Shannon Center Facility Use Policy STAFF RECOMMENDATION: ,p/ Deny request; provide direction on possible /JC,(/� revisions to the Use Policy FINANCIAL STATEMENT Potential increase in revenue of $300/week DESCRIPTION Correspondence has been received from Dr. Craig Madsen, a Captain with the Salvation Army, requesting an exception to the continuous use provision of the Facility Use Policy for the Shannon Community Center (Exhibit A) . Dr. Madsen has requested use of the East Room, West Room and the A&B Room of the Shannon Community Center on Sundays from 10:00 a.m. until 12 noon for the Amador Valley Christian Fellowship, a suburban center for worship and service sponsored by the Salvation Army. Under the current Facility Use Policy for the Shannon Community Center (Exhibit B) , continuous use is accepted on a quarterly basis and is limited City users, certain school districts, the Dublin Chamber of Commerce and Community Groups having the following membership qualifications: a) is non-profit b) has officers and definite organizational structure C) activities are recreational or educational in nature d) at least 51% must be residents of the City of Dublin The Amador Valley Christian Fellowship does not meet two of the above qualifications as they do not currently have a membership comprised of 51% Dublin residents, and their activities are not recreational or educational in nature. While it could be argued that a church has an educational function, the law distinguishes religious activities from educational activities. The use requested by the Amador Valley Christian Fellowship, worship services, is considered to be a religious activity. If, however, the Policy were amended to allow further categories of users to have continuous use of the Center, the City could allow the Amador Valley Christian Fellowship or another church to use the facility as long as the Center was available on a non-discriminatory basis to all religious, educational, political or recreational organizations. With regards to the residency requirement, Dr. Madsen indicates that they do not presently have a documented membership of over 51% Dublin residents as they do not have a real membership established (they have only been meeting for 19 weeks) . However he feels that if the church is located in Dublin, it will draw from the community and serve Dublin residents. The Parks and Recreation Commission considered the request of the Amador Valley Christian Fellowship at their regular meeting of July 14, 1992. The Commission was in favor of allowing continuous use by the Amador Valley Christian Fellowship and recommended that the City Council grant an exception to the Shannon Center Facility Use Policy. ---------------------------------------------------------------------- ITEM NO. By allowing continuous use of this nature on Sundays, the Commission felt that additional revenue could be generated. Staff, however, is recommending that the City Council deny the request at the present time. Revisions to the Use Policies for all City facilities are currently being undertaken and Staff believes that it would be premature to make an exception to the Policy. If the Council is in favor of allowing this type of use at the Shannon Community Center, Staff will make the appropriate revisions to the Policy in order to broaden the classifications of users eligible for continuous use. It is anticipated that the revised Use Policies will be brought before the City Council for approval in October of 1992. As per your suggestion, we are hereby making official request for the above-captioned exception. We understand from your letter of July 6 that Amador Valley Fellowship would not qualify for a regular quarterly reservation under the present FACILITY USE RESERVATION POLICY (6c) because our membership is not presently composed of at least 51% Dublin residents,. Naurally, we were disappointed to get your letter (By the way, thanks for your most expeditious handling of our application. TWO DAYS must be something of a record! ) . With our disappoint- ment, however, has also arisen within us the sincere conviction that we should be considered for an "Exception" for the following reasons: 1 . While it is true that we don' t have a documented membership of over 51% Dubliners, we essentially have no real "membership" of any kind yet ! You see, we are only 19 weeks old as of this writing! The significance of this is that if we are allowed to operate in Dublin for what would be our FIRST full "Program Year" (September-June) , we would, in fact, BE an indigenous, DUBLIN based group! As our very name ( "AMADOR Valley Fellowship" ) implies, we have always envisioned Dublin as one of our "Key" target communities. Even our present location at the Stoneridge Holiday Inn (which is in immediate proximity to Dublin) was purposefully selected with any eye to servicing as many Dublin residents as possible. A SUBURBAN CENTER FOR WORSHIP AND SERVICE SPONSORED BY THE SALVATION ARMY Further, if we are allowed to provide our services from actually within Dublin at The Shannon Center, there is absolutely no doubt that when we do begin developing a regular constituency it will be comprised overwhelmingly of Dublin residents. 