco, pursuant to Resolution No. 78 of the Authority. C. Chapter III "Solid Waste Management Facilities" : - Figure III-2 is amended to read: - "Begin/End Two-Year Contra Costa County Import7" - ,7Pursuant to ACWMA Resolution No. 33" Transport of 580,000 tons of municipal solid waste (no hazardous wastes) is expected to begin in late 1989 or early 1990. It should be noted that the proposed plan amendment should not negatively impact Dublin. However, one aspect of the amendment that will indirectly impact the City is, there will be an increase in garbage transport trucks using I-580 and I-680. As long as the mitigation measures applied to this project are implemented, impacts can be curtailed. These mitigation measures include: 1) requiring that Contra Costa County pay to Alameda County an upfront fee of $623,150 for roadway improvements to roads used in Alameda County by the garbage transport trucks, and for improvements to the I-680/I-580 interchange; 2) limiting the number of garbage transport trucks from Contra Costa County to 275 arrivals per week and to 60 per day at the Altamont Landfill site; and 3) not allowing garbage transport .trucks from Contra Costa County through the I-680/I-580 interchange during peak periods of 6 a.m. - 9 a.m. and 3 p.m. - 6 p.m. -2- III. CONCLUSION In summary, transport of solid waste along I-580 and I-680 will have indirect impacts on the City. Increased useage of these freeways by garbage transport trucks will occur. This can be mitigated as noted above. Staff recommends that the City Council adopt the resolution shown as Exhibit A, approving the amendment to the Alameda County Solid Waste Management Plan (inclusive of mitigation measures) to allow importation and disposal of municipal solid waste from Contra Costa County to the Altamont Landfill site for a period of two years. -3- RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVAL OF AN AMENDMENT TO THE ALAMEDA COUNTY SOLID WASTE MANAGEMENT PLAN TO ALLOW IMPORTATION AND DISPOSAL OF MUNICIPAL SOLID WASTE FROM CONTRA COSTA COUNTY TO THE ALTAMONT LANDFILL SITE FOR A PERIOD OF TWO YEARS WHEREAS, the City of Dublin is a member of the Alameda County Waste Management Authority; and WHEREAS, the Authority and its member agencies have adopted the Alameda County Solid Waste Management Plan dated July 29, 1987 and most recently revised June 22, 1988; and WHEREAS, the California Waste Management Board has approved said Plan and all adopted revisions; and WHEREAS, Oakland Scavenger Company has requested an Amendment to said plan to permit import and disposal of a total of 580,000 tons of municipal solid waste from Contra Costa County at Altamont Sanitary Landfill over a two year period to begin after all necessary permits are in place; and WHEREAS, Oakland Scavenger Company also applied for Alameda County Conditional Use Permit No. C-5511 for Altamont Sanitary Landfill, to provide for the same importation and disposal of Contra Costa County waste as contained in the proposed Amendment to the County Solid Waste Management Plan; and WHEREAS, the Alameda County Zoning Administrator, as Lead Agency under CEQA, held a duly noticed public hearing on June 14, 1989, continued to the meeting of July 5, 1989, to consider the proposed project and a proposed Mitigated Negative Declaration; and WHEREAS, the Alameda County Zoning Administrator considered and approved the Mitigated Negative Declaration (SCH #89-053001) dated July 5, 1989 and also approved Conditional Use Permit No. C-5511 (July 5, 1989) for said project; and WHEREAS, the Authority held a duly noticed public hearing on June 28, 1989 and continued to July 19, 1989 to consider said Mitigated Negative Declaration and said Plan Amendment, at which time all interested parties were heard on the proposed plan amendment and Mitigated Negative Declaration; and WHEREAS, at its July 19, 1989 meeting the Authority did consider said Mitigated Negative Declaration and approved said Plan Amendment; WHEREAS, the Dublin City Council held a public hearing on August 28, 1989, to consider said Mitigated Negative Declaration and the Alameda County Solid Waste Management Plan Amendment as identified in the document entitled "Alameda County Waste Management Authority Resolution No. 33 - July 14, 1989; and -1- "uIBIT...,A NOW, THEREFORE; BE IT RESOLVED THAT a Mitigated Negative Declaration for the proposed project was prepared and adopted by the Alameda County Zoning Administrator, July 5, 1989, in accord with the California Environmental Quality Act and State and local EIR guidelines, and the City Council of the City of Dublin