HomeMy WebLinkAboutItem 4.3 Non Conforming Signs Status Report CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: May 26 , 1992 SUBJECT: Monthly Status Report regarding existing Nonconforming Signs identified on the Nonconforming Sign Summary List REPORT PREPARED BY: Ralph Kachadourian, Assistant Planner/Zoning Investigator RECOMMENDATION: �`' �\O IIkk Accept Report FINANCIAL STATEMENT: None DESCRIPTION: On June 1, 1992 the fourth reminder letters for nonconforming signs will be sent by certified mail to the business/property owners regarding the upcoming July 12, 1992 , expiration date. These reminder letters identify the signs which are nonconforming and the options available to bring the nonconforming signs into compliance with the City' s Sign Ordinance . Attached is an updated status list indicating the sixty ( 60 ) non- conforming sign locations . The list indicates the reminder letters and warning notices sent and shows the type of approval (s ) options required to modify or to maintain the existing nonconforming signs to comply with the ordinance . Per Council direction, enforcement action and nuisance abatement proceedings for the nonconforming business signs at the three auto dealerships indicated on the summary list will be held in abeyance, pending completion of the Sign Ordinance Amendment Study relating to auto dealership/automobile product line signage. On April 24 , 1992 , second warning notices, requesting compliance by May 8 , 1992 , were sent by certified mail to five nonconforming sign locations . Four of these were business/property owner locations which did not submit a time extension request. The fifth location had a time extension request and had erected a separate illegal sign. To date, three of these nonconforming sign locations have been corrected (two locations which did not submit an extension request and one location with the separate illegal sign) . The two remaining nonconforming sign locations which did not submit a time extension request have contacted Staff; however, they have not removed or submitted applications to correct the nonconforming signs . Staff is working with the City Attorney' s office to begin enforcement action and nuisance abatement proceedings . --------------------------------------------------------------------- ITEM NO. A446 CITY CLERK FILE 00 30 The following is an up-to-date summary of the attached status list. ■ Nine ( 9 ) sign locations could apply for Site Development Review. ■ Three ( 3) sign locations could apply for a Variance. ■ Thirty-three ( 33) sign locations could apply for a combination of either a Site Development Review, Conditional use Permit, Variance or an Administrative Conditional Use Permit. ■ Two ( 2 ) sign locations did not submit a request for a time extension and have not been corrected. ■ Thirteen ( 13) sign locations have been corrected and are in compliance with the Sign Ordinance. The comments section of the status list indicates 1) Staff ' s discussion with a business/property owner or representative and if an appropriate application has been submitted, 2 ) the two business/ property owner locations which did not submit a request for a time extension, 3 ) approvals granted for compliance of existing nonconforming signs and 4) any changes reflecting the non-conforming sign location. Forty (40) business/property owners or representatives of the forty-seven (47 ) remaining uncorrected nonconforming sign locations have contacted the Planning Staff, as a pre-application review process and to obtain more specific information, regarding their nonconforming signs . Two sign locations have submitted applications to gain compliance for their nonconforming signs .
