FINANCIAL STATEMENT: Revised fees are lower than those currently charged
for oversize/overweight vehicle permits.
DESCRIPTION:
In July of 1989, the State Legislature adopted AB 1849, which amended Sections
35781 and 35795 of the California Vehicle Code to require local jurisdictions
to use the same permit form and charge fees which are no higher than those
charged by the State Department of Transportation for oversize or overweight
vehicle permits.
Over the past year, the State has worked with both trucking associations and
local jurisdictions to develop a permit form and a fee structure that were
acceptable to the greatest number of agencies. City of Dublin Staff attended
two meetings with State officials and responded to surveys regarding the
permit form and fees.
The resulting fees are lower than those presently charged by the City of
Dublin for oversize/overweight vehicle permits. The purpose of the fees is to
cover the cost of administering the permits; the revenue is not intended to
reimburse the City for damage to public streets caused by heavy vehicles.
The City presently charges $35.00 for a single-trip permit and $10.0.00 for an
annual permit. The required fees as of July 1 will be $15.00 for a single-
trip permit and $75.00 for an annual permit. Moves requiring Police or Public
Works staff time for engineering or traffic control may still be charged at
the hourly rate for the service.
Staff recommends that the City Council conduct a public hearing, deliberate,
and adopt the resolution amending the encroachment fee schedule.

AMENDING RESOLUTION NO. 96-84 AND 51-89 ADOPTING FEES FOR MUNICIPAL SERVICES
(MODIFYING EXHIBIT 4 ENCROACHMENT FEES)
WHEREAS, Resolution 96-84 establishing fee schedules for City
Service was adopted by the City -Council on August 27, 1984; and
WHEREAS, Resolution 51-89 amending the fee schedule for
encroachment permits was adopted on April 24, 1989; and
WHEREAS, it is necessary to modify the fee schedule for
oversize/overweight vehicles to comply with the new provisions of State Law;
and
WHEREAS, said fees do not exceed the estimated reasonable cost of
providing the associated services;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin does hereby approve the revision of said items in the fee schedule
for encroachment permits, which is attached hereto and shall be considered as
a part of this Resolution.

SEC. 2. Section 35795 of the Vehicle Code is amended to read:
35795. (n) The Department of Trnnsportntion may clinrge a fee I _
for the Issuance of permits purstinnt to this article.
The fee schedule established by the Department of Transportation
pursuant to this section shall be established by a regulation adopted
pursuant to Chapter 4.5 (commencing with Section 11371) of Part I
of Division 3 of Title 2 of the Government Code, and shall not
produce a total estimated revenue In excess of the estimated total
cost to that department for administering this article. Special -
services necessitated by unusually large or heavy loads requiring
engineering Investigations, or other services, may be billed
separately for ench permit.

Attention Permit Units
Gentlemen:
The provisions of AB 1849 required development of a standard
Transportation Permit Application form and placed a limit on city
and county permit fees not to exceed those charged by California
Department of Transportation.
During December 1989 and January 1990, eight meetings were held
throughout the State to present a proposed standard application
form. The meetings were attended by 170 representatives
involving the Transportation Permit activities in 97 cities and
35 counties. The verbal input at the meeting was generally
supportive of the proposed standard permit application.
Following the meeting, 55 written responses were received
concerning the form. There were 52 comments ranging from very
favorable to neutral while there. were 3 negative or uncertain
comments. There were requests for further training in the use of
the form and applicable sections of the California vehicle Code.
In response to these requests, Caltrans ' Office of Permits has
conducted several seminars at various locations with more to
come.
The verbal response in regard to the limits on permit fees
generally indicated that under AB 1849 the fees allowed will not
equal the costs some agencies incur to provide the service. Of
the 55 written responses on the fee structure, there were 30 .
agencies with fees less than the fees charged by .Caltrans and 25
which charge. more.
On the basis of discussions, we have made a number of changes to
the standard permit application form and adopted it for uniform
statewide .use. A copy is enclosed for your use in reproducing
your supply of forms. Each jurisdiction should add their
official name or title.
For information to those who were unable to attend the meetings,
Caltrans requires permittees to submit the application on our
self carbon 3-part form with information on the permittee, load
and vehicle filled in. Caltrans fills in the routing and allowed
times for movement, adds "permit conditions" , number. stamps the

. form and issues it, as a signed valid permit. A copy. of the
form, as Caltrans has been using it, with directions for filling
it out is attached in the hope it will be instructive to those
who missed the meetings. A copy of our "permit conditions" ,
which is attached to all of our permits, is also included for
your information.
Our fees for permits which are contained in California State
Administrative Code, Title 21, Chapter 4, Subchapter 7,
Section 1411. 3 are currently $15.00 for a single trip and riders
and $70. 00 for an annual or repetitive permit.. These fees were
established by' an "administrative law" process. Fees set by
Caltrans and local agencies are limited, as stated in California
Vehicle Code, Section 35795, not to exceed the estimated amount
to cover the cost of administering the permit program activities.

