A regular meeting of the City Council of the City of Dublin was held
on Monday, June 24, 1991, in the Council Chambers of the Dublin Civic
Center. The meeting was called to order at 7 : 37 p.m. , by Mayor Pro
Tempore Jeffery.

PRESENT: Councilmembers Burton, Howard, Jeffery and Moffatt .
ABSENT: Mayor Snyder
PLEDGE OF ALLEGIANCE
The Mayor Pro Tempore led the Council, Staff and those present in the
pledge of allegiance to the flag.
Problems With Cats (300-20)
John Garrison, 7588 Knollwood Place addressed the Council and stated
he felt the community is getting overrun with cats. He can't open his
front door without being overrun. His court has over 12 cats on it
and something needs to be done.
Mr. Ambrose advised that the City can talk to Animal Control.
Mr. Rankin advised that there is a limit of 3 adult cats per
household; otherwise an Animal Fancier's Permit is required. There is
no leash law for cats. He questioned if the cats are strays.
Mr. Garrison responded that some of them might be, but not all. They
tear up his wife's flowers, get on his roof and generally make messes.
Mr. Ambrose advised that Staff will look into this situation and
report back to Mr. Garrison.

On motion of 'Cm. Moffatt, seconded by Cm. Howard, and by unanimous
vote (Mayor Snyder absent) , the Council took the following actions:

Mayor Pro Tempore Jeffery requested that the City Manager's Employment
Agreement be removed from the Consent Calendar and considered at a
future meeting. She advised that she is a member of the negotiating
committee and one remaining issue still needs to be resolved (600-30) .
PUBLIC HEARING - NO U-TURN ON DUBLIN BOULEVARD
BETWEEN GOLDEN GATE DRIVE AND REGIONAL STREET (590-20)
Mayor Pro Tempore Jeffery opened the public hearing.
Public Works Director Thompson advised that this is the second reading
of a proposed ordinance related to signs that were installed several
years ago as a safety measure, but which were not included in the
Traffic Code.
No comments were made by members of the public relative to this issue.

ASSESSMENT DISTRICT 83-1 1991-92 LEVY OF ASSESSMENTS (360-50)
Mayor Pro Tempore Jeffery opened the public hearing.
Public Works Director Thompson advised that in 1983 , the City formed a
Citywide Street Lighting Assessment District to replace the County of
Alameda Lighting Service Area. The 1991-92 District cost is expected
to increase approximately 12% over last year due to increases in
energy costs and the number of street lights. The assessment to
individual property owners is not anticipated to increase by the same
percentage because of the increase in the number of housing units.
Last year's assessment for a single-family house was $18.24 and Staff
estimated that the 1991-92 assessment would be approximately $19. 00.
No comments were made by members of the public relative to this issue.

RESOLUTION NO. 55 - 91

PUBLIC HEARING-ADOPTION OF FINDINGS TO GRANT VARIANCE TO SECTIONS
OF UNIFORM BUILDING CODE FOR GAZEBO ON AMADOR PLAZA ROAD (450-40)
Mayor Pro Tempore Jeffery opened the public hearing.
City Manager Ambrose advised that on June 10, 1991, the Council
granted a variance to Sections 2517 (b) -7 and 3203 (b) of the Uniform
Building Code to Enea Properties related to a gazebo and instructed
Staff to prepare a resolution making the necessary findings.
Cm. Burton stated since there was no time limit indicated in the
Resolution, he assumed that the gazebo can stay until the street is
built.
Mr. Ambrose advised that this was correct.
Mayor Pro Tempore Jeffery pointed out that the fire retardant has to
be reapplied every 2 years, however.
Mr. Ambrose also advised that they still have to come in for a
Planning Variance to permit this on an ongoing basis. This will be
the second step, and it is an administrative process.
City Attorney Silver explained the process. The right-of-way lines
prohibit buildings in the right-of-way, but they can apply for a
variance. This will not come before the City Council, except on
appeal.

