Address Files (2) [dnln408] 1p, - Project Planner Applicant/Property Owner single family project site (Annexation No. 7) to the City of Dublin (see Attachments 1 & 2 ) . To maintain consistency with LAFCO' s approval of both annexations, Staff was informed by the City Attorney that each of the above mentioned resolutions should be amended to include ordering the annexation of the project sites to the Dublin San Ramon Services District (DSRSD) . In addition, the conditions specified in the DSRSD resolutions making applications for annexations of the Donlan Canyon and Hansen Hill/Bren Co. project sites to DSRSD were inadvertently omitted from LAFCO' s resolutions approving these annexations (see Attachments A-2 and B-2 ) . According to the City Attorney, the City Council is allowed to correct this clerical error made by LAFCO with written consent from LAFCO (see Attachment 5) . The attached draft resolutions (Exhibits A and B) correct these minor clerical errors and approval of the draft resolutions will not affect the previous approvals ordering the annexations of the Hansen Hill/Bren Co. and Donlan Canyon project sites to the City of Dublin. Staff recommends adoption of the attached draft resolution (Exhibit A) amending City Council Resolution No. 115-90 ordering the annexation of the Hansen Hill/Bren Co. project site to the City of Dublin and . to the Dublin San Ramon Services District and draft resolution (Exhibit B) amending City Council Resolution No. 150-90 ordering the annexation of the Donlan Canyon project site to the City of Dublin and to the Dublin San Ramon Services District. -2- RESOLUTION NO. - 91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING CITY COUNCIL RESOLUTION NO. 115-90 RELATING TO ANNEXATION NO. 7 HANSEN HILL/BREN CO. PROJECT SITE WHEREAS, the Local Agency Formation Commission of the County of Alameda adopted its Resolution No. 90-12 on July 21, 1990, making determinations and approving the proposed reorganization, consisting of annexation of territory described in Attachment A-1 attached hereto and by this reference incorporated herein to the City of Dublin and to the Dublin San Ramon Services District; and WHEREAS, the terms and conditions of annexation as approved by the Local Agency Formation Commission are as follows : 1) Correction of the map and description as may be required by the County Surveyor; and 2 ) designate the City as the conducting authority for the reorganization and authorize the City to proceed without notice or hearing; and WHEREAS, the reason for this annexation is to provide for consistent and orderly development to insure that essential municipal services are provided; and WHEREAS, the regular County assessment roll is utilized by the City; and WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of the City; and WHEREAS, the Local Agency Formation Commission has authorized the City Council to approve this Annexation No. 7 without notice and hearing; and WHEREAS, the City Council, by Resolution No. 115-90, adopted on August 27 , 1990 , ordered the annexation of the territory to the City but, due to a clerical error, omitted approval of annexation of such territory to the Dublin San Ramon Services District; and WHEREAS, the Dublin San Ramon Services District Resolution No. 4- 90 , making application for annexation included certain conditions ; and WHEREAS, the purpose of this resolution is to amend Resolution No. 115-90 to provide for the annexation of the territory to the Dublin San Ramon Services District as well as to the City and to include the conditions set forth in the District ' s Resolution No . 4- 90, a copy of which is attached hereto as Attachment A-2 and made a part hereof, pursuant to Government Codi Section 56854 and authorization from the Executive Officer of LAFCO. EXHIBIT A NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby order the territory (designated as "City of Dublin Annexation No. 7 Hansen Hill/Bren Co. Project Site" ) described in Attachment A-1 attached hereto and incorporated herein by reference annexed to the City of Dublin and the Dublin San Ramon Services District subject to the conditions set forth in Resolution No. 4-90 adopted by the Board of Directors of the Dublin San Ramon Services District (Attachment A-2) , and directs the City Clerk to transmit a certified copy of this resolution with applicable fees required by Section 54902 . 5 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Alameda County, pursuant to the provisions of Division 3 Cortese-Knox Local Government Reorganization Act of 1985 Government Code 56000 et seq. Application is hereby made for annexation of the Annexing Territory to the District pursuant to the Act, subject to the proposed terms and conditions in paragraph 2 specified, and this Board does hereby request that proceedings be conducted for said annexation pursuant to the Act. 2 . The following conditions are herebv recuested to be imposed upon_ the annexation: a. The owner of the Annexing Territory (the "Owner" ) shall pay all costs of annexation including , but not li�ilted to, the annexation fee established by the District to defray the District ' s costs incurred in processing the application for annexation , costs of publication and mailing of notices , and all other costs , fees and expenses related to the Annexation proceedings . b. The Owner shall , at the Owner ' s cost and expe'Se, convev all necessary and appropriate easements , or other interests in real property to the District for the installation, operation , maintenance , repair and replacement of any and all utility facilities for District' s