CITY COUNCIL MEETING DATE: March 12, 1990
SUBJECT: Agreement to Conduct Household Hazardous Waste
Collection (HHW)

RECONIIMENDATIO 1 ) Approve the agreement and Authorize the Mayor to
Execute the Agreement on behalf of the City.
(2) Establish a Public Hearing for April 23, 1990 to
consider a garbage rate adjustment, which would be
effective July 1 , 1990. The purpose of the rate
increase would be to recover the cost of the
collection day.
FINANCIAL STATEMENT: Pursuant to the C'W y Council action taken
December 21 , 19 , the full cost of the program
will be recovered through a garbage rate
adjustment, which would be effective July 1 , 1990.
The estimated cost for Dublin would be
approximately $16,850, which equates to
approximately 20 cents for each Single Family
residential customer.
In addition, aproximately $200-250 of the
publicity costs would be paid for through an
expenditure from the approved 1989-90 Budget.
DESCRIPTION: At the City Council meeting on December 21 , 199, Staff
presented an update on Household Hazardous Waste Collection. AB939
mandates that each City develop a program. In addition, under separate
legislation, the City is required to evaluate Non-Point Source Reduction
which contaminates waterways.
Alameda County Program
The Board of Supervisors has reviewed a plan to develop some form of a
permanent collection program. This concept is in the planning stages and
the earliest the County has anticipated having a program available is
July 1 , 1991 . If the final program includes the acquisition and permitting
of specific sites, the time frame presented may be optimistic.
Since the County program is not currently available, Staff believes that it
is important for the City to proceed with a program. If the operation of a
Countywide program takes substantially longer than is currently
anticipated, Staff would strongly recommend that the County pursue an
alternative while the final program is developed.
One option would be for the County to coordinate regional collection
events. Presumably, the County could negotiate a cost effective agreement
by negotiating with the disposal firm for multiple events. This would also
provide the County with important data in order to develop their program.
The Cities would benefit through a cost effective program, which would
hopefully avoid duplication among the various agencies. Also, the County
had suggested implementing a tipping fee to fund their program. This would
provide a revenue source which would presumably be spread across all rate
payers in the County. Staff will continue to monitor the efforts being

undertaken by the County and will advise the City Council of any
developments.
Dublin/Livermore/Pleasanton Household Hazardous Waste Program
As directed by the City Council in December, Staff has been working with
the Cities of Livermore and Pleasanton to conduct a Household Hazardous
Waste Collection Event. Pursuant to the City Council direction, Staff has
worked with Livermore/Dublin Disposal to develop the recovery of the
program costs from the garbage rate payers. Staff representatives from
each of the agencies have been working with Chemical Waste Management to
provide the services.
The program has been scheduled for May 5, 1990 and will be conducted at the
Pleasanton Fire Training Facility. The program is open to residents of the
three sponsoring Cities only. Exhibit 1 to the CWM agreement outlines the
basic elements of the program.
The following sections highlight some of these elements:
Batteries
Chemical Waste Management (CWM) , the firm which will be providing the
services, does not currently work in conjunction with any battery recycler.
However, the Cities have made arrangements to have a recycler collect any
batteries brought to the event. The pick-up will occur on the week
following the actual event.
Motor Oil
CWM will make arrangements to bulk all motor oil and have a Recycler remove
the oil at the end of the event. The Staff members planning the event
recommended that participants be encouraged when possible to reuse their
contaminated oil container. Therefore, reusable containers will be
returned to each participant. If this is not done, the contaminated
containers must be trucked to the Kettleman California Disposal Facility.
Although there will be some containers of which must be disposed, the
disposal cost is based on the cubic yards transported. Staff also believes
that this encourages the individual to recycle, rather than taking up space
and incurring the cost associated with a special landfill.
Paints
The Staff investigated the possibility of recycling paints collected. A
major problem with this option is that there is not an easily identified
use for the paint collected. The recycling programs typically collect
latex paint which is blended together and returned to the agencies
collecting the program. The agencies pay the packaging and transportation
cost to the blending facility in Southern California. They are also
charged for the repackaging and return shipment of the paint. It was
indicated that agencies which have used this method often wind up with
significant amounts of Latex paint for which they do not have any use.
Given these problems, the program cost assumes that the latex paints will
be overpacked for delivery to the Kettleman Hills landfill. Oil-based
paints will be incinerated. These paints are not allowed to be placed in a
landfill and, therefore, a separate disposal method had to be selected.
The incinerator is part of the O.S.C.O. supplemental fuels program located
in Azusa, California.
Public Relations
The Cities will be undertaking the primary responsibilities for these tasks
in order to help control the costs of the program. CWM offered a full range
of services, however, the agency Staff members felt they could be provided
more efficiently by the Cities.
The City of Dublin has requested the provision of trash can hangers
announcing the event. These will be placed at each residence which
subscribes to Livermore/Dublin Disposal. In addition, a notice will appear
on the April/May/June garbage bill. The Cities are independently working

