HERITAGE AND CULTURAL ARTS COMMISSION
MINUTES OF: DUNE 14, 2007
The June 14, 2007, meeting of the Heritage and Cultural Arts Commission was called to order at 7:00 p.m. at the
Dublin Civic Center, Dublin, California, by Chairperson Mack.

8.1 Dublin Village Historic Area Specific Plan
Heritage & Cultural Arts Supervisor John Hartnett advised that in November 2004, the Heritage and Cultural Arts
Commission received a presentation from RBF Consultants on the Draft Design Guidelines for the Dublin Historic
Area, including the proposed boundaries for the Area. In December 2004, the Commission approved the Design
Guidelines and recommended approval to the City Council.
The City is now proposing to initiate an application to incorporate three parcels located along Dublin Boulevard
into the Dublin Village Historic Area Specific Plan Site. Hartnett introduced Laura Karaboghosian, Associate
Planner, who will be presenting a proposal on the addition of three parcels. of land to the Dublin Village Historic
Area boundaries. Karaboghosian explained that on January 18, 2005, the City Council adopted an Ordinance
creating a new Historic Overlay Zoning District as Chapter 8.62 of the Municipal Code. The Ordinance also
amended the Zoning Map to apply the overlay zone to the Historic Area as then defined. Prior to the Dublin
Village Historic Area Specific Plan's adoption by the City Council, the specific plan was considered by the
Planning Commission at the July 11, 2006 Planning Commission meeting. The Planning Commission expressed
their interest in including three additional properties in the Specific Plan boundary for the purposes of ensuring that
any redevelopment of these properties would be in compliance with the Specific Plan's Design Guidelines and for
the purposes of ensuring consistency of the public streetscape. The three parcels were identified as follows:
11746 Dublin Boulevard (APN 941-0113-004) -- property is owned by Burger Livermore Valley and
contains two office buildings.
11700 Dublin Boulevard (APN 941-0113-005-02) -- property is owned by Oleg and Linda Dubney and
contains one office building.
11684 Dublin Boulevard (APN 941-0113-007-01) -- property is owned by the Briarhills of Dublin Cabana
Club and contains one building and a swimming pool.

The Planning Commission adopted a Resolution on July 11, 2006, which included a recommendation to the City
Council that the Specific Plan boundary be revised to include the three additional parcels described above.
On August 1, 2006, the City Council adopted the Dublin Village Historic Area Specific Plan and directed Staff to
return to the City Council with a request to initiate a Specific Plan Amendment to study the addition of the three
parcels outlined by the Planning Commission. On October 3, 2006, the Dublin City Council initiated the study.
Karaboghosian indicated that with the proposed expansion of the historic area, the Zoning Map is proposed to be
amended to include the three added parcels. The proposed addition of three parcels within the Dublin Village
Historic Area Specific Plan furthers the goal of the Specific Plan to establish the City's historic downtown core.
Through the inclusion of these three parcels and application of the Historic Overlay District, the City of Dublin is
taking a proactive approach to future development of these properties in an attempt to create a cohesive historic
district that further highlights the city's historic resources. Karaboghosian asked the Commission for their
questions or comments regarding Dublin Village Historic Area Specific Plan.
Commission Comments
Cm. Lussie asked if the property owners agreed to sell or give property to the City. Karaboghosian advised that
the City is not interested in purchasing the properties in question. Karaboghosian has spoken to the property
owners and two of the owners were not overly concerned regarding this modification. Briar Hills does have a few
concerns which they voiced along with three other Dublin residents at the June 12, 2007 Planning Commission
meeting which were:
The notion of whether or not future updating or modifications to their property would be inhibitive or
expensive to maintain.
2. If they did decide to sell their property would this change be enticing or undesirable for prospective
buyers.
Cm. Lussie asked if the properties would be designated as "historical buildings" once they are included in the
specific plan. Karaboghosian advised that they would fall under the regulations of the specific plan but their
properties would not be considered "historical sites". The inclusion of these buildings is really to create a cohesive
historic downtown district.
Cm. Vonheeder-Leopold advised that the map in the packet pointed to the wrong parcels. Karaboghosian agreed
and advised she would provide the correct maps to the Commission at a later date. Cm. Vonheeder-Leopold also
felt it was a little misleading to say that there would be no negative impact. She feels it may be misleading to say
that there will be no negative impact rather; the potential for negative impact is possible as future Planning
Commissions and/or City Councils may require additional maintenance and/or changes to the buildings to match
the historic district, which could be an additional cost to the property owner. Other than this concern, Cm.
Vonheeder-Leopold indicated she approved of the concept.
Cm. Swalwell asked if there were any tax benefits given to the property owner or any benefit to the property
owners at all, should they agree to this change. Karaboghosian advised that there were no tax benefits offered.
The only benefit to be derived would be to the community as a whole by creating a cohesive, visually appealing
historic downtown district.
Chairperson Mack asked if the City Council would review the Heritage and Cultural Arts Commission's concerns.
Karaboghosian stated that an Addendum would go to City Council for review on July 3, 2007. Then, City Council
would hopefully adopt the Specific Plan with the boundary change. Karaboghosian stated that all property owners
within a 300 foot radius of the proposed locations have had opportunities to attend all the public meetings,
including the Heritage and Cultural Arts Commission meeting being held tonight.