service to be installed by said Owner or by the District in connection With development and improvement of the Annexing Territory. Without limitation upon the foregoing , the O:•mer Stall convey an easement for a Water transmission line as Specified by District for District ' s Plater SVSte::i ZONE 3 , 3 DE'S:. The findings of the City of Dublin, as lead acency, made pursuant to Resolution No. 19-89 entitled "A Resolution. Making Findings Pursuant to California Environmental Quality Act (CEQA) and Certifying Final Environmental Ironpact Report , ;-17ith Statement of Overriding Considerations (General Plan Amiendme nt - PA 87-045 Hansen Mill Rand) " , adopted February 27 , 1989 and made pursuant to Resolution NO. 127-89 , entitled , "A Resolution etckinc Findings Pursuant to Cali forr.i a Environmental Quality Act (CEQ;_) and Approving tIiticated Declaration (Hansen Hill Ranch Project) " , adooted November 27 , 1989 by the City Council cf the City of Dublin are hereby adopted by this Board and incorporated herein by reference . 5 DES:C - ')2/15/90 (009/26) 2/20/90R 5 , The General Manager is hereby authorized and directed to file a Notice of Determination pursuant to Section 15096 of the California Code of Regulations ("State CEQA Guidelines" ) with respect to the annexation proposed hereby. 6 . Ci, FILE I?; T,•_ CFFIC_ C= Sc.110ES DISTRICT FEB 2 6 f' 6 RESOLUTION NO. - 91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING CITY COUNCIL RESOLUTION NO. 150-90 RELATING TO ANNEXATION NO. 9 DONLAN CANYON PROJECT SITE WHEREAS, the Local Agency Formation Commission of the io9u9nOty of Alameda adopted its Resolution No. 90-28 on November 8 , making determinations and approving the proposed reorganization, consisting of annexatiothos reference incorporated herein Attachment thel attached hereto and by City of Dublin and to the Dublin San Ramon Services District, and WHEREAS, the terms and conditions of annexation as approved by the Local Agency Formation Commission are as follows : 1) Correction of the map and description as may be required by the County Surveyor; and 2 ) Designate the City as the conducting authority for the reorganization and authorize the City to proceed without notice or hearing; and WHEREAS, the reason for this annexation is to provide for consistent and orderly development to insure that essential municipal services are provided, and WHEREAS, the regular county assessment roll is utilized by the City; and WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of the City; and WHEREAS, the Local Agency Formation Commission has authorized the City Council to approve this Annexation No . 9 without notice and hearing; and WHEREAS, the City Council , by Resolution No . 150-90 , adopted on December 10 , 1990, ordered the annexation of the territory to the City but, due to a clerical error, .omitted approval annexation of such territory to the Dublin San Ramon Services District; and WHEREAS, the Dublin San Ramon Services District Resolution No. 46-90 , making application for annexation included certain conditions ; and WHEREAS, the purpose of this resolution is to amend Resolution No. 150-90 to provide for the annexation of the territory to the Dublin San Ramon Services District as well as to EXHIFBIT the City and to include the conditions set forth in the District ' s Resolution No. 46-90 , a copy of which is attached hereto as Attachment B-2 and made a part hereof, pursuant to Government Code Section 56854 and authorization from the Executive Officer of LAFCO. NOW, THEREFORE, BE IT RESOLVED that the City-. Council of the City of Dublin does hereby order the territory (designated as "City of Dublin Annexation No. 9 Donlan Canyon Project Site" ) described in Attachment B-1 attached hereto and incorporated herein by reference annexed to the City of Dublin and the Dublin San Ramon Services District (Attachment B-2) , subject to the conditions set forth in Resolution No. 46-90 adopted by the Board of Directors of the Dublin San Ramon Services District, and directs the City Clerk to transmit a certified copy of this resolution with applicable fees required by Section 54902 . 5 of the Government Code to the executive officer of the Local Agency Formation Commission of Alameda County, pursuant to the provisions of Division 3 Cortese-Knox Local Government Reorganization Act of 1985 Government Code. 56000 et seq. C. §§56000 et seq.) provides that an affected local agency, as therein defined, may propose a change of organization by the adoption of a resolution of application by the legislative body thereof; and WHEREAS, the Dublin San Ramon Services District ("District") is a community services district organized and existing pursuant to the Community Services District law (Govt. C. §61000 et seq.). located in the Counties of Alameda and Contra Costa, California; and WHEREAS, for purposes of the Act, Alameda County, California, is the "Principal County" as said term is defined in the Act; and WHEREAS, the District is an affected local agency with respect to the proposed change of organization hereinafter described; and WHEREAS, the change of organization so proposed would annex the territory described in Attachment A (the "Annexing Territory"), currently located in the unincorporated area of Alam�,?a County, to the District; and WHEREAS, pursuant to Resolution No. St-90 (Exhibit A) entitled "A Resolution of the Cite Council of the City of Dublin - Resolution of Annexation Application (PA89-125 Donlan Camon Reorganization)", adopted by the Cite Council of s::id City on June 25, 1990, application has been by said City for a