RECOMMENDATION" 1) Consider the agreement amendment allowing
, for more detailed studies of the Cronin property
for the purpose of determining residential
development potential.
2) If Council decides in favor of the agreement
amendment:
a) Adopt resolution approving the first
amendment to the agreement between the City
of Dublin and WPM Planning Team, Inc.
b) Authorize the City Manager to sign the
agreement between the City and WPM Planning
Team, Inc. after funds have been received
from the Applicant.
3) If Council decides to not study the
potential for residential development at
this time, no additional action is required
by Council and the West Dublin Studies will
proceed as outlined in the original
agreement.
FINANCIAL STATEMENT: The Applicant is responsible for all processing
costs associated with the agreement amendment,
including but not limited to, planning
consultant costs, contract planner costs and
Staff processing costs. A payment method and
schedule will be developed with the Applicant
and the City' s Finance Department.
DESCRIPTION:
On May 8, 1989, the City Council authorized the City Manager to sign an
agreement with WPM Planning Team, Inc. (Consultants) to undertake the West
Dublin Studies which include a General Plan Amendment, a Specific Plan and an
Environmental Impact Report ("Studies") . The Cronin property was included in
the study area boundary but was to remain undeveloped; therefore, the
Consultant' s workscope did not include detailed studies of the property for
purposes of determining development options.

Subsequently, Marie Cronin, property owner and Applicant, has indicated
_ she intends to sell the property and the potential buyers wish to develop the
site for residential use. The Applicant has requested the City to include the
Cronin property in the Studies and to evaluate the site for residential
development. A preliminary site plan and soils report have been prepared by
Bissell and Karn engineering firm. The preliminary site plan indicates 143
single-family homes on the 176+ acre site, yielding one unit per 1.23 acres.
Approximately 64% of the site would remain in open space, although 24 lots
have been located on the ridge, the most sensitive area of the site.
Development of the Cronin property raises several key issues that will
need to be examined by the Consultants in the course of the Studies:
- circulation, traffic and access
- visual impacts
- geotechnical constraints
- biological impacts
- ridgeline/open space preservation
As mentioned above, the original workscope prepared by the Consultant
did not include analysis of the Cronin property for potential residential
development. The cost for undertaking this additional work is estimated at
$40,000:
$29,385 - WPM Planning Team costs
$10,615 - City of Dublin Staff and Planning Consultant deposit.
Applicant responsible for cost of processing project.
Examination of the Cronin property for residential development will add
approximately two months to the West Dublin processing schedule. The time is
needed to assess the proposed site plan, alternative development plans for the
site and resultant environmental impacts.
If the Council decides to study the potential for residential
development on the Cronin property, there would be several advantages to
amending the West Dublin Studies agreement, rather than conducting a separate
General Plan Amendment study:
- it would result in a fully integrated development plan for the West
Dublin area
- it would avoid re-analyzing certain issues and minimize delays in the
West Dublin processing schedule
- it would be more cost effective and time efficient
If the Council decides to not study the potential for residential
development on the Cronin property at this time, no further Council action
would be required.

A RESOLUTION APPROVING FIRST AMENDMENT TO THE AGREEMENT
FOR THE WEST DUBLIN STUDIES
WHEREAS, the City Manager has presented an Agreement entitled "FIRST
AMENDMENT TO AGREEMENT FOR CONSULTANT SERVICES FOR PREPARATION OF THE WEST
DUBLIN GENERAL PLAN AMENDMENT, SPECIFIC PLAN AND ENVIRONMENTAL IMPACT REPORT
STUDIES; and
WHEREAS, the City Council is familiar with the provisions of said
Agreement.
WHEREAS, Marie Cronin, owner of the property shown on Exhibit A, is
hereby requesting the City to amend the West Dublin Studies Agreement to
include consideration of residential .development for said property.
NOW, THEREFORE, the City Council does resolve as follows:
The City Council approves said Agreement and authorizes the City Manager
to execute said Agreement.
PASSED, APPROVED AND ADOPTED this 28th day of August, 1989.

FIRST AMENDMENT TO AGREEMENT FOR CONSULTANT
SERVICES FOR PREPARATION OF THE WEST DUBLIN
GENERAL PLAN AMENDMENT STUDY,SPECIFIC PLAN STUDY
AND ENVIRONMENTAL IMPACT REPORT
WHEREAS, the CITY OF DUBLIN("The City")and WPM PLANNING TEAM,INC. ("The
Consultant")are parties to an agreement entitled "AGREEMENT FOR CONSULTANT
SERVICES FOR PREPARATION OF THE WEST DUBLIN GENERAL.PLAN AMENDMENT
STUDY, SPECIFIC PLAN STUDY AND ENVIRONMENTAL IMPACT REPORT(The West
Dublin Study), dated June 20, 1989 (the "AGREEMENT"); and
WHEREAS,the owner of that piece of property currently known as the Cronin
17 to:
an ownership of JS-eacres,has made application to The City to include
such property as a candidate for development in The West Dublin Study; and
WHEREAS, The City and The Consultant desire to amend the AGREEMENT to provide
for additional planning and environmental services necessary to consider the
Cronin property as a development candidate in The West Dublin Study;
NOW, THEREFORE, The City and The Consultant agree to amend as follows:
A. Exhibit "A" is amended by adding thereto the work set forth on Exhibit A-1
attached hereto and incorporated herein, to be included within the Paragraph 11
Scope of Work.
B. Paragraph III is amended by deleting the sum of$559,032 and adding in its
place the sum of$588,417.
Except as expressly set forth herein, the AGREEMENT shall remain in full force
and effect.
