Rankin, Assistant City Manager) EXHIBITS ATTACHED: Copy of Claim Copy of Sketch Illustrating Requirement for Zoning rdinance Setback RECOMMENDATION: ' 1 Deny the claim and direct Staff to notify the Claimant and the City's insurance provider. FINANCIAL STATEMENT: The claimant alleges $1 , 670 in damages. DESCRIPTION: The City has received a claim submitted by Domingo and Nora Bonifacio. The claim alleges improper permit approval in conjunction with the construction of their swimming pool. The claimant obtained a permit to construct a backyard swimming pool. The Zoning Ordinance includes a requirement for a six foot separation between the house and the pool. The claimant's house extends out from one of the second floor rooms and encroaches on the six foot setback. Maintaining this setback is important for access and to assure that the second floor can be maintained. Attached is a sketch prepared by the Planning Department, which illustrates the separation requirement. The claimants' original site plan approved by the Planning Department did not show the second floor encroachment. The building inspector who conducted the field review prior to beginning construction did not note the encroachment. The City's Building Inspection Services are provided under independent contract with Taugher & Associates, Inc. The City's insurance provider will be tendering this claim to Taugher & Associates as the City's contract contains specific indemnification and insurance requirements. The Planning Staff explained to the pool company representatives that they had several options including: (1 ) appeal of the enforcement based on an alleged error; (2) apply for a variance with facts to support findings; (3) request a study to amend the Zoning Ordinance; or (4) work with their client to revise the construction to meet the code requirements. The claimants did not pursue any of the remedies available to appeal the decision. They revised the pool design and submitted a liability claim.