has considered said document in conjunction with the proposed plan amendment; and BE IT FURTHER RESOLVED THAT the City Council of the City of Dublin does hereby approve said plan amendment to the Alameda County Solid Waste Management Plan as identified in the document entitled "Alameda County Waste Management Authority Resolution No. 33 at Meeting of July 19, 198911 , inclusive of mitigation measures; and BE IT FURTHER RESOLVED THAT this Resolution be transmitted to the Authority. We enclose the 35-page-long proposed plan amendment. We also enclose a summary of the major features of the proposal, focussing on the 'identified project impacts and mitigation measures. The Alameda County Zoning Administrator approved a Conditional Use Permit and Mitigated Negative Declaration for the project on July 5. Prior to this, proposed project mitigation measures were referred to each city and district manager, as well as other concerned parties. A11 concerns raised by the managers and others were addressed in the final CEQA document. The proposed amendment to the County Solid Waste Management Plan was initially considered by a seven-member Authority committee, with a TAC of three city/ district managers. The committee recommended approval of the amendment. The Plan Amendment was approved by the full Authority on July 19. After approval by the Authority, State law provides 9U days for the cities to review the plan amendment and either approve or disapprove. Failure to act within that period is deemed to be plan approval. To be adopted, the plan amendment must be approved by a majority of the cities in the county containing a majority or the incorporated population. The proposal is also submitted for review and approval to the Board of Super- visors and two special districts that are Authority members. The Board of Supervisors has designated the Authority to be responsible for preparing and SRI Alameda County Waste Management Authority - Gus horrison Transmittal Memo to Council/hoard Members- July 2U, 1989 Page 2. amending the plan. The special districts are not includeu in the State formula for amendment of county plans. In the past, the boara of Supervisors and district boards have reviewed and approved the Plan. Although, under the State law, the cities have until October 17 to act on the proposed plan amendment, it is requested that the cities consider this item as soon as possible. After adoption by the cities, the plan amendment is submitted to the California Waste Management board for its approval. The project must also be approved by the County Department of Environmental Health, the Regional Water Quality Control Board and the Bay Area Air Quality Management District. REASON FOR PROJECT Contra Costa County's main landfill, Acme Fill near Martinez, is scheduled to close on September 27, 1989. The County does not have sufficient alternative capacity to handle this waste for two years. ' I.I. PROJECT DESCRIPTION Applicant: Oakland Scavenger Co. (OSC), subsidiary of Waste Management Inc. Term: Two Years, to begin when all= permits are in place (expected to begin in late-1989 or early-1990). Wasteshed: Central and east Contra Costa County. Waste Type: Municipal Solid Waste - (+69% residential/commercial, +15% construction/demolition and +16% industrial). No hazardous wastes would be allowed and Contra Costa operators would be required to implement a hazardous waste control program. No wastewater treatment plant sludge or sludge ash/residuals from Contra Costa County would be allowed. Tonnage: 290,000 tons per year (18% increase in waste flow to Altamont landfill). Up to 1,100 tons per day may be disposed (five-day operating week). Transport: Transfer trucks only. 55 trucks daily with maximum of 60 daily j or 275 weekly, unless permitted by the Alameda County Department of Environmental Health in an emergency. Transfer trucks must originate at Acme Fill Transfer Station near Martinez. Other origination points for transfer trucks would be considered by the Authority and Alameda County, if proposed during the two year term. Truck Route: Approach from Contra Costa would be via I-680 to I-580 to South- front Road to Greenville Road to Altamont Pass Road. Departure route would be via Altamont Pass Road to Northfrout Road to I-580 to I-680. Landfill: Fill Area I (existing permitted area), Altamont Sanitary Landfill Operations: No significant landfill design or operational changes are pro- posed. PROJECT IMPACTS AND MITIGATION MEASURES The most significant project impacts are addressed as follows: A. Impacts on Roadway Condition Based on an independent