on the creation of a flyer, which will be distributed primarily through the
schools.
Restrictions/Limitations
The State Law restricts the amount of hazardous waste which can be
transported without a permit. Participants will be restricted to 5 gallons
or 50 pounds of waste material. In addition, the waste must be restricted
to households only. The program is not permitted to accept waste from
businesses or other commerical ventures. Participants will be reminded to
securely close all containers and to leave all original labels on the
container. Proof of residency will also be required as this will affect
the final billing.
Cost Sharing
As described in the December Staff Report, the Cities have agreed to share
the base set up costs equally. CWM will require 20 personnel in order to
stage the event. The total set-up costs are $26,762 which amounts to
$8,921 per agency. The remaining costs will be apportioned based on the
participation from each jurisdiction. In order to estimate each City's
potential cost, we have assumed that the participation rates will reflect
the number of households in each community.
The following identifies a breakdown of Dublin's share of the estimated
costs to be paid for through the rate base:
Set-up Costs $8,921
Estimated Variable Costs 7,295
Estimated Publicity Costs 637
Estimated Total $16,853
In addition, it is estimated that $200-$250 will be required to produce a
flyer for the event. Staff recommends that this cost be paid for by the
City through the approved 1989-90 Budget. The total estimated cost of the
contract for all three agencies including public relations is $79,897.
The precise costs of the program will not be known until after the event is
concluded. The two major variables are: (1 ) the number of Dublin residents
who participate and (2) the amount of waste actually collected. For
estimating purposes, Staff has assumed that the level of waste generated
will be 14% greater than the 1987 collection. If the estimates are
significantly different, this will impact the amount which must ultimately
be collected through the garbage rates.
Garbage Rate Adjustment
As previously discussed with the City Council, Staff is working with
Livermore/Dublin Disposal to implement a residential curbside recycling
program. This program will also be funded through a garbage rate
adjustment. Dublin/Livermore Disposal has been extremely helpful in
working with Staff to coordinate the two adjustments. It is advantageous
to consolidate the rate adjustments in order to reduce any confusion which
may occur among customers.
Dublin/Livermore Disposal has agreed that they will remit to Chemical Waste
Management the full cost of the HHW Collection upon final accounting. The
cost would then be recovered through an adjustment effective July 1 , 1990.
The goal of the rate adjustment would be to fully recover the program costs
over a one year period. By acting on a single rate adjustment combining
HHW and Residential Recycling, the rate payer will only observe one change
in the rates.
In conjunction with the Controller at Livermore/Dublin Disposal, Staff has
developed a methodology for recovering the cost from the entire residential
rate base. Although condominiums and apartments may have lower
participation rates, those residents are still eligible to participate in
the event. It is also anticipated that these residential types would
generate a lower quantity of wastes.
However, these residents benefit from the program if we are able to
eliminate illegal disposal which impacts the environment. The use of this
methodology will basically recover the costs from all residences except
those which do not subscribe to a regular garbage service.
Using a formula which discounted the number of units serviced per cubic
yard of bin space, a cost was developed which would collect fees from
multifamily residential projects services with commercial bins. The
formula resulted in a 20 cents per single family residence and 15 cents per
cubic yard on multi-family bin rates. If the entire cost was recovered
from only single family residences, the cost would have been 30 cents per
customer.
If the Recycling Cost is approximately $1 .25 per month as indicated at the
December City Council meeting, the combined rate increase would be $1 .45
per month. As noted above, it is anticipated that this cost increase would
be effective July 1 , 1990. The cost per cubic yard for multi-family bins
service would increase from $4.80 to $4.95 per yard. It is important to
note that the Recycling Program has not been finalized and a determination
has not been made, as to whether the entire recycling cost would be added
to the first can.
The City Attorney has previously advised that garbage rate adjustments
require publication of a notice pursuant to State Law. In order to allow
adequate lead time, Staff has recommended that the City Council designate a
hearing on the garbage rate increase for the meeting of April 23, 1990.
This will hopefully allow adequate time to finalize negotiations on the
residential recycling program allowing consideration for a single rate
increase covering both programs.
Conclusion
Staff would recommend that the City Council adopt the resolution approving
the agreement.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

