DESCRIPTION:
Section 3301(c) specifies the distance required between exits.
When two exits are required, the distance between exits shall be
not less than one-half of the overall diagonal served. The
purpose of this requirement is to provide a reasonable separation
between exits so that if one becomes unusable, that the other may
be expected to be used with reasonable safety.
In this instance a permit was issued on February 6, 1989 which
authorized the dividing of a large storage area so as to create a
separate tenant space approximately 72 feet x 96 feet. The
overall diagonal is 120 feet and the exit doors are required to
be 60 feet apart.
A permit was issued for this work and the approved plans included
installing a 3 foot wide swinging exit door in an existing roll-
up door. (Note: roll-up and sliding doors are not permitted to
be used as exits because they can be difficult to operate) . The
distance between exit doors as shown on the approved plans is
approximately .63. feet.
The contractor is requesting this variance on behalf of the
owner. The owner is objecting to installing a 3 foot exit door
in the existing roll-up door because of security reasons. It is
proposed that the existing doors which are 48 feet apart be
allowed to serve as the required exit doors.

In order to grant the variance the City Council must find that
the variance is consistent with the intent of the code and that
granting the variance will not lessen the protection of the
people of the City of Dublin and the property situated therein.
It is the opinion of the Building Official that this finding
cannot be made; therefore recommends denying the variance
request.

Dear Sirs:
I am requesting a fire safety exit code variance on behalf of the owners
of the above-referenced property.
The code requires the exits to be at least one-half of the distance of the
-- - diagonal apart. In this case we have two exit doors which look approximately
ten feet from being one-half the diagonal. As you can see by the attached
plan, the tenant area is not very deep relative to the width and adding an
exit door in the roll-up would provide, in reality, no additional martin of
safety in case of an emergency. In fact, the existing door is exactly the
same distance from the furthest corner of the building as is the proposed
door due to the obstruction of the bathroom. Moreover, the existing door
provides a quicker exit from a much greater portion of the building than the
proposed exit.
The spirit of this code, which I support, is to prevent people from being
trapped in a corner of a building during an emergency (fire, vapors, etc. ) .
• In fact, the owners have provided fire corridors in other units of this
building where the space was narrow and deep, which is the type of situation
for which the code is intended.
Putting a man-door in the roll-up creates security problems as well as is
an unnecessary expenditure of money. We appreciate the city Building
Department's thoroughness and strict adherence to codes, but request that
a variance, be granted in this situation because the existing exit condition
meets all the requirements for safe emergency exits and in no way is in
conflict with the code's intent.

RESOLUTION NO - 89
A RESOLUTION OF THE.CITY COUNCIL
OF THE CITY OF DUBLIN
DENYING VARIANCE TO SECTION 3301(c) OF 1985 UNIFORM BUILDING CODE
} WHEREAS, Bill Garaway, Garaway Contracting acting on behalf of
the owners of 6800 Sierra Court, Dublin, has requested a variance to Section . .
3301(c) of the 1985 Uniform Building Code of the City of Dublin which requires
if only two exists are required they shall be placed a distance apart equal to
not less than one-half of the length of the maximum overall diagonal dimension
of the building, or area to be served measured in a straight line between
exits; and
WHEREAS,. the City Council did hold a public hearing on this
matter on March 13, 1989; and
WHEREAS, the City Council finds that granting the variance would
lessen the protection to the people of the City of Dublin and property
situated thereon, and that the granting of the variance is not consistent with
the spirit and purpose of the Building Code;
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby ':.,
deny said requested variance.
PASSED, APPROVED, AND ADOPTED this 13th day. of March, 1989.
