FINANCIAL STATEMENT: Funding in the amount of $1 ,500 was included as part of the approved 1990-91 Budget. DESCRIPTION: As part of the 1990-91 Budget deliberations, the City Council considered a request for funding from the Livermore Amador Valley Transit Authority. (LAVTA) LAVTA provides Dial-A-Ride services to elderly and handicapped residents. LAVTA began providing the service to Dublin residents on July 1 , 1988. The agreement between the City and LAVTA provided for a City contribution for Fiscal Year 1988-89 only. The City Council approved an appropriation of $1 , 500 as part of the adopted 1990-91 Budget. These funds will assist LAVTA in meeting requirements for fare box recovery. Staff has prepared a proposed amendment to the original agreement. Staff recommends that the City Council approve the amendment and authorize its execution. ---------------------------------------------------------------------- COPIES TO: ITEM NO. FIRST AMENDMENT TO AGREEMENT DATED March 28, 1988 Between the City of Dublin and Livermore/Amador Valley Transit Authority Providing a City Contribution for Fiscal Year 1990-91 This Agreement is entered into this day of 1990 by and between the Livermore/Amador Valley Transit Authority (hereinafter referred to as "AUTHORITY") and the City of Dublin, a municipal corporation (hereinafter referred to as "CITY") . WHEREAS, the AUTHORITY and the CITY entered into an agreement dated March 28, 1988, whereby the AUTHORITY assumed operation of City's Dial-A-Ride Paratransit Service for special transportation of elderly and handicapped persons; and WHEREAS, Section 2 of Said Agreement limited the City of Dublin's obligation to provide funding to a contribution for Fiscal Year 1988-89 only; and WHEREAS, PUC 99268.5 and MTC Resolution Number 1209 set a fare local match ratio of 10 percent for operators qualifying as "Special Transit Service" claimants; and WHEREAS, the AUTHORITY cannot meet the 10 percent fare local match ratio through passenger fares alone; and WHEREAS, the Dublin City Council appropriated a contribution to the AUTHORITY of $1 ,500 in the approved Fiscal Year 1990-91 Budget adopted on June 26, 1990 for the Dublin Dial-A-Ride Service. NOW, THEREFORE, the parties agree as follows: A. Section 2 of the agreement dated March 28, 1988 shall be amended to read as follows: Section 2. The CITY shall provide a contribution to AUTHORITY for Fiscal Year 1990-91 in an amount of One Thousand Five Hundred Dollars ($1 ,500) . This funding shall be used by AUTHORITY to conform to the PUC mandated fare local match ratio of 10 percent for the Dublin Deal-A-Ride Service. B. A new Section 10 shall be added as follows: Section 10. This agreement may be amended as agreed to in writing by both parties. Box 2340 MIN Dublin, CA 94568 Q�/ / Dear Richard: Vi At a special meeting held on May 24, 1990, LAVTA's Board of General Manager aJ Directors approved a motion requesting that the City Councils of V5:br '�' ' Dublin and Livermore be asked to contribute $1,500 and $6,000 C:780 respectively for Dial-A-Ride service based upon use of the service in each City. The total amount of $7,500 would help cc: Councilmember Linda Jeffery LAVTA conform to MTC and PUC requirements. The alternative to Councilmember Peter Snyder City contributions would be a fare increase (an alternative "'? Y"y rejected by the Board as being prohibitive to the riders) or a ;;�,;> reduction of service. Contributions from the Cities of over ) $7,500 would translate to more service available during the next ' . year. The Livermore/Amador Valley Transit services provides Dial-A-Ride Paratransit service to Elderly and Handicapped persons residing in the Cities of Dublin and Livermore. The funding for this service to LAVTA consists of the State of California Transportation Development Act Article 4.5 funds, and fares paid by the passengers. Under the provisions of the Public Utility Code 99268.5 and Metropolitan Transportation Commission's Resolution 1209, it is required that LAVTA's Dial-A-Ride Paratransit service recover a minimum of ten percent (10%) of operating costs through fares paid by the users and/or through city contributions. LAVTA faces an estimated shortfall of $27,500 for this service during FY 1990-91. Twenty thousand dollars will be made up by funds allocated to fixed route, but LAVTA still needs $7,500 from a local source (users or city contribution) . If LAVTA does not meet the ten percent (10%) Farebox requirements, future year TDA Article 4.5 Paratransit funds would be reduced and LAVTA would be forced to reduce iA the following year.