APPROVING AN AGREEMENT FOR PARTICIPATION
IN A JOINT HOUSEHOLD HAZARDOUS WASTE COLLECTION EVENT
AND DESIGNATING A FUNDING METHOD
WHEREAS, the California Integrated Waste Management Act (AB 939)
required Cities to have programs for the collection and disposal of
Household Hazardous Waste; and
WHEREAS, in order to provide a program in a cost effective manner, it
is advantageous to work with neighboring cities on a joint program; and
WHEREAS, the Cities of Livermore and Pleasanton are also anticipated
to adopt similar agreements; and
WHEREAS, Chemical Waste Management (CWM) has provided a proposal which
provides the full range .of services necessary for the event; and
WHEREAS, CWM is a subsidiary of Waste Management Inc. , as is Oakland
Scavenger Company (OSC) ; and
WHEREAS, the Livermore/Dublin Division OSC is the franchised garbage
collection firm for the City of Dublin; and
WHEREAS, through the corporate relationship between OSC and CWM, the
cost of HHW collection can be funded as part of the garbage rate structure.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Dublin does hereby approve the Pleasanton/Livermore/Dublin Service
Agreement with CWM and the Mayor is authorized to execute said agreement.
BE IT FURTHER RESOLVED, that the Dublin City Council establishes the date
of April 23, 1990 to conduct a public hearing to consider an adjustment to
the Authorized Garbage Collection Rates, for the purpose of paying for the
cost of the HHW Collection.

SERVICE AGREEMENT
On this day of , 19 , the parties, City of Dublin, a California
Municipal corporation with principal offices located at
(Customer), and Chemical Waste Management, Inc., a Delaware Corporation with
principal offices located at 3001 Butterfield Road, Oak Brook, Illinois 60521, (CWM),
hereby agree as follows:
WHEREAS, This agreement shall only be effective if similar agreements are
executed for the City of Pleasanton and the City of Livermore with CWM.
WHEREAS, Oakland Scavenger Company (OSC) (Livermore/Dublin Division) shall
be a parry to this agreement for those cities serviced by OSC and electing to pay costs
through a garbage rate adjustment.
WHEREAS, Customer is in need of certain analytical, treatment, storage and
disposal services with respect to waste materials generated at the Household Hazardous
Waste Collection program on May 5, 1990 to be held at the Pleasanton Fire Training
Center, 3301 Busch Road, Pleasanton, CA (host agency).
WHEREAS, CWM agrees to provide Customer with such services upon the terms
as set forth herein, and in accordance with industry standards and with all regulations
governing the proper packaging of lab pack materials, as well as site-specific
requirements. All drums will be packaged to maximize cost efficiency.
1. Waste Materials
For purposes of this Agreement, Waste Materials shall be defined as those solid, liquid,
semi-solid, or contained gaseous materials which are generally described in and which
have the physical, chemical, biological and radioactive constituents, characteristics and
properties within the specifications set forth in the Waste Material Profile Sheet(s) executed
by Customer, based on the waste material generated the day of the event. The term
"Waste Materials" also includes containers described in the Waste Material Profile Sheets
if they do now, or have in the past, contained Waste Materials. The term "Unit of Waste
Materials" refers to a single whole container of Waste Materials (such as a barrel, drum,
box or tanker load) and also includes units of measure (such as yard, gallon or ton).
Customer expressly warrants to Disposer that the Waste Materials tendered to Disposer
shall conform to the description contained in the Waste Material Profile Sheet(s).