AMENDMENT TO AGREEMENT WITH
MCE CORPORATION FOR PUBLIC WORKS MAINTENANCE (830-60)
Public Works Director Thompson advised that MCE Corporation has
provided maintenance services under contract to the City since July 1,
1984 . They have a multi-year contract, and the contract is not being
reviewed this year. On July 1, 1990, the City entered into an
agreement covering a 3-year period with MCE Corporation which will
expire on June 30, 1993 . An amendment is proposed for Fiscal Year
1991-92 which would establish a Schedule of Work and revise the labor
and equipment rates.
Mr. Thompson advised that it is anticipated that MCE will spend
$38, 100 less than they were authorized to spend in Fiscal Year 1990-
91. The estimated contract costs for maintenance services provided by
MCE for FY91-92 total $1, 024, 600 which is approximately $78, 900 more
than last year. Mr. Thompson explained the factors involved in this
increase.
Cm. Moffatt stated he is very happy to have MCE here in Dublin and
felt they have been doing a grand job.
Cm. Burton questioned how the savings of $38, 000 was calculated on
last year's budget. He asked if this is due to efficiency or over
budgeting.
Mr. Ambrose stated that part of it was due to the drought. We did not
have a normal winter because of the drought.
Mr. Rankin advised that the other major contributor was the fact that
we anticipated that Shannon Park would be in service sooner and also
Alamo Creek Park.

have done a commendable job.

TJKM TRANSPORTATION CONSULTANTS (590-10)
Public Works Director Thompson advised that Traffic Engineering
services are provided to Dublin by TJKM Transportation Consultants.
They originally functioned as a subcontractor under the Santina &
Thompson agreement, but in 1985, the City entered into separate
agreements with both Santina & Thompson and TJKM.

Mr. Thompson outlined the services provided. TJKM provides traffic
engineering services generally in the areas of private development
review, Capital Improvement design and construction review. In
addition, they perform traffic engineering studies as a result of
citizen or City requests. Mr. Thompson advised that these functions
have been performed in a timely and professional manner.
Approximately 50 studies were made this year as a result of Staff or
resident requests.
TJKM proposes to continue to charge the City at a reduced (804) hourly
rate for general traffic studies. This reduced rate type of work
amounted to 68% of TJKM's charges for the 1989-90 Fiscal Year and an
estimated 56% for the 1990-91 Fiscal Year. The remainder was expended
on capital projects and on private development review, for which the
City is reimbursed by developers.
Mr. Thompson advised that during 1990, TJKM provided their services
utilizing 16 different employee classifications. TJKM has requested
hourly rate increases which average 6. 1%, which is in line with
previous years' increases.
Mr. Thompson advised that City Staff anticipates a decrease in TJKM's
overall charges due to: 1) the City hired a full-time Senior Civil
Engineer with a Traffic Engineering background; 2) proactive approach
to potential problems since the formation of the Traffic Safety
Committee; 3) private development review decrease due to economic
trends; and 4) the Downtown Traffic Impact Fee will be in effect.
TJKM's evaluation for Fiscal Year 1990-91 indicated the need for
improvement in the areas of signal operation and timing and
construction traffic control.
Cm. Moffatt questioned the amount to be spent this year and expressed
concern over whether we are looking at this realistically.
Mr. Thompson advised that they did quite a few studies this past year.
They have also done a lot of impact fee studies on an individual
basis. Hopefully, the City's Senior Civil Engineer will be able to
take over some of the traffic engineering duties in certain cases.
Mayor Pro Tempore thanked Mr. Kinzel and pointed out that he didn't
have to wait until the end of a long meeting this year for his
contract review.

