Foss, City Manager SUBJECT: Termination of Local Drought State of Emergency Prepared by: Dan Stevenson, PW Manager EXECUTIVE SUMMARY: The City Council will consider a resolution terminating its declaration of a local drought emergency. STAFF RECOMMENDATION: Resolution Staff recommends that the City Council adopt the regarding Termination of Local Drought State of Emergency. FINANCIAL IMPACT: None. DESCRIPTION: On January 17, 2014, Governor Jerry Brown declared a drought state of emergency and called on all Californians to conserve water, with the goal of reducing consumption by 20 percent. In early 2014, both of the City’s water suppliers, the Zone 7 Water Agency Board of Directors (“Zone 7”), which provides wholesale water service in the region, and the Dublin San Ramon Services District Board of Directors (DSRSD), which provides water service to retail customers in Dublin, declared states of emergency based on drought conditions. In solidarity with DSRSD and based on conditions of extreme peril to the safety of persons and property in the City of Dublin, on March 18, 2014, the Dublin City Council declared a local emergency. Since its declaration, the City Council has reviewed the continued need for a state of emergency no less than every 30 days. In addition to frequent review of the need for the state of emergency, California Government Code section 8630(d) requires that the City Council proclaim the termination of the local emergency at the earliest possible date that conditions warrant. 12 Page of On May 9, 2016, California Governor Edmund G. Brown Jr. Issued Executive Order B- 37-16 which established a new water use efficiency framework for California by establishing longer-term water conservation measures. Soon thereafter, on May 18, 2016, the State Water Resource Control Board adopted a statewide water conservation approach that replaces the prior percentage reduction based water conservation standard with a locally driven supply-based assessment. In June, 2016, Zone 7 projected that there will no longer be water shortage nor mandatory water conservation targets for DSRSD over the next three years and DSRSD terminated its drought emergency on June 21, 2016 and declared a Stage 1 voluntary 10% water conservation goal. In accordance with Government Code section 6630(d) and based on the findings, policies and actions of the State, Zone 7 and DSRSD, the City Council is being asked to consider termination of its declaration of a state of emergency based on extreme drought conditions. XX - 16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * * * TERMINATION OF LOCAL DROUGHT STATE OF EMERGENCY WHEREAS, Ordinance No. 02-85 (Section 6.A(1)) of the City of Dublin, adopted on January 14, 1985, empowers the City Council to proclaim the existence or threatened existence of a local emergency when said City is affected or likely to be affected by a public calamity; and WHEREAS the State of California experienced record dry conditions between the years of 2012 and 2016; and WHEREAS , on January 17, 2014, Governor Jerry Brown declared a drought state of emergency and called on all Californians to conserve water, with the goal of reducing consumption by 20 percent; and WHEREAS , the Zone 7 Water Agency Board of Directors (“Zone 7”) declared a drought emergency on January 29, 2014; and WHEREAS , the Dublin San Ramon Services District Board of Directors (DSRSD) declared a community drought emergency on February 18, 2014; and WHEREAS , on March 18, 2014, the City Council of the City of Dublin declared a local emergency based on conditions of extreme peril to the safety of persons and property in the City of Dublin, caused by extreme drought conditions; and WHEREAS , as required by California Government Code section 8630(c), the City Council has reviewed the need for the continued local emergency at least once every 30 days since its declaration; and WHEREAS , the State of California has seen improved hydrologic conditions in contrast to severe drought conditions experienced over the last three years; and WHEREAS , on May 9, 2016 California Governor Edmund G. Brown Jr. issued Executive Order B-37-16 which established a new water use efficiency framework for California by establishing longer-term water conservation measures; and WHEREAS , on June 15, 2016, Zone 7, following state guidelines for availability of water, projected that there is no water shortage and no mandatory water conservation target for DSRSD over the next three years; and WHEREAS , on June 21, 2016, DSRSD terminated its drought emergency and declared a Stage 1 voluntary 10% water conservation goal; and WHEREAS , California Government Code section 8630(d), requires that the City Council shall proclaim the termination of the local emergency at the earliest possible date that conditions warrant; and WHEREAS , the City Council finds that based on the findings and actions of the State, Zone 7 and DSRSD, conditions have improved to a degree whereby the City can terminate the local drought emergency; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin herebyterminates its local drought state of emergency. th PASSED, APPROVED AND ADOPTED this 19 day of July 2016, by the following vote: AYES : NOES : ABSENT : [ ABSTAIN : ______________________________ Mayor ATTEST : _________________________________ City Clerk