reorganization pert:tinin_, to the ;\nnexing Territory, which rcor,anizauon would provide for detachment of said Territory from the fllauteda CUUnt1'Structural Fire District and annexation thereof to the City of Dublin; and 1 Madmt - a WHEREAS, the Annexing Territory is uninhabited territory as that term is defined in the Act (Govt. C. §56046); and WHEREAS, the exterior boundaries of the Annexing Territory are depicted on Attachment B hereof, incorporated herein by this reference; and WHEREAS, this Board proposes that the annexation be made subject to the terms and conditions hereinafter described; and WHEREAS, the change of organization is proposed at the request of the owner of the Annexing Territory; and WHEREAS, the plan for services for the Annexing Territory is set forth in Attachment C, incorporated herein by reference; and WHEREAS, an environmental impact report and mitigated negative declaration have been prepared by the City of Dublin, as lead agency, pursuant to the California Environmental Quality Act (Pub. Res. C. §§21000 et seq.), which report and declaration have been reviewed and considered by this _ Board prior to making this application; and WHEREAS, the proposed annexation is consistent with the sphere of influence of the District; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Dublin San Ramon Services District, a public agency in the Counties of Alameda and Contra Costa, California, as follows: 1. Application is hereby made for annexation of the Annexing Territory to the District pursuant to the Act, subject to the proposed terms and conditions in paragraph 2 specified, and this Board does hereby request that proceedings be conducted for said annexation pursuant to the Act. 2. The following conditions are hereby requested to be imposed upon the annexation: a. The owner of the Annexing Territory (the "Owner") shall pay all costs of annexation including, but not limited to, the annexation fee established by the District to defray the District's costs incurred in processing the application for annexation, costs of publication and mailing of notices, and all other costs. fees and expenses related to the Annexation proceedings. b. The Owner shall, at the Owner's cost and expense, convey all necessary and appropriate easements, or other interests in real property to the District for the installation, operation, maintenance, repair and replacement of any and all utility facilities for District's services to be installed by said Owner or by the District in connection with development and improvement of the Annexing Territory. Without limitation upon the foregoing, the Owner shall convey an easement for a water transmission line, as specified by District for District's Water System Zone 3, and Water System Zone 4, which line shall be constructed in conjunction with the first stage of development of the Annexing Territory. C. An and all utility facilities for District's services for the development of the Annexing Territory shall be installed at the cost and expense of the Owner in accordance with. and subject to, District's Codes, Rules, standards and specifications pertaining thereto. d. The Owner shall pay all charges, fees, costs and other expenses pertaining to the installation, construction, connection to, and use of District's utility facilities in accordance with District's Codes, Rules, and Regulations, as the same now exist or may from time to time be amended, with respect to development and improvement of Annexing Territory. Notwithstanding the foregoing, in the event District's Codes, Rules, and Regulations, at the time of annexation or thereafter, do not expressly establish such charges, fees, costs and other expenses for the provision of water utility facilities for any portion, or all, of the Annexing Territory situated at 740 feet elevation above mean sea level, the cost of such water utility facilities shall be borne by Owner, Owner's successors, assigns, heirs, administrator, or transferees in proportion to the benefit conferred upon said lands by said utilities in such manner or form as may be approved by District. e. The AnnexinL Territory, upon annexation, shrill be subject to liability, if any, for payment of all or any part of principal, interest t:t_d other amounts which shall become due on account of any part of any outstanding bonds or other evidences of indebtedness of the District, 3 which may become due, or which are authorized and thereafter may become due within the District. f. Services to be provided by the District shall include water and sewer service and such other services, if any, as the District may, in its discretion, extend.to the Annexing Territory pursuant to its authority. 3. The plan of services set forth in Attachment C, which is identical to the plan of services submitted by the City of Dublin in its application above referenced, is hereby adopted; provided, however, that said plan shall be deemed modified to the extent provided by the conditions set forth in paragraph 2 hereof with respect to the obligation of the Owner to finance construction of, and provide property interests for services to be furnished by the District. 4. The findings of the City of Dublin, as lead agency, made pursuant to Resolution 77-90 (Exhibit B) entitled a resolution of the City Council of the City of Dublin adopting a "Negative Declaration of Environmental Significance for PA89-125 Donlan Canyon." Adopted June 25, 1990 by the City Council of the City of Dublin finding that the negative declaration is complete and adequate is hereby adopted by this Board and incorporated herein by reference. 5.