traffic study and data provided by the Alameda County and City of Livermore Public Works Agencies., it was found that the project would have signficant impacts on the following public roads: Altamont Pass Road (need for resurfacing and eventual reconstruction; improvements needed near landfill entrance, at intersection with Dyer Road, and at the Union Pacific Railroad crossing; also safety-related signage). Southfront Road (need for resurfacing and traffic signal at interesectioa with Greenville Road). Northfront Road (need for resurfacing). Greenville Road (need for resurfacing and traffic signal as noted above). I-580/I680 interchange (expedited schedule of planned improvements). As mitigation, Conditions #12 and "13 provide that OSC shall pay an up front mitigation fee of $623,150 for roads, equaling the proportional share of costs attributable to Contra Costa trucks. Conditions of approval for the landfill and prior plan amendments provide for payment of the remaining shares of road repairs attributable to garbage trucks from Alameda county and San Francisco. B. Impacts on Traffic ' The following traffic impacts were identified: jIncreased peak period congestion at the I-580/I-580 interchange. Increased congestion and delay at the Highway Patrol Weigh Station located along I-580, one-half mile west of Greenville Roaa. Increased need for traffic signal at Greenville Road/Southfront Road. As mitigation, Conditions #8 and #9 require that waste from Contra Costa be hauled in transfer trucks. This reduces the average number of trucks per day from 105 to 55 and allows control of scheduling to avoid peak period traffic congestion. Condition u14 limits the maximum number of trucks per aay to 60, to insure that trucks are dispersed throughout the working week. Condition #15 bans transfer trucks from the I-580/I-680 interchange during the 6:00-9:00 a.m. and 3:00-6:00 p.m. peak periods. C. Impacts on Authority Import Policies The County Solid Waste Management Plan (July 29, 1987) contains four specific policies governing importation of waste. These policies and the conditions proposed to insure plan consistency, are detailed below: ` Alameda. County Waste Management Authority Summary of July 19, 1989 Plan Amendment - i Page 3. I i 1. Plan Policy 3(a): Requirements for handling, processing and transporting solid waste from outside Alameda County shall be at least as restrictive as required of in-county operations. Currently, most waste disposed at Altamont is first handled at a transfer station. Transfer trucks reduce truck traffic and air pollution, save energy, and result in greater waste compaction at the landfill. Transfer stations allow inspections to remove recyclables and hazardous wastes. At present, all trucks are inspected by the County Department of Environmental Health to-ensure compliance with State standards. Litter is reduced since transfer trucks are enclosed and because transfer stations provide a close- in site for public deliveries. Public acceptance of transfer trucks is greater than for more easily identifiable and unsightly "garbage trucks." Under Condition #8, all Contra Costa waste must be brought in by transfer trucks. Under Condition #5, the transfer station must have a hazardous waste control program that is at least equivalent to the program conducted at the Brisbane Transfer Station. Condition #10 requires that trucks be enclosed to prevent litter. Condition #11 allows the Alameda County to inspect all Contra Costa trucks which dispose at Altamont. 2. Plan Policy 3(b): Exporting county shall have an existing resource recovery effort at least equal to that practiced in Alameda Count and must have an q y ongoing program to ensure future resource recovery rates consistent with the goals in the Alameda County plan. The Alameda County Solid Waste Management Plan calls for recovery of 30% of waste by 1990, 45% by 1995 and 75% by 2005. The county currently recovers about 6.8% of its wastestream. However, by the end of 1989, about 35% of households in the county are expected to have weekly curbside collection service (Albany, Berkeley, Fremont, Livermore, Newark and Union City). Monthly service is available in Piedmont and parts of Oakland. Increased commercial recycling is also underway. Before importation may begin, Condition "7 requires verification that current and proposed Contra Costa resource recovery efforts equal the current and projected levels in Alameda County. In addition, the amount of waste permitted for import is reduced if less than 35" of the Contra Costa wasteshed has weekly curbside collection by December 31, 1989. 