ANNUAL CONTRACT REVIEW AND
EXTENSION OF AGREEMENT FOR STREET SWEEPING SERVICES (820-30)
Public Works Director Thompson advised that the City contracts with
A-1 Sweeping for street sweeping and litter pickup services. The term
of the existing contract is 2 years, with the option to renew for 2
additional 1-year extensions. The first 1-year extension ends on
June 30, 1991.
Mr. Thompson advised that sweeping of residential streets is performed
twice a month. Commercial streets and intersections are swept once a
week. Downtown trash cans are emptied once a week and extra pickups
may be requested during heavy use. A-1 empties only the City's cans;
the Livermore-Amador Valley Transit Authority is responsible for the
bus shelter cans and they contract with a separate firm for pickup.
In addition, A-1 provides twice-monthly sweeping of parking lots at
Alamo Creek Park, the Civic Center, and the Dublin Sports Grounds.
Mr. Thompson advised that fewer service requests have been received to
date for street sweeping in FY90-91 than in previous years. A-11s
response on emergency callouts has been good, with service provided
within an hour in most cases. They have responded to service requests
within 24 hours or less in all cases, as required by the contract. In
last year's contract review, it was reported that invoices frequently
needed correction. This problem has been resolved, and recent
invoices have been correct.
Since this is the final year of the present contract, Mr. Thompson
advised that Staff will perform an in-depth survey of sweeping options
during the year and make recommendations to the City Council at a
later date with regard to a new contract. Staff suggested that the
term of the contract be lengthened to 5 years and that the "optional
extension" clause be dropped since the City has the ability to
terminate a contractor if performance is poor.
In accordance with the terms of the contract, A-1 Sweeping has
submitted a cost increase proposal. The only request is an increase
of the callout rate from $45 to $55 per hour. None of the rates for
other services are proposed to be increased.
Mr. Thompson summarized that this is a very cost effective service for
Dublin.
Cm. Burton asked if there was any plan to give A-1 a more definite
contract length in the future.
Mr. Thompson stated he hopes that the City will be able to do this.
A-1 is, by far, the finest street sweeping contractor the City has
had.
Cm. Burton felt the City should at least give him a longer contract.

Mr. Thompson advised that Staff will probably come back with this
recommendation next year.
Cm. Moffatt stated he certainly would be amenable to allowing a 5 year
contract.

APPROVING AMENDMENT TO AGREEMENT WITH A-1 SWEEPING
FOR STREET SWEEPING & TRASH RECEPTACLE PICKUP SERVICES
ANNUAL CONTRACT REVIEW
1991-92 VECTOR CONTROL SERVICES AGREEMENT (560-50)
Assistant to the City Manager Texeira advised that since March, 1988,
the City has contracted with Alameda County on an annual basis for
vector control services. The City contracts directly with the County
in lieu of participating in the Countywide Vector Control Services
District and funds services through the General Fund rather than
assess residents.
Ms. Texeira advised that the County estimates providing the same
number of service hours to the City in 1991-92 . Projected service
hours, as well as activities will remain consistent with those
performed in 1990-91.
Ms. Texeira advised that if the Council chooses to continue to
contract directly with Vector Control for services, then Staff
recommended funding the estimated program cost of $27, 796 for FY91-92 .
This level represents a 5. 8% increase over FY90-91. The current
agreement provides for an automatic renewal of services. The proposed
amendment provides for a slight increase in the number of Dublin
"equivalent benefit units" , as well as an increase in the "benefit
assessment rate" .
Ms. Texeira presented other service options and advised that the City
could consider direct participation in the Countywide Vector Control
Services District. Dublin is presently one of only three Alameda
County cities not participating in the District. If the City were to
participate in the District, the only difference would be that the
property owners rather than the City would be responsible for paying
for the cost of service.
Cm. Moffatt questioned the difference between the Mosquito Abatement
District and the Vector Control Services District.
Harry A. Scott, District Manager, stated that the Mosquito Abatement
District handles mosquitos only and they handle all other vectors. A
vector is any insect or animal that can cause disease.

