SUBJECT: PUBLIC HEARING Request for a Variance to Section 3304 (b) of
the Uniform Building Code so as to Permit an
Exit Door to Swing in Rather Than in the
Direction of Exit Travel at 6767 Dublin

FINANCIAL STATEMENT: No additional cost to the City.
DESCRIPTION: The Stereo Plus is a new tenant at 6767 Dublin
Boulevard. Exhibit 3 shows the proposed remodel work which includes
partitioning of a portion of the existing showroom to create a
warehouse area in the rear. This makes the existing rear exit
inaccessible because Section 3303 (e) provides in part, "In other than
dwelling units, exits shall not pass through kitchens, store rooms,
rest rooms, closets or spaces used for similar purposes" (emphasis
added) . -
Thus it becomes necessary to install a new second exit through the
exterior wall on the east side of the building. This door will open
onto a 10 foot wide driveway on the east side of the building. In
order to create a safe exiting condition, without having the exit door
swing directly into the path of traffic on the driveway, the door will
be recessed into the building. Exhibit 3 shows both cond itions . The
door labeled "E" complies with the code.
The tenant, Stereo Plus, objects to the recessed door because it is
feared that the recessed area will create an alcove which would screen
a vandal, or break-in attempt from public view. Stereo Plus proposes
to mount the exit door flush in the exterior wall and have the door
swing in, rather than out as shown by door "F" on Exhibit 3 . This
would minimize the hazard from traffic on the driveway.
This problem has been discussed with the Chief of Police . He indicates
that the recessed door does not substantially increase the security
risk. .
The problem has been created by the design of the store. The new exit
door would not be required if an exit corridor were provided through
the new storage room to the existing rear exit.
In order to grant this variance, the City Council must find that the
variance is consistent with the purpose of the ordinace and that it
will not lessen the protection to the people of the City of Dublin and
the property situated therein.
The purpose of the code requirement is to facilitate exiting in an
emergency and to prevent a back up of people, while the door is being
swung opposite the direction of flow of traffic.
It is the opinion of the Building Official this variance request would
lessen the protection to the people, and no mitigating measures to
offset the exit requirements have been proposed. The Fire Chief
concurs with the opinion of the Building Official .

Dear Mr . Taugher,
The new tenant at the above mentioned address, Stereo + Plus respectfully
request the following variation in the Uniform Building Code exit
requirement (Section 3303,8) ,
That the secondary means of exit from the public area be a door that
swings in (as opposed to outward in the direction of travel ) for the
following reasons:
I ) Stereo equipment retailers are a highly targeted item for theft
and break-in .
_ .24iI A recessed door would create an alcove or a sheltered area which
would be a convenient location to screen a vandal or break-in attempt .
3) A flush Mounted in swinging door would alleviate swinging a door
out over a driveway curb and thus minimizing any potential for bodily
injury by auto impact .
4) There are existing at present two means of exit from the public
area which are seperated by only 30 feet versus the required 55 linear
feet .
5) There presently exists a third, but noncomplying, exit through
the storage room to the rear of the building.
We believe that this request for varience is in keeping with the general
intent of the code in that it helps to deter theft and property damage and
presents no personal safety hazard.

system throughout.These distances may be increased 100 feet when the last 150
feet is within a corridor, complying with Section 3305. See Section 3319 for
Group E Occupancy and Section 3320 for Group H Occupancy travel distances.
In a one-story Group B, Division 4 Occupancy classified as a factory or
warehouse and inane-story airplane hangars, the exit travel distance may be
increased to 400 feet if the building is equipped with an automatic sprinkler
system throughout and provided with smoke and heat ventilation as specified in
Section 3206.
In an open parking garage,as defined in Section 709,the exit travel distance
may be increased to 250 feet.
(e)Exits Through Adjoining Rooms.Rooms may have one exit through an
r adjoining or intervening room which provides a direct,obvious and unobstructed
r. means of travel to an exit corridor,exit enclosure or until egress is provided from
the building,provided the total distance of travel does not exceed that permitted
by other provisions of this code.In other than dwelling units,exits shall not pass
through kitchens, store rooms, rest rooms, closets or spaces used for similar
purposes.
EXCEPTIONS: 1.Rooms within dwelling units may exit through more than one
intervening room.
2.Rooms with a cumulative occupant load of 10 or less may exit through more
than one intervening room.
Foyers,lobbies and reception rooms constructed as required for corridors shall
not be construed as intervening rooms.
Doors
Sec.3304.(a)General.This section shall apply to every exit door serving an
area having an occupant load of 10 or more,or serving hazardous rooms or areas,
except that Subsections(c), (h)and(i)shall apply to all exit doors regardless of
occupant load. Buildings or structures used for human occupancy shall have at
least one exterior exit door that meets the requirements of Subsection(e).

ouble-acting doors shall not be used as exits when any of the following
conditions exist:
�.` 1.The occupant load served by the door is 100 or more.
2.The door is part of a fire assembly.
3.The door is part of a smoke-and draft-control assembly.
4.Panic hardware is required or provided on the door.
A double-acting door shall be provided with a view panel of not less than 200
square inches.
(c) Type of Lock or Latch. Exit doors shall be openable from the inside
without the use of a key or any special knowledge or effort.
• EXCEPTIONS: 1.This requirement shall not apply to exterior exit doors in a
Group B Occupancy if there is a readily visible,durable sign on or adjacent to the

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
DENY VARIANCE TO SECTION 3304 (b) OF THE UNIFORM BUILDING CODE
•
WHEREAS, Stereo Plus requested a variance to Section
3304(b) of the Uniform Building Code so as to waive the
requirement that the exit door swing in the direction of exit
travel in the building located at 6767 Dublin Boulevard and;
WHEREAS, the City Council did hold a public hearing on
this matter on September 8, 1986 and;
WHEREAS, the City Council finds that the variance is
not consistant with the purpose of the building code Section
3304 (b) and that the construction proposed would lessen the
protection to the people of the City of Dublin and the property
situated therein;
NOW, THEREFORE, BE IT. RESOLVED THAT THE Dublin City
Council deny the variance to Section 3304 (b) of the Building Code
PASSED, APPROVED AND ADOPTED this 8th day of September,
1986. -