2. CWM Services
CWM shall provide Customer the services indicated below in conformance with the
proposal issued by CWM on October 21, 1989, attached hereto as Exhibit 1.
CWM will provide the following services:
x a. Sampling and analysis of unknown Waste Material;
x b. Classification and segregation of Waste Materials in accordance with DOT,
EPA and state and local regulations;
x c. Receiving, packaging, handling, labeling and manifesting of Waste Materials;
x d. Loading of Waste Materials onto transportation vehicles, cars or vessels;
x e. Transportation of the waste materials to an approved storage facility;
x f. Transportation of the waste materials from Pleasanton Fire Training Center
to KHF, TWI, or O.S.C.O disposal facility;
x g. Disposal of the Waste Materials using landfill, incineration, or fuels blending
disposal method(s) as set forth in Exhibit 1 attached hereto and made a
part hereof.
x h. CWM will assist as outlined in Exhibit 3 in the public education and publicity
program.
x i. CWM will provide each city with an account listing and project summary.
3. Compensation
For the services set forth above, Customer agrees to pay CWM in accordance with the
rate schedule attached hereto and made a part hereof. In the event the original scope
of services changes, the parties (host party) agrees to execute a change order reflecting
said changes. Unless otherwise stated in the attached rate schedule (Exhibit 4 hereto),
Customer shall pay all applicable local, state or federal taxes upon receipt of invoice.
The City of Dublin and the City of Livermore reserve the right to use Oakland Scavenger
Company's garbage rate adjustment, with the funds transferred from OSC to CWM.
Pleasanton will be billed directly by CWM. In the event the Cities of Dublin and Livermore
elect not to use a garbage rate adjustment, both cities will be billed directly by CWM.
Set-up costs will be equally shared by all three cities.
All invoices are due and payable to CWM immediately upon receipt hereof. All amounts
not paid when due shall bear interest at 1 1/2% per month until paid. Customer

guarantees payment of all such invoices when due notwithstanding any rights Customer
may have to reimbursements from insurers or other third parties.
In the event that CWM is required to undertake collection procedures or legal action to
enforce the provisions of this agreement, the prevailing parry shall be entitled to recover
interest, collection and court costs, and reasonable attorneys' fees.
4. Rejection or Revocation of Acceptance of Waste Materials
CWM expressly reserves the right to reject or to revoke its acceptance of any or all units
of Waste Materials upon verbal notice to Customer if such Waste Materials do not
materially conform to the description in the Waste Material Profile Sheet and CWM is not
permitted to treat, transport, store or dispose of said Waste Materials in the manner
specified herein. Customer shall make prompt arrangement for the removal of Waste
Materials from CWM's premises to another lawful place of storage and/or disposition.
Customer agrees to pay CWM's expenses and charges in connection with the handling,
loading, stowing, preparing for transport, transporting or storing any Waste Materials
rejected or revoked under this paragraph.
The following wastes are excluded from this program:
1. Radioactives
2. Explosives (including ammunition)
3. Compressed gas cylinders
4. Biological wastes
5. City or commercial wastes
6. Small quantity generator wastes
Excluded wastes received at the collection event will either be repackaged or overpacked
into safer containers and will be sent back with participant or collected and given to
sponsor or host agency until a final disposal determination is made. CWM will not be
required to handle materials its sites are not permitted to accept.
5. Work on Host Agency Premises
Host Agency (City of Pleasanton) agrees to provide CWM, its employees and
subcontractors a safe working environment for any work, in performance of this
Agreement, which must be undertaken on premises owned or controlled by the Host
Agency. While its employees or subcontractors are on Host Agency's premises, CWM
will maintain strict work discipline and effect its work in compliance with governmental
laws or regulations pertaining to occupational safety and health. CWM, its employees
and subcontractors shall also
comply with the Customer's safety procedures while on the Customer's premises,
provided such procedures have been made known to CWM or are attached hereto.

6. Indemnification
Each parry agrees to indemnify and defend the other for claims, demands, liabilities,
penalties, fines, causes of action and costs and expenses incidental thereto (including
reasonable attorneys' fees) arising out of personal injury, death, or loss or damage to
property, to the extent such injury, death, or loss or damage results from such party's
negligence, breach of contract or wilful misconduct.
7. Insurance
CWM shall procure and maintain, at its expense during the term of the Agreement, at
least the following insurance, covering activities performed under, and contractual
obligations undertaken in this Agreement:

B. Entire Agreement
This Agreement represents the entire understanding and agreement between the parties
hereto relating to the receiving, testing, transportation, storage, treatment, processing
and disposal of Waste Materials and supersedes any and all prior agreements, whether
written or oral,that may exist between the parties regarding same. Any acknowledgement
of this Agreement containing additional or different terms from those contained in this
Agreement shall constitute an acceptance of only those contained herein, and such
additional terms shall be null and of no effect unless accepted by CWM in writing. No
terms, conditions, prior course of dealings, course of performance, usage of trade,
understandings, purchase orders, or agreements purporting to modify, vary, supplement
or explain any provision of this Agreement shall be effective unless in writing, signed by
representatives of both parties authorized to amend this Agreement.