2 . Secondly, we feel the City would do well to grant us an exception in that we would in no way view such an arrangement as pre-empting the priority of more established Dublin groups . In other words, we would be more than happy to "give way" our portion of Shannon Center should special needs arise occasionally within the Dublin community. 3 . Lastly (and perhaps most pragmatically) we believe it would be prudent for the Council to grant us an Exception because it would appear to make solid economic sense. According to city officials with whom we have spoken, SUNDAYS (in general) and SUNDAY MORNINGS (in particular) are the most difficult period to rent of the entire week. We are told that Shannon is, in fact, nearly always vacant when we are asking to use it . In simple terms, we could guarantee the Recreation Department an annual "windfall" in excess of $11,500 ($222 x 52wks) ! As evidence of our "Good Faith" (and fiscal substance) we would even be willing to pay this entire sum in advance should the City so wish) . Once again, we wish to thank you, Diane, for your kind spirit as you have dealt with us on this delicate matter. We are confident that you will be able to get this on the July 14 Agenda as you have promised. Though I will be out of town that entire week working with kids at The Salvation Army' s camp in Santa Cruz, be assured that I will travel back to be at the July 14 hearing in order to answer any questions which might arise. As you can see from the materials we ' re passing along, we are a TRANS-denominational Fellowship (cutting accross sectarian lines) sponsored by The Salvation Army. Our purpose is to help Tri- Valley residents cope with the many stressors of the modern Suburban lifestyle by enabling them to bolster their lives spiritually, emotionally, and socially. IN HIS ARMY" ✓ Dr. and Mrs. Craig Madsen Dr. Craig Madsen is a native of the East Bay, having been born in Oakland, and raised in Orinda (Miramonte High). After his graduation from LIC Berkeley (BA History), Craig and Audrey moved to Livermore. It was during this period that Craig began three years with Allstate Insurance in Hayward. In addition to his undergraduate work at Berkeley, Craig holds an MA (Theology / Marriage & Family) from Fuller Theological Seminary in Pasadena, and a DOCTOR OF MINISTRY from Western Baptist Seminary in Portland, Oregon. Mrs. Captain Audrey Madsen was born in Toronto, Canada,yet has resided mostly in the East Bay since 1964. Audrey has an extensive background in Accounting and Computer Sciences. While she and Craig lived in Livermore, she served as Computer, Systems Analyst for AMFAC Corp. of Dublin, and was responsible for merging the AMFAC subsidiaries "Liberty House" and"Rhodes". Not long after their marriage in 1969, both Audrey and Craig received a definite "Call" from God to the Christian Ministry. In 1975 they entered The Salvation Army's School For Officers Training (Rancho Palos Verdes, CA), and have served Christ in four states as "officers" in this fine organization ever since their ordinations in 1977. FACILITY USE POLICY INTRODUCTION The City of Dublin manages the Shannon Community Center. The Center is utilized by the Recreation Department for City sponsored classes and programs and is also available for rental by community` groups and private individuals. The Facility Use Policy is designed to ensure that the Center is utklized for recreational , cultural , social and community service functions" that meet the needs and interests of the community. In addition, the Facility Use Policy establishes rules, regulations, procedures and fees governing the use of the Center. Any request for exception to the rules , regulations, procedures and fees as . stated in the Facility Use Policy, must be submitted in writing to the Director of Recreation no later than one (1) month prior to the date requested. CLASSIFICATIONS OF USERS 1 . The following classifications shall apply for the purpose of determining applicable fees and charges as well as priority use: I . City of Dublin Use II . School Districts with whom the City has a reciprocal Facility Use Agreement. III . Community Groups - An organized public group having the following membership qualifications: a) Is non-profit. b) Has officers and a definite organizational structure. C) Activities are recreational or educational in nature. d) At least fifty-one