3. Plan Policy 3(c): Sufficient fully-permitted landfill capacity must be demonstrated to exist in Alameda County to serve the needs of all County jurisdictions for a minimum 50-year continuous period. j In late-1985 independent consultants verified the capacity of Altamont (Fill Areas 1 - 5) to be 74 million tons. With a given compaction rate and annual growth rate, and assuming diversion of wastes to Altamont from Vasco Road and Durham Road landfills after those facilities are filled, the consultants found that Altamout landfill would reach capacity in +2019. I !1 Alameda. County Waste Management Authority Summary of July 19, 1989 Plan Amendment Page 4. i However, only Fill Area 1 at Altamont, with a capacity of +29 million tons, is "fully-permitted." The proposal to dispose 580,000 tons of Contra Costa waste would use +2.0% of this capacity. Without Contra Costa waste, Fill Area 1 would reach capacity between 1997 and 2000. Addition of Contra Costa waste reduces this life by up to 2 and 1/2 months. The lack of 50 years fully-permitted capacity has been apparent since the Authority first adopted Policy 3(c) in 1987. The Authority is using San Francisco mitigation fees to secure additional capacity. Under Conditions '. #17. and #18, OSC would pay the Authority a $3.09/ton fee on Contra Costa waste (adjusted for inflation). The Authority would adopt an Expenditure Plan for this account. The initial priority would be to acquire, in public ownership, reserve landfill capacity for use by Alameda county jurisdic- tions. The fee may also be spent on other programs to reduce waste, such as recycling. The proposed Plan Amendment would amend Policy 3(c) to specifically allow for import from Contra Costa County for two years on an emergency basis. 4. Plan Policy 3(d): Consider requiring reciprocal use of capacity in land- fills in the exporting county. Condition #6 'provides that reciprocal capacity at new landfills in Contra Costa county must be made available to Alameda county. i Contra Costa does not have excess landfill capacity. To date, the county has been unable to locate and build new landfills. Due to State action, Contra Costa County is now subject to a March 2, 1989 Peremptory Writ of Mandate issued by the Superior Court. It includes a "Solid Waste ,Facility Implementation Schedule" and "Landfill Plans and Projects Processing Time- table" to complete an amendment to the Contra Costa County General Plan, an amendment to the Contra Costa County Solid Waste Management Plan and all environmental work necessary to establish a new landfill in Contra Costa. To mitigate the conflict with Authority policy, Condition 106 also requires a program to designate a new landfill in Contra Costa County. Condition u6 includes an implementation schedule that incorporates the schedule found in i the March 22, 1989 Peremptory Writ of Mandate. However, it goes beyond the Writ of Mandate by recognizing the cities and the operators in Contra Costa as responsible parties. Also, where the Writ of Mandate stops after the planning entitlements are granted, Condition u6 includes all activities up to actual operation of a landfill by December 1, 1991. Condition #6 provides that the Alameda County Zoning Administrator will review the progress made in Contra Costa at six month intervals. He will consult with the Authority and conduct public hearings. If he finds that Contra Costa has not made sufficient progress to establish a landfill, he may alter the terms of the conditional use permit including reducing or prohibiting continued import of MSW from Contra Costa. 0372d i ;.� ALAMEDA COUNTY WASTE MANAGEMENT AUTHORITY RESOLUTION NO. 33 AT MEETING OF JULY 19, 1989 MOVED BY MR. The following provisions of the plan amendment mitigate impacts identified in the Initial Study and Mitigated Negative Declaration. The provisions are part of this Plan and shall be incorporated in the County Solid Waste Facilities Permit: 1. The Conditional Use Permit (CUP) for the proposed project shall not be implemented until the following permits and/or plans are modified as needed to provide for said project: • Alameda County Waste Management Authority (County Solid Waste Management Plan); • Alameda County Department of Environmental Health (LEA) (Solid Waste Facilities Permit); • California Waste Management Board (County Solid Waste Management Plan/Solid Waste Facilities Permit); • Regional Water Quality Control Board (Discharge Permit); • Bay Area Air Quality Management District; 2. OSC shall not accept MSW from Contra Costa County for disposal at Altamont Landfill that