INSTRUCTIONS FOR COMPLETION OF TRANSPORTATION PERMIT FORM
*Sections to be Completed by Applicant
*1. Name of company or person permit is issued to.
*2 . Address of company or person permit is issued to.
*3 . Street address or P. 0. Box, city, state and zip code.
*4 . Complete phone number of company/person named on permit where
additional information may be obtained and/or where the area
of responsibility lies.
*5 . Must be completed on mobile home move or show as N/A.
*6 . Check correct box for move requested.
*7 . Complete description of load or equipment to be moved. Where
appropriate, use specific model number or serial numbers to
complete identification.
*8 . Show hauling vehicle description using attached list when
applicable. Serial numbers should be shown for vehicles which
have an inspection report.
*9 . This shall apply to all two-vehicle combinations, and all
towed loads where a semitrailer is used. Write 1140 ' max. "
unless the transporter requests something different. '
Dimensions in excess of legal shall be allowed when the load
justifies it. Annual and single trip permits for manufactured
housing shall show the word "variable" .
*10. The word "legal" per CVC 35401 shall be used for all
combinations except when the load justifies a dimension
greater than "legal" . Permits for single vehicles shall show
legal or actual dimension.
*11. Show "legal" if 14 ' or less, otherwise show actual height.
Show actual height for manufactured housing.
*12 . Show legal if 816" or less, otherwise show actual width.
*13 . Show legal or actual length if longer than legal .
*14 . "Legal" may be used. If there is doubt as to what legal
overhang is, use the actual dimensiol given by the
transporter. Actual overhang may be needed at times to
determine if a :pilot car is required.

*15 . Must be comp, ad for all overweight loan Number of tires
must be correct for weight requested. If more than 9 axles
are used put the spacings, etc. ; on a rider (free) form.
*16 . Allows use of the words "min" and "max" at the appropriate
times for axle spacing. These words shall not be used unless
it is your intent to exempt the applicant from the exact
dimensions. Exact dimensions shall be used for all fixed load
permits and permits issued for loads to be moved from a
special program such as large scrapers (i. e. , 651's and 6661s)
shall show dimensions within the limits of the special scraper
program.
*17 . Must be completed for all overweight loads. Axle width must
correspond to the weight.
*18 . Use one of the following: 1) legal, 2) weights given by the
transporter, 3) weights allowed by Caltrans inspection sheets
or 4) weights allowed by actual spacing shown on plates 25-3 ,
25-4 , 25-5 . Authorized weight can not exceed tire capacity.
*19 . Show origin of load (city or area) . The on ramp, cross
street, origin adress is to be supplied on the route
requested.
*20. Must show destination of move(city or area) . The off ramp,
cross street, destination address. is to be supplied on the
route request.
*21. Must show number of trips authorized.
22 . Must show routes move will take (if routing will not fit in
space, attach rider) , check to be sure routing information is
clear and makes sense. Spell out names of roads, streets or
ramps to help prevent driver error. Asterisks shall be used
where appropriate to indicate that authorization to use the
State highway terminates and permits for city and/or county
roads are required. It should be used where appropriate at
the beginning of the route or end of the route, and anytime
a detour is indicated that requires the use of city or county
routes.
23 . Mark "yes" or "none" . If "yes" , indicate number of pilot cars
and clearly identify where needed.
24 . Mark and list all attachments required on permit.
*25 . Mark applicable box and fill in amount. Fee must correspond
to number of trips authorized (item 21) times per permit
($15 . 00) and must show party to be billed. if other than

permittee, e. permit service annual rmit fee shall show
$70 . 00.
*26 . Must be signed on all permits. Certification applies to
mobile home moves only.
*27 . Must be dated on all permits.
28 . Fill in all spaces and check appropriate boxes. If the permit
is valid on the day it is written the actual time written
shall be used. I.e. : if issued at 2 ;00 p.m. show it valid
at 2 ; 00 p.m. If the permit is to become valid any other day
than the day it is written the word sunrise may be used
instead of actual time. If the effective day is the following
day and night movement is authorized show 0001 a.m. as the
authorized starting time. Use footnote for special conditions
for night moving. (3 ;00 a.m. to 6 ;00 a.m. ; 0001 a.m. to 0500
a.m. only, etc. )
29 . Must be signed by Caltrans representative. Must be clearly
stamped with district/permit number. Make sure the number is
legible. All stamp machines shall use the same size letters
and identical layout. Do not stamp over signature. Initials
or first name only shall not be used. Last name of Caltrans
representative is required.
30 . Must have seal if faxed to an :..authorized receiving station.
Facsimile permits are not valid without the seal and signature
of authorized permit service representative.
*31. Clearly mark the sending station number. Applications by the
transporter shall show N/A.
*32 . Clearly mark. the receiving station number. Applications by
the transporter shall show N/A.
Facsimile permits must have numbers 30, 31, and 32 completed before
release to driver/transporter.

Authority:
Under the appropriate authority of Division 15,Chapter 5,Article 6 of the California Vehicle Code(CVC),the Department of Transportation may,at its
discretion,issue special permits to operate or move a vehicle or combination of vehicles or special mobile equipment of a size or weight of vehicle or load
exceeding the maximums specified in the CVC. Except as specifically provided herein, the requirements of the CVC, including vehicle registration
requirements, signing(CVC 27900) and other applicable laws, must be complied with in all particulars.
Possession of Permit:
This permit shall be carried in the vehicle to which it refers at all times while the vehicle is being moved within the highway limits,and shall be open to
inspection by any peace officer,traffic officer,authorized agent of the Department of Transportation,or any other officer or employee charged with the
care and protection of such highways(V.C.35783).
Permit Conditions
