FINANCIAL STATEMENT: None
DESCRIPTION:
Government Code Section 65400(b) requires each jurisdiction to
provide an annual report to the legislative body on the status of the
General Plan and progress in its implementation, including the
progress in meeting its share of the regional housing needs. Staff
has prepared a report on the status of the General Plan for the City
Council as follows:
Status Of The Plan
The Dublin General Plan was adopted on February 11, 1985 . Since
its adoption the General Plan has been amended on several occasions
most notably by the Downtown Specific Plan and General Plan Amendment
in July of 1987 and the Housing Element which was revised in June of
1990 . The Government Code has been revised since adoption of the
General Plan requiring revisions to some elements. The following
changes need to be made to clarify the General Plan and meet the
requirements of State Law:
1. Revise the Land Use Element to develop floor area ratios and
employee generation factors for commercial land uses and develop
density standards for the open space land use category. Incorporate
changes made by the Downtown Specific Plan into the Land Use Element.
2 . Revise the Noise Element to address proposed BART stations .
3 . Revise the Open Space Element to inventory and map open
space areas especially in eastern and western Dublin, and to add open
space action programs.
4 . Revise the Conservation Element to develop text and policies
on historic resources and to develop a heritage tree ordinance.
5 . Revise the Utilities Element to address solid and liquid
waste facilities, water supplies and gas and electric services.
6. Revise the Circulation Element to develop policies for
provision of new roadways, describe the street/highway classification
system and to address new transit terminals. Address the jobs/housing
balance in the Circulation and Land Use Elements.
In addition to these substantive changes, many non-substantive changes
are necessary to clarify and better organize the General Plan.
Progress In Implementation Of The Plan
Since the adoption of the General Plan, the City of Dublin has
approved development proposals for all residential land within the
City west of Camp Parks with the exception of 21 acres (6 acres at
Arroyo Vista and 15 acres at Valley Christian Center) . Development
studies are currently being prepared for 7 ,400 acres in eastern Dublin
and for 3 , 255 acres in western Dublin. These studies are anticipated
to be before the City Council for consideration in 1992. A general
plan amendment to include the changes proposed above is anticipated in
1992.

Progress In Meeting Share Of Regional Housing Needs
At the time the Housing Element was revised in June of 1990, the
ABAG projected need for housing in Dublin was 3 , 391 dwelling units for
the 1988-1995 period. As of December 1989 , 920 dwelling units had
been built leaving a projected need of 2 ,471 dwelling units. Between
January of 1990 and the end of 1991, 552 dwelling units will have been
built or are anticipated to be built. The projected housing need for
the 1988-1995 period would therefore be reduced to 1 ,919 dwelling
units. It is anticipated that between January of 1992 and December of
1994 337 to 446 dwelling units will have been built, further reducing
the projected regional housing need to between 1,473 dwelling units
and 1 ,582 dwelling units. If the western and eastern Dublin specific
plans are approved in the next year, the prospects for providing more
housing, much of which would be affordable, will increase.
Progress has occurred this year in implementing the following
Housing Element strategies:
1. The Rental Availability Ordinance was adopted implementing
Strategy III.E which requires that 10% of the units in multifamily
projects with more than 10 units be rented for a period of 5 years or
that a flat in-lieu rental fee be paid.
2. The Density Bonus ordinance, required by Strategy I.A is
near adoption. This ordinance would encourage the provision of
housing for very low income and low income households and for senior
citizens by granting density bonuses to residential developers. This
ordinance also implements Strategy II.B which calls for the reduction
of application fees for senior housing projects and developments
providing 10% or more units affordable for very low, low and moderate
income households.
3 . The Inclusionary Housing Ordinance as set forth in Strategy
I.B would require that a minimum percentage of low and moderate income
housing be provided in developments with 20 or more units and could
provide for the payment of in-lieu participation fees. This ordinance
is being prepared by Staff and will be presented to the Planning
Commission in the first quarter of 1992 .
Progress is anticipated in 1992 in the implementation of the
following Housing Element strategies:
1 . Encouraging use of air rights over parking lots and low
intensity land uses to build housing (Strategy I.D) .
2 . Encouraging higher density residential development near the
proposed Dublin BART station (Strategy I.E) .
3 . Adoption of an amendment to the Zoning Ordinance allowing
emergency shelters in multi-family zoning districts as a conditional
use (Strategy I.F) .
4 . Encouraging shared living arrangements (Strategy II.C) .
5. Annexation and rezoning of additional land for residential
use (Strategy III .A) .
6. Encouraging residential development in the Downtown
Intensification Area (Strategy III .C) .
7. Supporting semi-public institutions in efforts to add
affordable housing to their sites (Strategy III.D) .
8. Encouraging development of second units in existing single
family homes through review of approval requirements, publicity and
City recognition of good design (Strategy III .F) .
9. Cooperating with non-profit housing providers to develop
units affordable to very low and low income households (Strategy
III.G) .
10. Requiring evidence of developer effort to receive public
financial assistance for the purpose of including below market rate
units in proposed projects and assisting developers in obtaining
information on available programs (Strategy III.J) .
11 . Promoting equal housing opportunity for all Dublin residents
and others seeking housing in Dublin (Strategy III.K) .
Article 7.Administration of General Plan
65400.After the legislative body has adopted all or part of a general plan,the planning agency shall Implementation
do both of the following: plan
(a) Investigate and make recommendations to the legislative body regarding reasonable and
practical means for implementing the general plan or element of the general plan,so that it will serve
as an effective guide for orderly growth and development,preservation and conservation of open
space land and natural resources, and, the efficient expenditure of public funds relating to the
subjects addressed in the general plan.
(b)Provide an annual report to the legislative body on the status of the plan and progress in its Annual report
implementation,including the progress in meeting its share of regional housing needs deter-
mined pursuant to Section 65584.