percent (51%) must be residents of the City of Dublin. Organizations claiming status in this classification must demonstrate that they qualify f or such status by submitting a roster of their membership and a copy of their bylaws or constitution at the time that they submit a Facility Use Application. IV. Dublin Chamber of Commerce V. Private Individuals or Groups - Youth or adult groups not open to the public and which are using the facility for private purposes. In this group are lodges, fraternal organizations , political organizations, wedding receptions, but not limited. to :these groups . VI . Non-resident Individuals or Groups - Individuals or groups with less than fifty-one percent , (51%) of their membership residing within the boundaries of the City of Dublin. VII. Commercial use by private groups for the principle purpose of making a profit not pledged to be devoted to public or welfare use. 2 . Use of the Center shall not be granted: a) To any individual or group, political or otherwise, that advocates the overthrow of the government of the United States of America or the State of California by force, violence or any other unlawful means. b) When determined by the Director of Recreation, such use may not be in the best interest of the City. RESERVATION PROCEDURE 1 . In order to reserve the Shannon Community Center, a Facility Use Application must be submitted for approval by the Director of Recreation. Approval takes 3-5 working days; you will be notified by mail as to the status of your application. 2 . Once an application has been submitted, a waiting list will be established for applicants requesting use , on the same . date. If, after the review by the Director of Recreation, the application is rejected, the first applicant on the waiting list-,will be notified. -1- August 1990 . RESERVATION PROCEDURL `CONTINUED) 3 . Applications must be submitted in person at Civic Center, 100 Civic Plaza, Dublin. The applicant must be the "user" of the facility'. 4 . Applications are accepted between the hours of 9 :00a.m. and 4 : 00p.m. , Monday through Friday (holidays excepted) . 5 . Applications for weekday use of the Center will be accepted up to three ( 3 ) months in advance of the desired date. Applications for weekend use (Friday night-Sunday) of the Center will be accepted as follows: a) Classifications I-V may submit applications up to one (1) `year in advance of the desired date. b) Classification VI may submit applications up to nine (9) months in advance of the desired date. C) Classification VII may submit applications up to six ( 6) months in advance of the desired date. d) If the submittal date falls on a Saturday, the application may be submitted the preceeding Friday. If the submittal date falls on a Sunday, the application may be submitted on the following Monday. 6 . Applications for continuous use of the Center will be accepted as follows: a) Classification I may submit applications up to one ( 1) year in advance. b) Classifications II-IV may submit applications on a quarterly basis as follows: 1 . Summer (June, July, August) - Applications accepted starting May. 2 . Fall (September, October, November, December) - Applications accepted starting August 1. 3 . Winter (January, February, March) - Applications accepted starting December 1 . 4 . Spring (April , May) - Applications accepted starting March 1. C) Continuous use is not permitted for Classifications V-VI. 7 . Applications submitted less than fifteen (15) working days prior to the day requested will not be accepted. 8 . An additional 50% will be charged for use of the Center on designated City holidays. 9 . Transfer of security deposits from one date to another is permitted if the request is submitted in writing no late than sixty ( 60) days prior to the original date requested. (This will only be allowed one time) . CANCELLATIONS 1 . Cancellations must be made in writing by the person listed as applicant on the Facility Use Application. Refunds will be handled as follows : a) 30 days or more prior to function date - forfeit deposit unless date is rebooked by another user. b) Less than 30 days prior to function date - forfeit deposit and one-half of fees paid. Occasionally it may be necessary to reschedule, relocate or cancel a request previously approved. In this event, the group or individual will be given as much advance notice as possible. PAYMENT SCHEDULE 1 . At the time the application is submitted, the security deposit is required (see Fee Schedule) 2 . Final payment is due no later than one month ( 30 days) prior to the scheduled function date. Please call the rental secretary at 833-6645 to schedule an appointment 3 . Payments . not received by this thirty day deadline will result in cancellation of the function and forfeiture of the deposit. 