In no event shall the preprinted terms or conditions found on any CWM or Customer
purchase or work order be considered an amendment or modification of this Agreement,
even if such documents are signed by representatives of both parties; such preprinted
terms or conditions shall be considered null and of no effect.
9. Excuse of Performance
The performance of this Agreement, except for the payment of money for services already
rendered, may be suspended by either party in the event the delivery or transportation of
Waste Materials by Customer, or transportation, storage, treatment or disposal of Waste
Materials by CWM are prevented by a cause or causes beyond the reasonable control of
such party. Such causes shall include, but not be limited to, acts of God, acts of war, riot,
fire, explosion, accident, flood, or sabotage; national defense. requirements; injunctions
or restraining orders; labor trouble, strike, lockout or injunction (provided that neither party
shall be required to settle a labor dispute against its own best judgment).
10. Disposer Warranties
CWM will handle, load, stow, transport, store, treat, process and dispose of the Waste
Products in an efficient, safe and workmanlike manner and in full compliance with all valid
and applicable statutes, ordinances, orders, rules and regulations of the federal, state, and
local governments in whose jurisdictions such activities are performed under this
Agreement.
11. Notice
Any notice, communication or statement required or permitted to be given hereunder
shall be in writing and deemed to have been sufficiently given when delivered in person
or by registered or certified mail, postage prepaid, return receipt requested, to the
address of the respective party below and copied to each city representative as well.

EXHIBIT 1
HOUSEHOLD HAZARDOUS WASTE PROGRAM
CWM will perform the following services for the Cities of Pleasanton, Livermore and Dublin
within the following guidelines:
Event Date: May 5, 1990
Event Hours: 9:00 a.m. - 2:00 p.m.
Location: Pleasanton Fire Training Facility
3301 Busch Road, Pleasanton, California
Sponsors: City of Dublin
City of Livermore
City of Pleasanton (Host Agency)
Participants: Residents of Sponsoring Cities
(Drivers License to be Verified)
Waste Oil: CWM to arrange for Evergreen Oil Recyclers to be on site to extract the oil
into their vacuum truck. Oil may be bulked by CWM employees or agency Haz Mat
personnel. Empty usable containers will be returned to householders whenever possible.
Unreturned containers will be landfilled at Kettleman Hills landfill facility, Kettleman City,
California.
Unusable Empty Waste Oil Containers: (OSC) Livermore/Dublin Division will provide a
licensed, permitted, roll-off container to collect and haul empty oil containers (in bulk) to
the KHF landfill disposal facility for disposal.
Batteries: City of Livermore will coordinate items necessary to accept lead acid type
batteries. Motorcycle batteries or those having metal cases cannot be accepted. CWM
will not be responsible for coordinating services or contracting with American Battery
Company. CWM personnel will remove them from the participants vehicle and will be
directed as to where to store them at the collection site.
Paints: Oil-based paints will be overpacked for delivery and incineration at the O.S.C.O.,
Azusa, California supplemental fuels program.

All latex paint is to be labpacked and delivered to the Kettleman Hills landfill.
Estimated Paint Generated:
Total: 1600 gallons Breakdown: 800 gallons Oil-based/800 gallons latex
Oil base = 25 drums Latex = 40 drums
Other Hazardous Waste: All to be lab packed and landfilled at Kettleman Hills facility.
Estimate: 120 drums - This represents a 14% increase from the 1987 collection.
Cost Estimate: Per Attached.
1. Non-hazardous waste materials will be collected and hauled by Oakland Scavenger
Company, who will be given special written permission by the City of Pleasanton
to do so, in roll-off containers provided by OSC (Livermore/Dublin Division) for the
fees as outlined in proposal estimate incorporated herein, and delivered to the
Altamont Landfill, Livermore, California for disposal.
Cost Sharing: Set up costs to be shared equally by three (3) cities. Remaining costs to
be based on participation from each city. This estimate assumes that participation rates
will be similar to the number of households in a community.
Dublin - 15% Livermore - 45% Pleasanton - 40%
Payment Methods: It is currently anticipated that Dublin and Livermore will use a garbage
rate adjustment and the funds will be transferred from Livermore-Dublin Disposal to CWM.
Pleasanton will be funding their share with General Fund monies and will be billed directly
by CWM. All agencies shall receive a final accounting of the event.
Public Relations: The agencies will be coordinating the majority of the public relations