Review of public 65401.If a general plan or part thereof has been adopted,within such time as may be fixed by the
works projects for legislative body,each county or city officer,department,board,orcommission,and each governmental
conformity with plan body,commission,or board,including the governing body of any special district or school district,
whose jurisdiction lies wholly or partially within the county or city, whose functions include
recommending,preparing plans for,or constructing,majorpublic works,shall submit to the official
agency,as designated by the respective county board of supervisors or city council,a list of the
proposed public works recommended for planning,initiation or construction during the ensuing
fiscal year.The official agency receiving the list of proposed public works shall list and classify all
such recommendations and shall prepare a coordinated program of proposed public works for the
ensuing fiscal year. Such coordinated program shall be submitted to the county or city planning
agency for review and report to said official agency as to conformity with the adopted general plan
or part thereof.

Restrictions on 65402. (a)If a general plan or part thereof has been adopted,no real property shall be acquired by
acquisition and dedication or otherwise for street,square,park or other public purposes,and no real property shall
disposal of real be disposed of,no street shall be vacated or abandoned,and no public building or structure shall be
property constructed or authorized, if the adopted general plan or part thereof applies thereto, until the
location,purpose and extent of such acquisition or disposition,such street vacation or abandonment,
or such public building or structure have been submitted to and reported upon by the planning
agency as to conformity with said adopted general plan or part thereof.The planning agency shall
render its report as to conformity with said adopted general plan orpart thereof within forty(40)days
after the matter was submitted to it, or such longer period of time as may be designated by the
legislative body.
If the legislative body so provides,by ordinance or resolution,the provisions of this subdivision
shall not apply to:(1)the disposition of the remainder of a larger parcel which was acquired and used
in part for street purposes;(2)acquisitions,dispositions,or abandonments for street widening;or
(3)alignment projects,provided such dispositions for street purposes,acquisitions,dispositions,or
abandonments for street widening,or alignment projects are of a minor nature.
(b)A county shall not acquire real property for any of the purposes specified in paragraph(a),nor
dispose of any real property,nor construct or authorize a public building or structure,in another
county or within the corporate limits of a city,if such city or other county has adopted a general plan
or part-thereof and such general plan or part thereof is applicable thereto,and a city shall not acquire
real property for any of the purposes specified in paragraph(a),nor dispose of any real property,nor
construct or authorize a public building or structure,in another city or in unincorporated territory,
if such other city or the county in which such unincorporated territory is situated has adopted a
general plan or part thereof and such general plan or part thereof is applicable thereto,until the
location,purpose and extent of such acquisition,disposition,or such public building or structure
have been submitted to and reported upon by the planning agency having iurisdiction, as to
conformity with said adopted general plan or part thereof.Failure of the plan
within forty(40)days after the matterhas been submitted to it shall be conclusive
that the proposed acquisition,disposition,or public building or structure is in c
adopted general plan or part thereof. The provisions of this paragraph (b;