4 . Security deposits will be returned by mail within 30 days of your function date providing there are no violations of the Facility Use Policy and/or excessive cleaning or damages to the facility. 5 . Payments can be made by check, money order or ash. Checks or money orders must be made payable to the City of Dublin. If paying by check, the check must be drawn on the account of the person listed as applicant on the Facility Use Application. -2- HOURS OF USE 1; The Shannon Community Center is available for rental Sunday through Thursday from 8 : OOAM to 10: OOPM, and Friday and Saturday from 9: OOAM to 12 Midnight. 2 . The minimum reservation accepted will be for two hours. 3 . Hours of use must include the amount of time needed for the function, setup and cleanup, includina any time needed by your caterer, band, florist, coordinator, etc. 4 . Refunds are not given for hours not used. 5. Within 30 days of function date, requests for changes in ftitnction hours are subject to availability of staff. 6 . The Center must be vacated by the time specified on the Facility Use Application. INSURANCE CERTIFICATE Applicants shall provide Insurance Liability information on the City of Dublin's required form evidencing such coverage. Such certificates shall provide Bodily Injury and Property Damage Liability protection at a minimum limit of $500 , 000 per occurrence. If alcohol is to be sold, liquor liability is required. The Certificate of Insurance shall name the City of Dublin, its officers and employees as the Additional Insured in conformance with the Hold Harmless Agreement as outlined in the Facility Use Application, and must specify that the user groups insurance shall be primary to any insurance carried by the City. The certificate shall be properly executed with an original signature of an authorized agent of the insurance company and is due at the time final payment is made. ALCOHOLIC BEVERAGES 1 . Requests to sell alcohol must be submitted in writing to the Dublin Polices Services , 100 Civic Plaza, Dublin, CA 94568 . 2 . If permission is granted, applicants must obtain the appropriate permits or licenses from the Alcoholic Beverage Control Board, 7677 Oak Park Street, Suite 1020 , Oakland, CA ( 639-0628 ) . The permit/license must be submitted when final payment is made. GENERAL REGULATIONS AND INFORMATION 1 . Groups composed of minors must be supervised by one (1) adult for each twenty (20) minors at all times while they are using the facility. 2. Facility, Use Permits cannot be transferred, assigned or sublet. 3 . Decorations must be of flame-retardant material . The use of nails , tacks or staples is prohibited. 4 . Storage is not available either before or after your event. 5. Tables and chairs may not be removed from the facility. 6 . Barbecuing and/or use of candles must be approved in advance by the Fire Department ( 829-2333) . 7. Rice, birdseed, confetti , and like materials may not be thrown inside or outside the facility. 8 . Tickets may not be sold at the door as an admission charge unless approved in advance by the Director of Recreation. 9 . Parking is permitted in painted parking stalls only. Parking is not permitted on sidewalks, lawn areas or unmarked blacktop areas. Vehicles parked illegally will be cited. 10. SMOKING IS PROHIBITED within the interior of the Center (Resolution No. 143-89) . 11 . Shannon Center is not air conditioned! 12. Caterers, florists, etc. are not authorized to schedule hours of use. 13 . Children in attendance must be supervised at all times. ---------------------------------------------------------------- SIGN AND SUBMIT WITH APPLICATION The undersigned, hereby agrees to be responsible for any damage to the facility occurring during this use, and agrees to be responsible for the conduct of all persons attending this function. Applicant further agrees to be responsible for any accident or injury occurring to anyone during this use, and agrees that the City of Dublin, its officers and employees, shall not be responsible for any such injury or loss. No Charge Classifications II, III, and IV (School Districts/Community Groups/ Dublin Chamber of Commerce) 1. No charge if the following criteria is met: a) Admission fees are not charged b) Event held during the Centers regular business hours If the event is held outside of the Centers regular business hours (8:OOa.m.-5:OOp.m.) or if staff is required to setup and take down tables or chairs, the group will be assessed an $8.00 per hour Building Attendant Fee. 2. If the Center is to be used for the purpose of fundraising or if an admission fee is to be charged, see charges under Classification II, III and IV below: 3. If the Center is to be used on a continuous basis, applications will be accepted quarterly (see Facility Use Policy for application dates).
