SUBJECT: Claim submitted on behalf of Roberto Flores and Maria
Marquez Flores

RECOMMENDATION: Deny the claim and direct Staff to notify the Claimant.
FINANCIAL STATEMENT: Claim alleges $1 .5 - $3 million in damages.
DESCRIPTION: On May 23, 1990, the City received a claim submitted on
behalf of Roberto Flores and Maria Marquez Flores.
The claim alleges that on November 25, 1989, Dublin Police Services
personnel served a search warrant at the claimants' home. Allegedly this
resulted in emotional trauma, shock, indignation, nervousness, fear, loss
of civil rights, and property damage. Dublin Police Services is a contract
service of the Alameda County Sheriff's Department.
The City's insurance provider has recommended that claims involving Alameda
County be denied. Pursuant to the agreement with Alameda County for Police
Services, the claim will be tendered to Alameda County. The agreement
contains standard hold harmless and indemnification clauses. The denial of
the claim will protect the City's legal rights related to the time period
for filing a legal action.
Staff recommends that the City Council deny the claim and direct Staff to
notify the claimant.
