SUBJECT: Declaration of Surplus Public Property
Westerly End of Dublin Boulevard

FINANCIAL STATEMENT:
None at this time
DESCRIPTION: Several years ago, the State relinquished the Dublin Boulevard right-
of-way west of Silvergate Drive to the City. This right-of-way is owned in fee and is not utilized in its
entirety as roadway.
Kaufinan and Broad, the developers of the Donlan Canyon project, require a small piece of this right of
way (less than one acre) for their development. This area was indicated as the Dublin Boulevard frontage
in the submittal and approvals for the project.
Section 54222 of the Government Code requires that the City offer this property to any housing
authorities, redevelopment agencies, local park and recreation departments, and the State Resources
Agency, prior to committing to sell to a private party. If the property is declared to be surplus and Staffis
authorized to enter into negotiations with Kaufman and Broad for the sale or trade of this property, these
agencies will be notified in writing and will have 60 days to respond. If all agencies decline to purchase the
property or have not responded within 60 days, Staffwill return to the City Council with a request to
adopt a resolution of intent to consummate this transaction.
Staff recommends that the City Council adopt the resolution declaring the property to be surplus and
authorize Staff to begin the process for this property sale or exchange.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ESTABLISHING SURPLUS PROPERTY
AND DIRECTING STAFF TO NOTIFY APPROPRIATE AGENCIES
WHEREAS, Kaufman and Broad has requested to enter into negotiations with the City to acquire
property at the northerly side of Dublin Boulevard, westerly of Silvergate Drive in conjunction with
further development at that location; and
WHEREAS, the property proposed to be acquired by Kaufman and Broad is not needed by the city
for street right-of-way or other purposes;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin finds that
approximately 0.93 acres of vacant right of way at the northerly side of Dublin Boulevard, westerly of
Silvergate Drive, as illustrated in the attached Exhibit A is surplus land and is determined to be no longer
necessary for the City's use.
BE IT FURTHER RESOLVED that the City Council directs Staff to notify the appropriate
agencies pursuant to statutory procedures.
BE IT FURTHER RESOLVED that if the appropriate agencies do not wish to purchase property,
then the City Council authorizes Staff to enter into negotiations for the sale or exchange of property
pursuant to Section 2.38.030C of the Municipal Code.