Cm. Moffatt asked if they handled cats.
Mr. Scott stated they are very interested in cats. Wild cats are
definitely a public health problem; they spread fleas and cause a
nuisance. They are always fearful of rabies. You never know when the
first case of rabies is going to occur.
Mr. Scott explained that they first put together the Vector Control
Services District is 1984 . They hope that Dublin will come into the
District and become part of the family.
Cm. Burton questioned the process to join the District.
Mr. Scott advised that each City Council must announce their intent
and all they need is a majority vote. Dublin is considered to be in
the sphere of influence of the District so Dublin would have to apply
to LAFCO to join. The Board of Supervisors initially asked each city
to join. The costs would be identical to what we are paying now;
however, the costs would show on the tax bill. This is a County
Service Area and twice a year, when the tax bills go out, his office
gets telephone calls asking what vector control is.
Cm. Burton questioned the necessary time frame involved.
Mr. Scott stated that the hearings for the District are coming up in
July. The benefit has been dropped to $3 .96 per unit. He thought
this could be done by the 1992-92 fiscal year if Dublin wished to be
included; however, he would need to check with County Counsel.
Mr. Ambrose advised that because we have to have this kind of an
action approved by LAFCO, and in order to get on the tax rolls by
August, we could not make it for this year. The soonest we could be
included would be Fiscal Year 1992-93 . If this is the Council's
intent, Mr. Ambrose advised that Staff would need to move as soon as
possible because LAFCO has reduced the number of meetings they hold.

Also included in the motion was instruction to Staff to investigate
how to join the District and to bring the information back to the
Council for presentation at a future meeting.

ANNUAL CONTRACT REVIEW - AGREEMENT WITH ALAMEDA COUNTY
TO FUND ADDITIONAL HOURS OF LIBRARY SERVICE (940-30)
Recreation Director Lowart advised that the City's current contract
provides funding for 19 additional hours of Library service per week.
The estimated cost to the City for FY90-91 additional Library hours is
$149, 650. The proposed contract amount for the same level of service
in 1991-92 totals $156, 007, which, represents a 4 . 25% increase over
last year.
Ms. Linda Wood, the new Alameda County Librarian who stated she was
appointed about 5 months ago, addressed the Council. She stated the
partnerships in the County are very important. She was most impressed
with the support that cities are providing for enhanced Library
services. She felt the City of Dublin should be proud of the
additional support they are providing. Ms. Wood stated Rayme Meyer's
leadership at the Dublin Branch should also be acknowledged.
Cm. Burton stated he felt that Dublin seems to be one of the more
progressive cities in providing additional Library services.
Cm. Moffatt questioned if there was anything in the mill regarding
enlarging the Dublin Library.
Ms. Wood advised that an architectural study had just been completed,
and she would like to discuss this with the Advisory Commission
representative and the City Manager before making a presentation to
the City Council as a whole. They want to look at the total long
range growth plans of the City.

APPROVING A CONTRACT WITH THE COUNTY OF ALAMEDA
FOR ADDITIONAL LIBRARY SERVICES DURING FISCAL YEAR 1991-92
ENGINEERING SERVICES CONTRACT REVIEW (830-10)
Assistant City Manager Rankin advised that general professional
engineering services have been provided under contract by the firm of
Santina & Thompson, Inc. , since February, 1983 . Santina & Thompson is
a medium sized civil engineering firm of approximately 60 people,
specializing in municipal clients. Over the years, some of the
engineering functions have been transferred to permanent City
positions. The full-time City positions of Public Works Director/City
Engineer, Senior Engineer, and Public Works Inspector have been
created over the past 3 years. A second City employee in the Public
Works Inspector position is proposed for Fiscal Year 1991-92 .

