SUBJECT: Public Hearing: Establishment of Commercial Garbage
Can Collection and Disposal Rate

RECOMMENDATION: Open public hearing; Receive Staff Report and public
input; Close public hearing and deliberate; and Adopt
Resolution Amending Resolution No. 3-92 to provide for
a Commercial Can Rate.
FINANCIAL STATEMENT: The recommended rate is equal to what the Company
charged this class of customers in 1991 .
DESCRIPTION: On January 13, 1992, the City Council adopted a
comprehensive rate schedule for garbage collect and disposal service in the
City. Subsequent to that action, the Company advised the City that rate
information for commercial cans had not been included in the information
originally transmitted to the City by the Company.
Prior to 1992, the City had not adopted a comprehensive rate schedule and
the Company would establish rates not explicitly shown, in relationship to
the rates set by the City Council. In 1992 Staff requested that the
Company identify all rates, which were to be included in the rate schedule
adopted by the City. Through an oversight, a minor class of service was
omitted from the information transmitted to the City.
The Company has 26 cans in service at commercial establishments.
Typically, these are smaller firms such as banks and other service
providers. In some cases it may be that individual cans are used instead
of a commercial container due to space limitations. A comparison of rates
currently charged by the Company as compared to the new residential rates
are as follows:

The Residential Rate shown is the first can amount including special
Residential Services.
The Company indicates that these establishments are serviced by the
residential trucks. In some cases this may not be conveniently located
adjacent to residential areas. The City's Rate Consultant has also advised
that it is appropriate to assure that a business cannot subscribe for
multiple cans at a rate less than the more efficient commercial service.
The Company estimates that approximately 6 and 2/3 32 gallon cans are
equivalent to a one yard commercial bin. The current rate for a one yard
container emptied once per week is $27.70 per month. Therefore, if the
City maintains the current rates a customer would need to have four cans

before the commercial bin service was cost effective. A reduction in the
rate would increase the number of individual cans a business could have,
before reaching a cost benefit to switch to a commercial bin. The
following breaks down the composition of those currently using this class
of service:

Staff would recommend that the rates be maintained at the current rate for
1992. This is a customized service utilized by relatively few businesses.
It is also consistent with establishing rates to encourage the most
efficient type of service.
Staff has prepared a resolution which amends Resolution No. 3-92. The
amended section is highlighted as Section (V) (B) Commercial Can Rates. In
addition, the proposed resolution corrects a minor typographical error
which appeared on information originally submitted by the Company. In
Section VII (H) (1 ) , the original resolution stated that the flasher charge
was applied to each pull. The wording should have read each "placement. "
Staff would recommend that following the public hearing that the City
Council adopt the resolution.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

AMENDING RESOLUTION NO. 3-92
TO PROVIDE FOR COMMERCIAL CAN RATES
WHEREAS, the City Council adopted Resolution No. 3-92 on January 13,
1992; and
WHEREAS, said Resolution identified solid waste collection rates for
most classes of service; and
WHEREAS, Resolution No. 3-92 omitted a rate for Commercial Customers
subscribing per can instead of using bin service; and
WHEREAS, a notice announcing a public hearing on the proposed
commercial can rate has been published as required by the Government Code;
and
WHEREAS, the City Council has conducted a public hearing on the
proposal on February 10, 1992; and
WHEREAS, the impact of this resolution is only intended primarily to
amend Exhibit A of Resolution No. 3-92 to provide for a Commercial Can Rate
and all other recitals and findings shall remain as originally stated in
Resolution No. 3-92; and
WHEREAS, a minor typographical error appeared in Section VII (H) (1 ) of
Resolution No. 3-92; and
WHEREAS, this resolution shall correct the typographical error.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Dublin does hereby adopt the Rate Schedule attached hereto, marked "Exhibit
A" and by reference hereof, shall be the official rate schedule.
BE IT FURTHER RESOLVED that said rates shall be effective January 1 ,
1992 .

RATES FOR GARBAGE COLLECTION & DISPOSAL SERVICES
CONDUCTED PURSUANT TO A FRANCHISE AGREEMENT
BETWEEN THE CITY OF DUBLIN AND
OAKLAND SCAVENGER COMPANY
I . EFFECTIVE DATE
The rates shown for the collection of refuse within the City of Dublin
are effective as of January 1 , 1992 .
II . RESIDENTIAL SERVICE
A. Super Recycler Collection This is a minimum service level
providing for once a week collection of a 20 gallon capacity
container. This service level cannot be combined with services
identified in sections (B) or (C) below. This rate includes a
$1 . 30 (one dollar and thirty cents) charge for curbside recycling.
Monthly Charge: $6 . 65
B. First Container Collection Cost for Customers not Subscribing to
Super Recycler Rate For customers not subscribing to the Super
Recycler service level (as described in subsection A above) , the
rates shown below shall apply to the initial can of service. Once
per week collection of the following sized containers shall include
a $1 . 30 (one dollar and thirty cents) charge for recycling.

III . DESIGNATION OF POINT OF COLLECTION
For Single Family Residential Service, the above rates shall be for
"back yard service" for regular garbage service. The term "back yard
service" shall mean the container(s) shall be on the outside of and in
close proximity to the structure being served, and at a location which
is the customer' s option. Padlocks or other devices which deny the
Collector reasonable access will relieve said collector from
responsibility of such collection. The Curbside Residential Recycling
Program requires that containers be placed in location which can be
easily seen and readily accessible, within five feet from the curb.
IV. ADDITIONAL SERVICES PROVIDED IN RATES
The above rates shall include four (4) annual residential cleanups.
Dates of said cleanups shall be at the discretion of the City upon
reasonable notice to the Company. The rules regulating the special
cleanup shall be approved by the Contractor and the Director. The
Contractor shall separately account for costs associated with this
service and report information as requested by the City.

V. COMMERCIAL AND MULTIFAMILY BIN SERVICE
A. The following rates include collection, disposal, and bin rental at
commercial establishments and multifamily projects serviced by
centralized bins . The rates shown are for a monthly period. All
charges are based upon bins being filled no higher than water
level . Excess rate for waste which exceeds water level is $6 . 40
per yard.

VII . DROP BOX
The following rates shall be charged for drop box services rendered.
The cost shall be on a per pick-up basis and costs are based upon the
load not exceeding the water level. Certain miscellaneous charges as
noted in subsection (H) may also apply.
A. 6 Cubic Yard Container (Dirt/Rock/Debris) Rate per Pick-up
The pick-up cost of this container shall be $ 95 . 15
the same as the 14 yard container due to the
weight accommodated.