Hartnett reviewed the details, timelines and costs for the five CIP Projects, which include; Dublin Historic Park
Acquisition, Dublin Historic Park Development, Shannon Community Center Art, Bus Shelter Art Project Phase H
and Transit Center Art.
Hartnett indicated that one additional project which has been included in the CIP but is expected to occur beyond
the timeframe of the CIP is the construction of a 16,000 square foot Community Theater/Cultural Arts Center with
a total estimated project cost of $8,032,000.
Commission Comments
Cm. Swalwell asked if the bank would remain at the Historic Site. Hartnett advised that at this time the bank has a
15 year lease and therefore the City is planning on working around the area occupied by the bank during Phase 1 of
project.
Chairperson Mack asked if formal RFP's were going to be requested for upcoming art projects. Hartnett advised
that RFP's would be requested for artist's submissions.
Cm. Swalwell asked if we are taking any anti -graffiti measures for public art. Hartnett advised that anti -graffiti
sealant is typically applied to artwork such as murals and tile art. If for some reason a City artwork art is damaged,
the City would fix it as soon as possible.
Cm. Swalwell asked if we could tear down the bus shelters and start over. Hartnett advised that you cannot destroy
an "art piece" without the artist's permission.
Cm. Carr stated that the bus shelter's chosen were the best choice of all submitted and were the easiest to maintain.
Cm. Lussie asked what would happen to the existing art bus shelters. Hartnett advised that those three shelters will
remain in place for now.
Cm. Vonheeder-Leopold thought it might be a good idea for the Commission to take a field trip to visit the Transit
Center site to become familiarized again, since the development has changed.

Cm. Lussie reported that she attended the Alameda County Library Foundations fundraising event. They are in the
process of receiving grant requests.
Cm. Vonheeder-Leopold advised that the Art Takes Place project has been postponed because there were a lot of
events going on in Livermore. Some Committee Members suggested holding this event around March of next year.
The Art Takes Place Committee will take this time to work out the issues needing attention, as this collaboration of
three cities is very important and should be supported by all participants.
Cm. Vonheeder-Leopold advised that the public art for the Dougherty Hills Dog Park is ready. The opening is
scheduled for July 281h. Cm. Vonheeder-Leopold really likes the idea of hosting a few dog contests which are a lot
of fun. The public art for Bray Commons will be done shortly. Cm. Vonheeder-Leopold asked Hartnett to find
out what happened to Troop 905's Honorees Plaque.
Cm. Swalwell advised he was in Minneapolis last week and really enjoyed their multitude of artwork. He visited
the Sculpture Gardens and encouraged everyone to stop by and visit the museum someday.

Hartnett advised that the Summer Concert Series starts on Friday, July 6 and will feature a performance by
Jukebox Heroes, who are Rock and Roll performers