does not originate from a specified wasteshed, as provided in the Alameda County Solid Waste Management Plan and in the CUP. (including Pacheco), Oakley Sanitary District and Byron Sanitary District; and unincorporated, unfranchised areas of central and east Contra Costa County including West Pittsburg. The wasteshed shall be specified in CUP No. C-5511 (Altamont Landfill) j and in the Alameda County Solid Waste Management Plan prior to the start of the proposed project. The wasteshed shall be subject to the daily and total tonnage limits contained in Measure 3. Only communities within the wasteshed that meet other requirements, including Measure 7 (resource recovery), may dispose at Altamont Landfill. 3. MSW import from Contra Costa County shall be limited to no more than 580,000 tons over a two year period to begin after all necessary permits are in place. Up to 1,100 TPD may be disposed, based on a five-day operating week. 4. OSC shall not accept wastewater treatment plant sludge or sludge ash or residuals originating in Contra Costa County for disposal at the Altamont Landfill. 5. OSC shall not accept hazardous wastes from Contra Costa County, as defined in the California Health and Safety Code, and regulations promulgated thereunder by the Department of Health Services, and in- cluding changes to statutory and regulatory definitions, for disposal i at Altamont Landfill. OSC shall not accept for disposal at Altamont Landfill wastes proces- sed at Acme Fill Transfer Station (interim and permanent) unless the Alameda County LEA finds that OSC has provided adequate verification that these facilities comply with the hazardous waste identification and acceptance control methods contained in the "Waste Acceptance Control Program for the City and County of San Francisco and Sanitary Fill Company, November 1, 1988" or another program that is equivalent in effectiveness for screening out hazardous wastes, as determined by the Alameda County LEA. i 6. Before OSC may accept any Contra Costa County MSW, OSC shall provide the Alameda County Zoning Administrator with evidence that the Contra Costa County Board of Supervisors, and a majority of cities in Contra Costa County containing a majority of the incorporated population, have approved the Solid Waste Disposal Facility Implementation Schedule attached (Exhibit C). The Zoning Administrator shall confirm. that said Schedule provides for -.i a program to designate a landfill sites) in the Contra Costa County ' Plan General Plan and Solid Waste Management g , a program to issue a CUP for the landfill, acquire other necessary permits and establish an j operating landfill. The program must provide landfill capacity in Contra Costa County to meet the projected MSW needs of Contra Costa for a minimum of 20 years. The program must specify that the County Solid Waste Management Plan provide for reciprocal use of the new landfill(s) to dispose MSW generated in Alameda County, based on equivalent tonnage as would be imported into Alameda County during the proposed two-year import period. Reciprocal capacity shall be provided by Contra Costa County at a price not to exceed the disposal cost at the Altamont Landfill as inflated by Exhibit B of the Mitigated Negative Declaration provisions or resulting from mandated costs attributed to changes in Federal or State regulations. This capacity shall be guaranteed in whatever landfill is finally approved and developed in Contra Costa County. This capacity shall be guaranteed to the Alameda County Waste Manage- ment Authority and its member agencies upon reasonable noitice of its need and without conditions. The guarantee shall be in the form of a binding agreement between the County of Contra Costa and the Alameda County Waste Management Authority. The Authority considers that, due to the long hauling distances to the future landfill(s) in Contra Costa County, the reciprocal capacity provided for herein is expected i to used by Alameda County jurisdictions on an emergency basis and does not mitigate the loss of landfill capacity in Alameda County that would result from the proposed importation of Contra Costa MSW. The Schedule and program shall be at least as restrictive and comprehensive as the Solid Waste Disposal Facility Implementation Schedule and Landfill Plans and Projects Processing Timetables included in the March 2, 1989 Peremptory Writ of Mandate issues by the Contra Costa County Superior Court. Before OSC may accept any ' Contra Costa County MSW, OSC shall also provide evidence to the Zoning Administrator of a financial commitment on the part of