Direct Staff to submit applications for ` $49 , 138 in CDBG funding for FY 1992-1993 and for an advance of $46 ,520 in CDBG funding for FY 1993-94 and other funding periods as necessary as shown in the Staff report. FINANCIAL STATEMENT: (See discussion below. ) DESCRIPTION: Since 1982, the City of Dublin has participated in the Alameda County Urban County Housing and Community Development Block Grant (CDBG) Program. In May 1990, the City entered into a City-County Cooperation Agreement for CDBG Program Years 1991, 1992 and 1993 . In the current program year, CDBG funds were allocated as follows : 1) Minor Home Repair $ 8, 797 2 ) Dublin Senior Center renovation $ 9 ,225 3) Dublin Housing Authority/Arroyo Vista playground equipment installation project $23, 781 4 ) Kaleidoscope Activity Center $ 5, 000 Total $46 , 803 The total allocation to the City from the CDBG program for FY 1992-93 is $49 , 138 (see Exhibit A) . Of that total, $9 , 308 must be spent on housing rehabilitation. The remainder, $39 , 830 may be used for Jurisdiction Improvement Projects determined to be eligible under HUD guidelines . Staff recommends that the City Council direct Staff to submit applications for $49 , 138 in CDBG funding for FY 1992-93 as follows : --------- - --------------------------- ------------------------ ITEM NO. Dublin Swim Center Bathhouse Improvements The Americans With Disabilities Act, Public Law 101-336 , requires that facilities and programs which receive public funds be accessible and usable by people with disabilities . The bathhouse at the Dublin Swim Center is not accessible to the disabled and is subject to the Act . An individual discriminated against under the Act has the right to obtain a court or administrative order against the discriminatory behavior and to have attorneys ' fees paid. The use of CDBG funds to improve the Dublin Swim Center bathhouse has been determined to be eligible under HUD guidelines . Given the urgency of improving the Swim Center bathhouse to meet the requirements to the Act, Staff recommends that $39, 830 of the CDBG funding be allocated to that project in FY 1992-93 . It is estimated that the cost of renovating the bathhouse would be $86 , 350 . If the renovation is to occur in FY 1992-93 it will be necessary to receive an advance on Dublin' s CDBG funding for FY 1993-94 (and later funding periods as necessary) in the amount of $46 ,520 . Funds can be advanced only if other cities in the Urban County CDBG program do not use funds allocated to them during FY 1992-93 . In order to receive an advance it will be necessary for the City to guarantee that the advance would be returned if funds are not available (if all of the cities are using their full amounts) or if funding is not available for other reasons, such as the cancellation of the CDBG program by the Federal Government . An alternative to requesting an advance of funds would be to accrue funds from FY 1992-93 and later program years as necessary and to renovate the bathhouse when sufficient funds have been accumulated. Given the possibility that- an individual who feels discriminated upon under the Act could apply for a court or administrative order at any time, Staff recommends that the City Council direct Staff to apply for an advance on FY 1992-93 funds and funds from later funding periods as necessary. Kaleidoscope Activity Center The Kaleidoscope Activity Center has requested $5 , 000 in CDBG funds for FY 1992-93 to be put toward purchase of the property on which the Activity Center is located (Exhibit C) . Staff recommends that the funds not be allocated to the Kaleidoscope Activity Center during this funding period because of the urgent need to renovate the Swim Center bathhouse and because of the availability of other sources of funding for the Activity Center. The City supported Kaleidoscope in FY 1984-85 with $27 , 000 in start up funding through the CDBG related Jobs Bill and in FY 1991-92 with $5, 000 which was used to purchase a modular handicapped accessible ramp. The City Council may allocate CDBG funds among eligible projects as it chooses . It is necessary that a decision be made regarding the funding levels for given projects at this meeting due to the need to submit applications to County HCD by February 28, 1992 . As you will remember , $5 , 000 of City of Dublin Community Development Block Grant Funds were designated for the handicapped accessible equipment during the 1991/92 part of the CDBG funding cycle. Your support specifically funded the partial purchase of a 45 foot by 8 . 5 foot handicapped accessible ramp and deck as well as outfitting our new portable building with a handicapped accessible shower and rest room. The net result of your generosity is Kaleidoscope ' s expansion of its scope of services to include physically challenged as well as more severely disabled youth . In addition, through the new building we will be able to serve an additional 40 family members with disabled youth including Dublin families such as the Pinkstons . Linnie, who has Dismorphic Syndrome, has been waiting for our expansion of services for several years now. Your support has made Kaleidoscope ' s new building accessible for her and others ! We would also like to thank the City of Dublin Staff for the expertise in both the planning and building inspection process . Your ' s and your staff ' s support has made us feel very much at home in Dublin . I would also like to thank the City Council and Staff for their continued support toward the Lions Park handicapped accessible play structure at Kolb Park next to Kaleidoscope . Together, we have worked very hard to make a quality activity center for Dublin ' s and the Tri-Valley developmentally disabled youth. We would like to make our 7425 address a permanent one by purchasing the property from the Dublin Unified School District . Our current level of community support , and state funding will not allow for us to take on this estimated $200 , 000 capital campaign goal without your support . We hope that the you and the staff will be able to assist us in this goal by allocating an additional $20, 000 over the next two years of the CDBG period. Thank you for giving us the hope of a permanent home to help keep our disabled youth and their families together, as well as helping our youth reach their potential !