Mr. Rankin advised that the City has contracted with other engineering
firms for street projects in cases where the other firm may have a
better background for the project because of having worked on adjacent
projects. During the last 2 fiscal years, S&T has designed only one
of the new projects that were let to outside consulting firms.
During Fiscal Year 1990-91, Santina & Thompson provided assistance in
obtaining 4 grants totaling $1, 335, 024 .
Plan check work is sporadic and better done by a contractor with a
pool of people so as not to cause large delays when multiple plan
checks are received at the same time. It is also valuable to have
this work contracted out so that when there is no work to check, the
City would not be maintaining unoccupied Staff. S&T is prohibited
from performing work for private clients in the City Limits and within
the City's Sphere of Influence. Other consultants which have been
awarded design service contracts have not had the restriction related
to performing work for other clients within the City boundaries.
Mr. Rankin advised that the total cost of contract engineering has
tended to decrease over the past 5 years. Within the last 8 1/2 years
that S&T has been on contract with the City, they have designed 43
projects, representing approximately $10, 860, 000 of construction. In
all of these projects, the City has had no contractor claims or
lawsuits nor any private lawsuits which the City has had to defend.
This is an indication of good project plans and specifications.
Mr. Rankin summarized that Santina & Thompson, Inc. , has proposed a
new agreement for Fiscal Year 1991-92 which will consolidate changes
made by amendment over the past 2 years. The proposed agreement also
contains a revised rate schedule and increases the limits of
Professional Liability Insurance from $500, 000 to $1, 000, 000, at no
extra cost to the City. The scope of services has been amended to
eliminate contract positions now being filled by City Staff. Only 2
of S&T's hourly rates are proposed to be changed from the current
schedule: a $7 . 00 per hour (10. 7%) increase for construction
inspector (including vehicle) and a $1. 50 per hour (1%) increase in
the 2-man survey party.
Cm. Burton questioned if the City Council adopts the proposed
Resolution approving the agreement, does it lock in Santina & Thompson
for all the projects listed.
Mr. Rankin advised that we would be seeking design services for the 2
new projects which are the Dougherty Road widening and the Dublin
Boulevard/Silvergate Drive modification. Staff intends to use the RFP
process. Agreements would then need to come back to the Council. If
Santina & Thompson is selected, Staff would come back and advise the
City Council.
Cm. Burton commented that Santina & Thompson has done some very good
work, particularly in receiving grants; however, being from Dublin, he
wanted to give local professionals an opportunity. Staff should look

at ways of bringing in other engineering firms into the process. We
need more participation from local engineering firms.
Cm. Moffatt pointed out that the City has a right to solicit bids
outside of Dublin as well as from local firms.
Cm. Burton clarified that he was simply stating that whenever
possible, we should stress that we like to do business with as many
local people as possible.
Mayor Pro Tempore Jeffery added that the firm must be qualified.
Mr. Ambrose advised that one of the exhibits indicated that the City
has used a number of firms other than Santina & Thompson in the last 4
years. He also pointed out that the City would save $69, 000 every
year, not just one year by hiring a City employee as Public Works
Inspector . This would be an ongoing savings.
On motion of Cm. Burton, seconded by Cm. Moffatt, and by unanimous
vote (Mayor Snyder absent) , the Council adopted

OTHER BUSINESS
East Bav Division Meeting Q League Conference in Monterey (140-25)
Cm. Moffatt stated he wanted to stress the importance of everyone
attending the East Bay Division dinner meeting while at the League
Conference in Monterey on July 10-12, 1991. All those who want to
vote for the new president and vice president of the East Bay Division
must be there.
Light Rail in San Ramon (1060-60)
Cm. Moffatt advised that a proposal had been made by the Tri-Valley
Transportation Committee for a light rail alignment which would go
down the Southern Pacific Right-of-Way from Dougherty Road to the
County line.
It was felt that this was the San Ramon City Council, not the TVTC.
This is the first time anyone has ever seen it. It is essentially the
light rail that will go around San Ramon.
Cm. .Moffatt stated he would distribute copies to the rest of the
Council. There seems to be a lot of interest in this and he felt
Dublin should look at what some of the problems could be.

Dublin Housing Authority Tenant Commissioner Opening (430-90)
Mayor Pro Tempore Jeffery advised of a need to appoint a subcommittee
to interview for a tenant commissioner opening on the Dublin Housing
Authority.
Cm. 's Burton and Moffatt indicated a willingness to work on this and
to review applications and conduct interviews.
Following discussion, the Council was not sure this could be completed
in time to make the appointment at the DHA July meeting.
American City Magazine Awards (150-20)
Mayor Pro Tempore Jeffery advised that she was recently going through
the American City magazine, and felt it would be good public relations
for the City to enter competitions whenever we can. She specifically
thought the overpass project we are jointly doing with Pleasanton
would be worthwhile to enter.