Contra Costa County and a majority of its cities containing a majority of the incorporated population to implement the scheduled program including anticipated environmental reviews. Said Schedule must be approved by resolution of the Alameda County Waste Management Authority before submittal by OSC to the County J Zoning Administrator. At six month intervals subsequent to the date of the start of import, OSC shall report to the Zoning Administrator on the progress made by Contra Costa County, its cities and the landfill owners/operators in i that county in meeting the implementation schedule to establish a landfill in that county. For purposes of this measure, the wasteshed includes those communities identified in Measure 2 which dispose at the Acme Fill Transfer Station. Calculation of the amount of resource recovery shall be on substantially the same basis in terms of materials and program types as found in Table A-1 of the Alameda County Resource Recovery and Recycling Plan, January, 1988. ; that at least 137 of the population within that Contra Costa waste- shed is already provided with weekly curbside collection programs at the time that import to Alameda County is to begin; and that every jurisdiction in that wasteshed with more than 3,000 population has adopted a plan to initiate curbside collection on a jurisdiction- wide basis by 1992. . that no later than December 31, 1989, OSC shall provide evidence to the Waste Management Authority that there is an operating weekly curbside collection program serving at least 357 of the population within the Contra Costa wasteshed for Altamont Landfill. In the event that, by the date import is to begin, any Contra Costa County community in the Altamont Landfill wasteshed has not adopted a curbside collection plan as provided for herein, MSW from that commu- nity shall not be accepted at Altamont Landfill. In the event that, at the Acme Fill Transfer Station, waste from said community cannot feasibly be separated from the waste of communities that do conform to this measure, then the total tonnage (580,000 tons) and the daily tonnage (1,100 TPD) that may be accepted from Contra Costa will be i reduced by the amount generated by the non-conforming community(s). In the event that less than 35% of the population in the Contra Costa wasteshed for Altamont Landfill has weeny curbside collection in place by December 31, 1989, the total tonnage (580,000 tons) and daily I tonnage (1,100 TPD) that may be accepted from Contra Costa County will be reduced by a percentage representing the difference between 357 and the actual percent of population with available curbside service. i i I i Alameda County Waste Management Authority ' Resolution No. 33 - July 19, 1989 Page 7. 8. OSC shall accept for disposal at Altamont Landfill only Contra Costa County MSW which is contained in solid waste transfer vehicles origi- nating at the Acme Fill Transfer Station (interim or permanent). The approach route from Contra Costa County shall be by way of I-680 to I-580 to Southfront Road to Greenville Road to Altamont Pass Road. j.� The departure route from Altamont Landfill shall be by way of Altamont Pass Road to Northfront Road to I-580 to I-680. At a future date within the two year import period, OSC may propose to accept containerized MSW at Altamont Landfill that is delivered by '-•:; specially-designed transfer vehicles. The transfer vehicles would ' collect the contained MSW at a facility(ies) in Contra Costa County. That facility(ies), in turn, would receive the contained MSW from specially-designed route collection vehicles that would serve one or more of the following cities: Danville, Walnut Creek, Lafayette and unincorporated areas franchised by the Central Contra Costa County Sanitary District. The proposal would reduce truck-related impacts by eliminating direct-haul of collection vehicles to Acme Fill Transfer Station and by shortening the distance travelled by transfer vehicles to/from Altamont Landfill. Also at a future date within the two year period, OSC may propose to accept MSW at Altamont Landfill that is delivered by transfer vehicles that originate at a transfer stations) in Contra Costa other than the Acme Fill Transfer Station. Only MSW which originates from the wasteshed defined in Measure 2 of this Initial Study could be accepted at Altamont Landfill from this possible new transfer station. The Alameda County Zoning Administrator and Waste Management Authority will consider proposals for MSW originating from a containerized waste transfer point or from transfer stations other than Acme Fill Transfer Station if said facility(ies) has received all required land use permits from the affected local Jurisdiction(s) in Contra Costa County and is included in the Contra Costa County Solid Waste Management Plan (as required by State codes). The proposed facility operations shall have no significant impact on adjacent land uses, shall result in no significant reduction in level of service on any road or result in a significant negative impact on roadway condition, vectors, odors, air Pollution, noise or landfill operations. The proposal shall have no negative effects on mitigation measures specified herein. Further, in the case of a containerized waste transfer point, the affected juris- diction(s) shall have a weekly curbside collection recycling program and a quarterly household hazardous waste collection program in place at the time the new program becomes operational. Such consideration by the Alameda County Zoning Administrator and Waste Management Authority shall require compliance with CEQA, and other mitigation measures may be required at the time the CEQA document is considered. Public hearings must be held by the County Zoning Administrator and I'• Authority prior to authorization. 1 t u t. OSC shall not accept for disposal any'--MSW or other waste from Contra Costa County which is carried in direct-haul solid waste collection vehicles (packers), carried by-commercial haulers, or by the general r" public in private vehicles. 10. All Contra Costa transfer vehicles that dispose at Altamont Landfill `A 1 shall be enclosed as required by the Alameda County LEA to prevent y rubbish from escaping en route. k 11. Pursuant to State codes, all Contra Costa County trucks which dispose MSW at Altamont Landfill must be inspected and approved by the Alameda County LEA. The LEA charges a fee -for this service. 4 12. To mitigate roadway impacts identified in this Initial Study, OSC shall pay to the County of Alameda a nonrefundable mitigation fee of $623,150.00 for a roadway improvement project. This amount is allocated as follows: $515,000 to cover Contra Costa's proportional share of the roadway improvement project identified in the County Public Works Agency December 13, 1988 memo, Items 1-10, 12 and 16, and identified in the January 23, 1989 oral communication from the City of Livermore. $5,150 is allocated to the I-680/1-580 interchange project as recom- mended in the TJKM Traffic Impact Study (December 1988). $103,000 is reserved to address Contra Costa's share of the roadway improvement project identified in the County Public Works Agency memo, the costs of which cannot be determined at this time. This reserve also provides for engineering and contract administration costs not included in the County Public Works Agency figures. These funds shall be spent for only the project identified above. OSC shall submit to the Alameda County Zoning Administrator biannual reports describing the status of the roadway mitigation project. . 13. The roadway mitigation fee provided for in Measure No. 12 shall be paid by OSC to the County of Alameda prior to any import from Contra Costa County. The fee shall be placed in a County interest-bearing account. Interest shall accrue to the benefit of the account and account purposes. The money shall be released to the Alameda County Public Works Agency and/or the City of Livermore upon presentation of signed contracts for the work specified in the County Public Works Agency memo dated December 13, 1988 and the TJKM Traffic Impact Study (December, 1988). The County is not obligated by this measure to pay any monies other than those contained in this account or for purposes other than those identified in the specified County Public Works Agency memo dated December 13, 1988, City of Livermore communication and TJKM Traffic Impact Study. i �a ti• ' I a Alameda County Waste Management Authority Resolution No. 33 - July 19, 1989 Page 9. 14. To minimize potential traffic impacts;--the number of transfer vehicle arrivals at Altamont Landfill from Contra Costa County shall not exceed 275 per week or 60 per day, unless permitted by the County Department of Environmental Health on an emergency basis. 15. In order to mitigate the effects of truck traffic on the I-680/I-580 interchange prior to completion of planned improvements, no transfer vehicles from Contra Costa County shall pass through the interchange . during the morning peak period of 6:00-9:00 a.m. and the afternoon peak period of 3:00-6:00 p.m. 16. Within one year of the date of approval of the CUP, OSC shall submit, f and have approved by the Alameda County Zoning Administrator and the Waste Management Authority, contingency plans to be used in the event of temporary or unexpected permanent closure of the Altamont Landfill or the Acme Fill Transfer Station. The contingency plan shall identify potential temporary sites and course of action for disposal of MSW during periods of closure. 17. To mitigate project-related environmental impacts identified in this ! Initial Study, other than roadway impacts, OSC shall pay a per ton mitigation fee of $3.09 on MSW imported from Contra Costa County, to be adjusted by an inflation factor as provided in Exhibit B of this Initial Study. Said payment shall be made monthly to the Waste Management Authority after the start of importation. 18. Fees received from OSC pursuant to Measure No. 17 shall be placed in an Alameda County Waste Management Authority interest-bearing account. All interest from this account shall accrue to the benefit of the mitigation fund. The Waste Management Authority shall adopt an Expenditure Plan pursuant to Measure No. 17 to mitigate short- and long-term impacts of Contra Costa importation within one year of the start of Contra Costa importation, and after review of the Expenditure Plan by member agencies of the Authority. The initial priority for mitigation shall be to acquire, in public ownership, reserve landfill capacity sufficient to serve the needs of all Alameda County jurisdictions for a minimum fifty year continuous period. Other priorities shall include support of resource recovery and other programs to preserve landfill capacity through reduction of the wastestream requiring disposal, as provided in the Alameda County Resource Recovery and Recycling Plan. 19. There shall be no assignment, trade, sale or any other creation of an interest by Contra Costa County solid waste exporters in capacity at the Altamont Landfill to any other public agency or private party. lI �r iyL+, Alameda County Waste Management Authority Resolution No. 33 - July 19, 1989 w Page 10. 20. Within 45 days of approval of the CUP, OSC shall submit for review by the Zoning Administrator a draft program for monitoring and enforce- ment of the impact mitigation measures and conditions of approval for the project. Responsible and Trustee Agencies (as defined by CEQA) may require similar monitoring programs where measures are required to ` mitigate impacts of the project. A final program should be adopted by the Zoning Administrator within 45 days of submittal of the program by OSC. The final program shall include provision that OSC pay to Alameda County full costs incurred for review, approval, administration, moni- toring and inspection of all programs. It should be recognized that this may require hiring additional personnel on a part-time or full- time basis. The cost of the program shall not exceed $250,000. This cost does not include routine costs of the local enforcement agency program or programs mandated by other responsible agencies. The Zoning Administrator may use employees of the Planning Department, other agencies and/or private consultants, as needed, to conduct such reviews, inspections and administration to ensure satisfactory imple- mentation and enforcement of these measures. When required by the Zoning Administrator, OSC shall post a cash deposit to cover estimated costs to satisfy this requirement. The County has determined, with the concurrence of the California Waste Management Board, that an Environmental Impact Report is necessary. 3. In accordance with State law, the Plan must! show eight years of continuous landfill capacity. This can be shown by use of the ex-,sting capacity at remaining landfills, reserved sites (sites that have a General Plan Amendment as well as being identified in xhc Plan), and fully-executed waste export agreements with other counties. 4. The Board of Supervisors has reaffirmed its support for the Keller-Bailey landfill. 5. Contra Costa County is currently in the process of obtaining agreements for waste export with other counties, including Alameda and Solano Counties. 6. Contra Costa County and the California waste Management Board have determined that a timetable showing completion of the Solid Waste Management Plan along with Completion of export agreements and General Plan Amendments for reserved sites is necessary. This capacity shall be guaranteed in whatever landfill(s) is finally approved and developed in Contra Costa County. This capacity shall be guaranteed to the Alameda County Waste Management Authority and its member agencies upon reasonable notice of its need and without conditions.
